Attached is a revised plan my office received from Melissa Cicetti,Studio Cicetti Architect PC, dated 07/29/2022. The plan shows a 2'wide increase to the approved addition described as follows: to construct an addition to the basement,first,and second stories of the existing dwelling along its southerly face measuring 12'x 31.2' (311.25 sq.ft);construct a roof deck above the first story addition and extending 46.2 feet from the westerly end of the addition towards the seaward face of the existing dwelling 12'x 27.4' (274 sq.ft) deck at first floor. Extend lower slab on grade terrace 12'x 12.5' and relocate existing outdoor cooking equipment.These changes, although partially within the 100 foot setback,will not have any adverse impact. The widening of the addition is to the south of the residence and does not extend further to the east,towards the bay. During the public hearing which took place on May 19, 2021, Trustee Krupski suggested that it may be appropriate to add more rock to the toe armor. We have carefully considered Mr. Krupski's suggestion and have concluded as follows: 1. Adding another course of rock above the toe armor would destabilize the toe armor and overall structural integrity of this shore protection structure. (See attached engineering report prepared by Joseph Fischetti dated May 27, 2021.) 2. Relocating the fronting wall further landward would also impact upon the structural integrity of the overall shore protection structure. (See attached engineering report prepared by Joseph Fischetti dated May 27, 2021.) 3. Extending the total armor structure into the water would result in impacts to public bottomlands and would be rejected by the New York State Department of Environmental Conservation and contrary to the Town's Local Waterfront Revitalization Policies.(The Board should take notice that the entirety of the structure is located on private property.) The Board should take notice that none of the recently reconstructed bulkheads along this stretch of shoreline contain fronting toe armor. Finally, during the Trustee meeting of May 19, 2021 the Board requested preparation of a Long Environmental Assessment Form ("LEAF"). The fronting angle of the toe armor is 45° as recommended by Corp of Engineers I am advised that one of the Trustees requested more rock be added to the toe armor. Adding an additional course of rock above that which is now proposed will result in an un-stable structure. Extending the base of the toe armor into the water(so that an additional course of rock can be added)will result in an un-stable structure follows: Relocating the fronting wall landward will reduce the width of the splash pad and the backing system thereby reducing the structural integrity of the overall wall structure. I do not recommend relocating the fronting wall landward. It is my opinion that the toe armor shown on and May 16, 2021 drawing provides for adequate protection of the fronting wall. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, is recommended as CONSISTENT with the LWRP. It is my recommendation that the proposal to construct 198 linear feet of bulkhead previously approved shortly after hurricane Sandy not built but removed, a 12 foot return on the South and of the bulkhead a 12 foot wide splash pad between the lower and upper bulkheads and a 10'x 20'at grade platform, is INCONSISTENT with Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The 10' x 20' at grade platform is proposed to be located within a FEMA Flood Zone VE (Velocity Hazard). Structure in these areas should be relocated or minimized due to threat of repetitive loss and damage from storms. Policy 4.3 Protect public lands and public trust lands and use of these lands when undertaking all erosion or flood control projects. B. Avoid losses or likely losses of public trust lands or use of these lands, including public access along the shore, which can be reasonably attributed to or anticipated to result from erosion protection structures. The bulkhead's seaward projection may result in the impact and loss of public lands (beach). Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
