Present were: Peter Young, Chairman Carol Brown, Member John Stein, Member Peter Meeker, Member Caroline Burghardt, Member Lauren Standish, Secretary Absent: John Chandler, Member James Dinizio, Jr., Town Board Liaison CALL TO ORDER Chairman Peter Young called the meeting to order at 4:35PM. CLIMATE SMART COMMUNITIES PROGRAM Peter Meeker didn't have any progress to report. There continues to be a problem with non-participation, therefore no activity. He asked Chairman Young for an update on a meeting with the Chief of Police. Chairman Young requested a format for the discussion before he schedules the meeting. Chairman Young, Carol Brown and Peter Meeker were going to meet with department heads at some point as well. Carol Brown expressed frustration with the lack of cooperation from the department heads and suggested a possible meeting with the town board. The town took a pledge in 2019 and she doesn't believe CSC is getting the attention it deserves and suggested a town staff person act as a liaison. John Stein reminded the council members that time was lost during 2020 due to the pandemic. Peter Young agreed that it's been a difficult year and a half. 2 Chairman Young and Peter Meeker will share ideas, development an agenda and contact the department heads in an effort to move this forward. REPORTS John Stein attended the Board of Trustees work session and regular meeting held on Thurs., March 18th. He participated in the work session discussion prior to the regular meeting where he was given the opportunity to address specific questions and concerns from the CAC. During the regular meeting, the application made on behalf of Southold Sunsets was denied w/o prejudice. NEW BUSINESS Chairman Young shared a Webinar announcement from the NYSDEC: Model Local Laws to Increase Resilience. Chairman Young and Carol Brown will interview a candidate for the vacancy on the CAC tomorrow, April 8th at 11:OOAM. APPROVAL OF MINUTES Moved by John Stein, seconded by Caroline Burghardt,,to Approve the Minutes of March 10, 2021. RECOMMENDATIONS -WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by John Stein, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of FARTHER OUT EAST, LLC to remove existing propane tank and hot tub; remove existing seaward deck and reconstruct remaining structure in-kind and in-place; reconstruct/expand existing seaward balcony by 52'; remove existing cellar entrance; abandon and remove sanitary system and install new IA/OWTS landward of existing dwelling; remove existing shed, chimney and 358 sf. of existing northeasterly deck; construct proposed porch, screen porch, new propane tank, new basement, new addition on northeastern corner of existing dwelling; and install 112 If. of retaining wall along the northeast corner of the subject parcel. Located: 860 Rabbit Lane, East Marion. SCTM#31-18-18 Inspected by: John Stein, Peter Meeker, Carol Brown The CAC does Not Support the application due to insufficient setbacks, the project is within the CEHA, and exceeds 20% of the building lot. Vote of Council: Ayes: All Motion Carried 3 Moved by John Stein, seconded by Carol Brown, it was RESOLVED to SUPPORT the application of RONALD SPILLANE for the installation of 80 If. rock revetment at toe of existing bluff, install 25 cy. of clean sand fill and plant Cape American beach grass. Located: 63403 North Rd., Greenport. SCTM#40-1-7 Inspected by: John Stein, Peter Meeker, Carol Brown The CAC Supports the application using best management practices, and recommends the work area be accessed by barge as there is no room,for a land-based crane. Vote of Council: Ayes Motion Carried Moved by Carol Brown, seconded by John Stein, it was RESOLVED to SUPPORT the application of JAMES WILLSE & SHARON STACK WILLSE for the installation of 266 If. of rip-rap shoreline stabilization along existing eroded bank. Rip-rap to consist of 1-2 ton sizes placed in a single row with filter fabric behind them and to prevent erosion between joints. Located: 1665 Mill Creek Dr., Southold. SCTM#51-6-31.4 Inspected by: John Stein, Peter Meeker, Carol Brown The CAC Supports the application and recommends the native, well-defined trees remain in-place, and the vegetation on the seaward side of the rip-rap is not removed. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by John Stein, it was RESOLVED to SUPPORT the application of PAUL & SUSAN WACHTER to demolish the existing dwelling and replace with a new two-story single family dwelling with attached decking and swimming pool and pool enclosure fencing. Construct new pervious gravel driveway, install a new IA/OWTS septic system, and install a rock revetment setback 10' from the landward edge of tidal wetlands. Vegetate the area seaward of the proposed rock revetment and landward edge of tidal wetlands. Located: 2295 Bay Shore Rd., Greenport. SCTM#53-4-15 Inspected by: John Stein, Peter Meeker, Carol Brown The CAC Supports the application, however, the property is prone to flooding. The proposed project is in conformance with the town code but there is a concern with the redevelopment and the close proximity to the flood zone. Vote of Council: Ayes: All Motion Carried 4 Moved by Carol Brown, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of PETER & VALERIE SAKAS to construct a 5'X 3'5" addition to the existing seasonal cottage; porch roof to be raised and extended to create dormer; window replacements; and interior alterations. Located: 65490 Route 25, Greenport. SCTM#53-5-12.6, Cottage #16 Inspected by: John Stein, Peter Meeker, Carol Brown The CAC Supports the application with the installation of gutters, leaders and drywells to contain the stormwater run-off, and hay bales and silt fencing during construction. Located: 65490 Route 25, Greenport. Install a shed 8'X 14' (setback 88.2' from tidal wetlands) east of the proposed swimming pool. ` 5 Located: 1585 Long Creek Drive, Southold. Any improvements to the property should include a 10' non-turf vegetated buffer. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Carol Brown, it was RESOLVED to SUPPORT the application of CHRISTIAN BAIZ, AS ADMINISTRATIVE MANAGER FOR DEKKA, LLC to repair the concrete seawall, install a bulkhead return 30 If. back to the secondary retaining wall within the southeastern corner of the property; install a bulkhead return 20 If. off the northern terminus of the existing seawall within the northeastern corner of the property; install a secondary bulkhead/retaining wall 439 If. 15' landward of the existing concrete seawall using vinyl sheathing; deposit 700 cy. clean fill obtained from an upland source between concrete seawall and proposed secondary bulkhead and planting with native plantings; and relocate the existing shed to the southwest (landward) to a minimum distance of 100' from the concrete seawall. Public lateral access of the shoreline should not be blocked. Existing 20'X 12'6" wood deck to remain. Proposed approx. 210 sf. addition/alteration to northside of existing dwelling. Demolish existing detached garage, proposed attached garage to northside of existing residence with bonus space above, and proposed 975 sf. asphalt driveway. Located: 3995 Wells Ave., Southold. DOROSKI to construct a retaining wall to capture stormwater causing erosion on property and steps to grade. Install three (3) new drywells landward of proposed retaining wall. Install haybales and silt fencing during construction and a 10' non-turf, non-fertilized buffer. Located: 425 Monsell Lane, Cutchogue. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Carol Brown, it was RESOLVED to SUPPORT the application of JAMES & PHYLLIS RUBIN for the construction of a 215 If. natural stone boulder border along the landward side of the existing wetlands to prevent salt water intrusion during storm tides. Install a silt fence between stone and existing wetlands to remain until area is stabilized. 40 cy. of clean sand fill will be placed landward of proposed stone and disruption area will be planted with non-fertilizer dependent grass seed. Removal of existing catwalk and replacement in same location with a 4'X 32' long fixed catwalk. All decking to be thru-flow and performed from an upland location. Located: 3915 Stillwater Ave., Cutchogue. SCTM#137-1-5.1 Inspected by: Peter Young, Caroline Burghardt The CAC Supports the application with the installation of gutters, leaders and drywells and a plan to address the stormwater run-off that is flowing into the creek from the concrete slab. Vote of Council: Ayes: All Motion Carried Moved by Caroline Burghardt, seconded by Peter Young, it was RESOLVED to SUPPORT the application of LAURIE M. HELGANS to raise (in-place) existing two-story, single-family dwelling by approx. 18" over new foundation, with new egress, three new window wells, two new sets of steps in place of existing, and a new chimney in place of existing; and installation of a drainage system consisting of leaders, gutters and drywells. Located: 1285 Fleetwood Rd., Cutchogue. SCTM#137-4-29.1 Inspected by: Peter Young, Caroline Burghardt The CAC Supports the application with the recommendation of an I/A septic system, a drainage plan, and a non-disturbance buffer along the slope between the top of the bluff and the bottom. Vote of Council: Ayes: All Motion Carried ELIZABETH CALLANDER to construct 105 If. of 4' wide wood pile and timber pier of which 65 If. is waterward of the apparent spring high water line, including five associated ladders, rails, electric, and water utilities, a 90SF boulder mounted dock with access walkway and three new tie-of piles, waterward of the apparent high water line. Located: 12244 East Main Road, Fishers Island. SCTM#3-2-6 The CAC did not make an inspection, therefore no recommendation was made. RECOMMENDATIONS-APPLICATIONS TO AMEND WETLAND & COASTAL EROSION PERMIT APPLICATIONS Moved by Caroline Burghardt, seconded by Peter Young, it was RESOLVED to SUPPORT the application of SAM ORLOFSKY to Amend Wetland Permit #9638 and Coastal Erosion Permit#9638C to restore the damage to existing bluff with plantings and timber terracing boards. g Located: 1'8575 Soundview Ave., Southold. SCTM#51-1-12 Inspected by: Peter Young, Caroline Burghardt The CAC Supports the application with retractable aluminum stairs at the base of the beach stairs, and the bluff slope is designated as a non-disturbance buffer on the final site plan. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Caroline Burghardt, it was RESOLVED to SUPPORT the application of STUART & BETH MACKINNON to Amend Wetland Permit#9740 to remove and replace 16' return on north side in a location 2' south on property line; install new 12' return on south property line; install 10'X 20' deck and 4' wide boardwalk on grade using untreated hardwood decking.
