WHEREAS, Samuel W. Fitzgerald, AIA on behalf of JAMES H. The northerly east property line measures 110.00 feet and is adjacent to Equestrian Avenue and runs to the northeast point of the property line that runs northeast and measures 105 feet where it then meets the southeast corner point of the property that measures I I5feet and runs to the southwest point of the property which measures 105 feet and continues northwest to Equestrian Avenue. The parcel is improved with a framed two-story dwelling. There is a detached single car garage on the southeast corner of the property that is reached by a paved driveway from Equestrian Avenue. There is a freshwater wetland located on the subject property as shown on the survey prepared by Craig P.Bigger,LS and dated December 28,2020. Page 2,March 18,2021 -' #7474,Carney SCTM No. 1000-9-6-3 BASIS OF APPLICATION: Request for Variances from Article XXIU, Sections 280-124 and the Building Inspector's December 15,2020 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling;at 1)located less than the code required minimum front yard setback of 35 feet;2)located less than the code required minimum rear yard setback of 35 feet;located at Equestrian Avenue, Fishers Island,NY. RELIEF REQUESTED: The applicant requests variances to construct additions and alterations to an existing single- family dwelling with a front yard setback of 20.8 feet and a rear yard setback of 22 feet where the code requires a a minimum front yard setback of 35 feet and a minimum rear yard setback of 35 feet as shown on the Site Plan prepared by Sam Fitzgerald,Architect PC, dated November 15, 2020.The plans call for the conversion of a corner of the house to an open porch(46 sq.ft.),2)remove a small portion of the existing roof to make an inset dormer, 3) construct a new covered porch at the rear of the property,4)construct a new one-story addition(96 sq.ft)at the rear of the dwelling.The applicant's house is one of the smaller homes in the neighborhood. ADDITIONAL INFORMATION: Although the application submitted to the Building Department is for proposed construction, the applicant's builder started construction on the house without permits. This work was eventually halted by the Town's Chief Building Inspector,who submitted photographs of the"as-built"construction to members of the Zoning Board of Appeals. The applicant's neighbor testified at the public hearing in support of the application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 4,2021 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The front yard setback is similar to other homes in the neighborhood. This is a very old home that the applicants wish to update and bring restore the architectural charm of the original Victorian dwelling. The prosed additions are all small and will not block any views from adjacent properties 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The non-conforming setbacks are existing so any work on the existing dwelling will require variance relief 3. Town Law X267-b(31(b)(3). The variances granted herein are mathematically substantial, representing 40.5% relief from the code for the front yard setback and 37%relief from the code for the rear yard setback.However,the house was built in the 1800's before zoning laws were in place. The applicants wish to update the dwelling and restore it and only 60 square feet of livable floor area will be added. 4. Town Law X267-b(31(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The architect, stated at the hearing that the applicants plan to add a buffer to protect the pond on the property along will dry wells to prevent runoff from the roof to further protect the wetlands located on the property along with abandoning the old septic system and replacing it with anew system. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 3,March 18,2021 #7474,Carney SCTM No. 1000-9-6-3 5. Town Law 5267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 5267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
