Box 202 Fishers Island, NY 06390 ACTIVITY: From the seaward end of an existing six-foot-wide by 59-foot-long fixed pier, install a six-foot-wide by 20-foot-long fixed pier extension and a -dew four-foot-wide by 16-foot-long ramp leading to a new eight-foot- �V ide ou 19-foot-long float from the seaward terminus of the new fixed ier extension. The proposed work also includes installing two (2), 12-inch diameter ` SUPERVISOR'S OFFICE piles approximately 12 feet east of the float and approximately 19 feet 7D�;vN OF SOUTHDLD apart and two (2), 12-diameter piles approximatelly 12 feet west of the float and approximately 19 feet apart. The proposed structures will extend approximately 66 feet into the waterway measured from the plane of Mean Low Water. B-Trustees Procedural History: _ 1. Application The applicant filed an application with the Board of Trustees on April 16, 2021 to remove an existing Tx 11. Tramp, 8' x 15. T float and piles as necessary, all of which were approved under a previous wetlands permit; construct a 6' x 20' extension onto the f seaward end of a 6' x 59' fixed dock,which was approved under a previous wetlands permit and install a 4' x 16' aluminum ramp, 12 new piles and an 8' x 18. 5' float. Under Section 6 Definitions -Unregulated Activities,the proposed reconstructed dock exceeds the 200 sf limitation, and therefore by code, must be removable. A dock of less than 200 sf could not be used for docking as it would not be long enough to reach the depths 4 needed to safely dock a boat due to water depths. The proposed work is within a near shore area in a Coastal Erosion Hazard Area located on property on parcel SCTM# 1000- 10- 9- 6. 1, 520 Sterling Street, Fishers Island,New York. 11. Public hearing: The Trustees held a public hearing on this application on June 16, 2021 and July 14,2021 at which times all those interested were given the opportunity to speak, t i 111. Trustees Determination and Certificate of'Ccmpliance. On July 14, 2021 the Trustees issued a determination stating that the proposed construction fell outside the jurisdiction of the Board of Trustees due to the proposed application being located within the designated Coastal Erosion Hazard Area and therefore the Trustees could not issue a permit under the tidal wetlands act denigd the application without prejudice, and as such further application would need to be made to the Town Board. IV.The Toivn Board Proceeding On August 11, 2021, the property owners timely filed an appeal of the Trustee's determination pursuant to Town Code Chapterl 11 with the Coastal Erosion Hazard Board of Review (the Board) seeking the reversal of the Trustees denial. The Board held a duly noticed laublic'licaring on October 5, 2021, at which time all interested parties were given the: opportunity to prescnt testimony on the application. Glenn Just of JMO Environmental Consulting Services on behalf of the applicant addressed the Town Board's concerns with regards to the application to remove an existing Tx 11. 5' ramp, 8' x 15. 5' float and piles as necessary, all of which were 2 approved under a previous wetlands permit; construct a 6' x 20' extension onto the seaward end of a 6' x 59' fixed dock, which was approved under a previous wetlands permit and install a 4' x 16' aluminum ramp, 12 new piles and an 8' x 18. 5' float. APPEAL OF THE TRUSTEE'S DEM kM1 ATION, Pursuant to §111-24 the Town Board is designated as the Coastal Erosion Hazard Board of Review and has the authority to "[h]ear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by the Administrator in the enforcement of this chapter."See,Town Code §111-24 (B). Furthermore,the Coastal Erosion Hazard Board of Review has the authority to "reverse ; or affirm, wholly or partly, or may modify the order,requirement, decision or determination of the Administrator, including stop or cease-and-desist orders." See, Town Code§111-25. F E When considering appeals pursuant to §§ 111-24 &25,the Board is limited to the record on appeal and the arguments made before the Board of Trustees. In this instance, this Board finds, based upon the record before,it,that the applicant has supplied the sufficient information regarding the criteria set forth in §1 I 1-9(A-C)of the Town Code to support the granting of a Coastal,Erosion Management Permit. CONCLUSION Therefore, in the interests of justice and for the reasons set Tforth herein,this Board grants the appeal of the Applicant pursuant to Chapter 111 of the Town Code to authorize applicant to remove an existing Tx 11. 5'ramp, 8'x 15. 5' float and piles as necessary,all of which were approved under a previous wetlands permit; construct a 6' x 20' extension onto the seaward end of a 6' x 59' fixed dock, which was approved under a previous wetlands permit and install a 4' x 16' aluminum ramp, 12 new piles and an 8' x 18. 5' float. Environmental Consulting on behalf of HARBOR VIEW COTTAGES LLC, c/o THOMAS SHILLO requests a Wetland Permit and a Coastal Erosion Permit to remove existing ramp, float and pilings as necessary; construct a 6'x20' extension to the seaward end of the existing fixed dock; install a 4'x16' aluminum ramp; install 12 new piles, and an 8'x18.5'floating dock. Located: 520 Sterling Street, Fishers Island. SCTM# 10-9-6.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is recommended as INCONSISTENT with the LWRP policies. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested.- A. uggested.A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. a. No development is permitted in natural protective feature areas, except as specifically allowed under the relevant portions of 6 NYCRR 505.8. The fixed portion of the proposed dock is within the Coastal Erosion Hazard Area (CEHA) and equals 200' in top surface area. All development is prohibited in the nearshore area pursuant to § 111-11. unless specifically provided for by Chapter 111, COASTAL EROSION HAZARD AREAS. Pursuant to § 111-6, allowable or unregulated activities in these areas may include docks built on open timber piles or other similar open work supports with a top surface area of less than 200 square-feet OR which are removed in the fall of each year. The dock exceeds the 200 square feet and will not be removed each year, therefore, the dock, as proposed, is prohibited in the nearshore area pursuant to Chapter 111, COASTAL EROSION HAZARD AREAS 6.3 Protect and restore tidal and freshwater wetlands.
