MA FINDINGS,DELIBERATIONS AND DETERMIN rgON MEETING OF NOVEMBER 21,2019 ®u old Town Clerk ZBA FILE:7330 NAME OF APPLICANT: Phillip &Linda Kermanshahchi PROPERTY LOCATION: 7312 Great Peconic Bay Boulevard,Mattituck,NY SCTM No. 1000-126-10-1.2 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD OFFICE OF ENGINEER: This application was referred for an evaluation and recommendation to the Office of the Engineer. In their letter dated October 16,2019,the Engineer stated that there are no other concerns about the structure due to the current conditions of the adjacent structures, beyond what the Building Department has already addressed. However, the site has never received a formal stonnwater review under Chapter 236 prior to construction. The engineer would recommend that the applicant submit a plan indicating any and all drainage systems that have been installed on the site. PROPERTY FACTS/DESCRIPTION: The subject property is a 130, 532 sq. ft. parcel located in an R-40 Zoning District. The property is located approximately 400 ft.north of Peconic Bay Boulevard on a private Right of Way. The property has a frontage of 229.23 ft. along the right of way, which then turns west 396.22 ft. before turning south 397.29 ft. It then measures 489.30 ft. towards the east and the right of way frontage. The residence is located close to the east side of the property along the right of way.The parcel is improved with a single-family two-story dwelling shown on the survey by Nathan Taft Corwin,Land Surveyor, last revised May 8,2019. BASIS OF APPLICATION: Request for a Variance from Article IV, Section 280-14 and the Building Inspector's May 17, 2019,Notice of Disapproval based on an application for a permit to legalize an "as built" second story on an existing single family dwelling; at, 1) less than the code required front yard setback of 60 feet; located at 7213 Great Peconic Bay Blvd.,Laurel,NY. RELIEF REQUESTED: The applicant requests a variance to legalize an"as-built" second story addition having a front yard setback of 15.2 feet to the foundation(14.4 feet to the roof overhang)where the bulk schedule requires a front yard setback of no less than 60 feet Page 2,November 21,2019 #7330,Kermanshachi SCTM No. 1000-126-10-1.2 ADDITIONAL INFORMATION: As per written submission and oral testimony by the applicant's agent, a variance was granted(# 5986, dated February 8, 2007)for an as-built addition of a two story attached garage with only unheated attic storage space on the second floor,with a setback of 14 feet,4 inches from the easterly property line along the Right of Way. Sometime after this, instead of building what was granted, the owner added dormers to the second floor of the garage and converted it to habitable space. A Certificate of Occupancy # 40299 was issued on April 5, 2019 for an "as-built" garage addition. An inspection report dated April 15, 2019 noted the existence of the second-floor additions to the attached garage. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 7,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's property has frontage along a private Right of Way, which extends approx. 400 feet north of Peconic Bay Boulevard. The existing 14'-4" setback to the garage roof overhang(15. 2 feet to the foundation) is greater than the five-foot setback of the adjacent house to the south, and also greater than the three-foot setback of the next house to the sgth. The existing structure legally exists under past Certificates of Occupancy, and the second-floor alterations to the attached garage do not extend past the lines of the existing house,the first-floor setback lines, or the roof lines. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing attached garage and roof structure above already legally exist under past Certificates of Occupancy and with the benefit of variance relief for a front yard setback. However, the applicant ignored the ZBA condition of approval limiting the second floor of the garage to unheated attic storage space by adding a dormer for head room and converting the attic to habitable space. Any work to this area of the house that was not granted by prior variance relief from the zoning code will require additional relief. 3. Town Law V67-WAW). The variance granted herein is mathematically substantial, representing approximately 74.6 % relief from the code. However, the as-built second floor alterations to the legally existing attached garage do not increase or change the degree of non-conformance of the previously approved front yard seback. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law V674(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law V67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second story bedroom while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. For example, under the proposed garage the roof frame and beams of the original carport temporarily remains. This carport on the south side of the house was enclosed with plywood and a shower door was used as a window and skylight. Another roofed over shed existed on the north side of the house which has been removed. The attic floor consisted of wood doors laid end to end. Mr Perini's widow removed 7 large dumpsters from the property and Mr. Kermanshahchi remo,,�ed two more dumpsters after he and his wife purchased the property in 2004. Mr. Kermanshahchi and his wife have been slowly replacing the rotted siding and roof shingle, high quality Anderson windows replaced the mismatched storm windows and glass panels and sheet rock replaced the paneling. The applicants have been replacing the previous owner's work little by little,so when they extended the garage they did not realize that a permit was required and that a variance would be needed. The average setback of structures to the right of way are: The neighboring properties are similarly setback close to the road. A survey was prepared which shows the average setback of the neighbor's properties. The only new house is Kraebel on the corner of Peconic Bay Boulevard and the right-of-way. Kraebel received a variance to build a new house in 1995 (Appeal No 4342)at 20 feet from the edge of the right-of-way. I ,C%I l The location of the garage could not be relocated. The applicant's house is existing and interior spaces laid out. The location of the existing car port is now the proposed garage. This space has a door which leads to an existing hallway,the garage could not be placed on the opposite conforming(north side) side because the garage would block the children's room and windows and the access door would need to be in the children's room. The children's room is on the north side of the house and a sun room is in the rear. The only location for the garage was where it was proposed and partially constructed. The top of the roof of the addition is 176" and was designed to connect to the existing roof pitch. The architectural style of the residence has be7n retained and continued with the eves that rap around the house. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The original structure was retained therefore when the garage was added it increased the nonconforming setback toward the right-of-way. The house location is preexisting nonconforming. The road is a private right-of-way on a minor subdivision map. The existing structures were located on the property when the land was subdivided. The applicant retained the existing house, the addition of a garage reduces the setback to the right-of-way. The applicant's effort at retaining the character of the home is appreciated by the neighbors. The only alternative,given the existing interior layout of the house,would have been to build a detached garage. X" detached garage was not chosen because the garage also provides a location for an updated heating system and extra storage space. The roof pitch was chosen to make a clean transition to the existing roof line- The garage also gives greater architectural style to the front of the existing house. The applicant has three young children under 7 years of age,he and his wife each have a car. Between the children's toys and seasonal equipment,the garage space is very needed. Unlike his predecessor, the applicant wishes to keep the property neat, orderly and properly stored. (3) The amount of relief requested is not substantial because: The right-of-way is used by Kraebel-lot 1 (126-10-1.5)which obtained a variance for 20 feet to the right-of-way. Denston, Lot 2 (126-10-_)contains existing buildings(formerly the camp chapel and dining hall)which do not appear to be dwellings. Denston, Lot 4 (126-10-1.4) existing dwelling is to the right-of-way. Two other homes which do not use this road(1000- 126-10-12.1 & 12.2)but the homes are located at less than 5 feet to the right-of-way. While, these two homes do not use the right-of-way the structures are very close to the right-of-way�and reflects the character of the neighborhood. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The house was the original girls bath house. The interior spaces,prior to sheet rock,contained names and dates of the campers. The home was purchased as an existing residence and the setbacks were established. The lot is very large (over 2 acres)but the house is located close to the road in the original location of the camp building. The owner has improved the existing conditions of the property. We have been advised that the Village of Southold has very specific limitations on the number of dens or family rooms a home can have.
