The drain for that shower is connected to the nearby drywell which also receives the roof runoff. • Pool Terrace was reduced 14 foot by 14 foot, or 196 sq. ft., at the south end of the pool, and fireplace unit was moved closer to the edge of the swimming pool, as now shown. • Beyond your jurisdiction, the western concrete retaining wall at crawl space entry was replaced by a timber retaining wall, 30 foot long by 12 foot wide, which is filled for support of a 'dog run', of 360 square feet. • The double doors noted are for access to the crawl space, and are surrounded by the requisite flood vents. There is no garage in this location. This area is also beyond your jurisdiction. • The beach grass shown on approved SITE PLAN will be planted in time for your next inspection. While the proposed relocation of the primary residence landward of the existing structure supports Trustee goals, the proposed 1541 sq. ft. pool house with electricity, water and septic, the approximately 1400 sq. ft. stone terrace on grade, and the nearly 400 sq. ft. deck sitting area, clearly do not. Since the proposed construction of the aforementioned structure is in an environmentally sensitive area, the Board of Trustees strongly recommends the pool house, stone terrace on grade, and the deck sitting area all be relocated 20 feet landward from their respective positions as shown on the site plan. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. Policy 4.1. "Minimize losses of human life and structures from flooding and erosion hazards." The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended: specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for a. structures which functionally require a location on the coast or in coastal waters. The parcel is located within the FEMA Flood Zones VE and AO and is known to flood during storm events (See below photo). VE zones are areas subject to inundation by the 1-percent-annual- chance flood event with additional hazards due to storm-induced velocity wave action. AO zones are areas subject to inundation by 1-percent-annual- chance shallow flooding where average depths are between one and three feet. The proposed residential structures do not require a location on the coast. The pool house is located 35' to the bulkhead and 50.9' to high water. The pool is proposed at 50.9' to the bulkhead. Chapter 275 Wetlands and Shorelines requires a 100' setback for all structures from the natural protective feature (beach in this instance). Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by sorne method, feasible for the applicant to pursue, other than an area variance. The applicant could build-a structure with a code conforming setback. However,the variance relief requested is relief from the setback to a foot path and not a heavily trafficked road. The applicant has two front yards and the proposed non-conforming setback is for the architectural side yard. The applicant's proposed dwelling does meet the side yard setbacks. 3. Town Law&267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 40%relief from the code. However, the non-conforming setback is still a significant distance from a lightly trafficked foot path providing access to the beach. In addition,the applicant is burdened by having two front yards. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code, and the conditions imposed herein will help to protect future water quality 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created.
