HomeMy WebLinkAboutLP-04/13/2021 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, April 13, 2021 at 7:00 p.m. This meeting will be held virtually via the Zoom online platform. Pursuant to Executive Order 202.1 of New York Governor Andrew Cuomo, in-person access by the public will not be permitted. This is a public meeting and the public will have access to view and listen to the Regular Meeting as it is happening via Zoom. If you do not have access to a computer or smartphone, there is an option to listen in via telephone. Comments from the public may not be solicited nor received without an appointment. The Land Preservation Committee may add or remove applications from the Agenda upon its discretion, without further notice. Applications may not be heard in the order they appear on this Agenda. It is expected that the Committee will enter into Executive Session* after the Regular Meeting for the purpose of discussing applications regarding proposed acquisitions of real property where publicity would substantially affect the value thereof. All “Attendees” will be dismissed from this meeting upon the Committee’s Motion to enter into Executive Session.  The meeting began at 7:03 p.m. with six LPC members present. Committee Minutes and Administration  Acceptance of LPC meeting minutes from March 30, 2021 MOTION made by Sam McCullough, seconded by Doris McGreevy, to accept the 3/30/2021 LPC meeting minutes. Motion carried: 7/0  Next Regular LPC Meeting Date The next regular meeting is scheduled for Tuesday, April 27, 2021. Code Committee meeting to be held on Tuesday, April 27, 2021 at 2:00 p.m. to discuss proposed changes to Town Code, Chapter 70. LPC members Sam McCullough, Anne Murray and Doris McGreevy will participate. LPC members Will Lee and John Simicich plan to attend, if able, and Melissa will inform the Supervisor’s office of intended LPC attendees. Inquiries for Uses or Structures on Preserved Property  SCTM #1000-107-10-10.4 (MCB 6900 f/k/a 6900 WICKHAM AVE LLC) Request for use within Town PDR Land Preservation Coordinator Melissa Spiro presented background information on this property and the LPC application submitted by Element Energy on behalf of current landowner, Kevin Cande of MCB 6900 LLC. The proposed plan is to install a 107.42 KW Solar Photovoltaic (PV) system. There are two areas proposed for the solar energy system; on the roof of an existing barn and a groundmount system on the south side of the greenhouse. The proposed roof top arrays are not within the area subject to a Town development rights easement and, therefore, not reviewed by the LPC. As per the request form, the following is proposed within the area subject to the Town development rights easement:  Solar PV Groundmount system is 29.52kW(DC). Its sole purpose is to produce energy to offset the greenhouses’ electrical usage, making the production of the agricultural system more sustainable and environmentally responsible.  The Groundmount system, to be located on the south side of the greenhouse as shown on the site plan, is shown as two arrays: o Array #5: 60 modules; length 132’-71/2” by 9’ 10 1/4” o Array #6 :18 Modules; 39’ 9” by 9’ 10 ¼” MOTION made by Eric Keil, seconded by Anne Murray, that the Land Preservation Committee reviewed the request of Element Energy application on behalf of MCB 6900 LLC and finds that the proposed Groundmount arrays and use, for agricultural production at the site, as consistent with the terms of the recorded easement. Motion carried: 7/0 The Committee members thanked attendees from Element Energy, Mike Lawton and Fred Azar, for their participation in this meeting to provide further information and clarification of the proposed energy project, as well as John Pratnicki from PSEG for his comments.  SCTM #1000-69.-4-8.8 (WESNOFSKE) Monitoring update HOLD – will discuss at another LPC meeting. General Land Preservation  REVIEW EASEMENT UNDERGOING REVIEW BY AGRICULTURAL ADVISORY COMMITTEE The Agricultural Advisory Committee is undergoing review of an easement format and is reviewing a recorded easement from 2006 (EWH, LLC/Peter Harbes). The Town Board asked LPC to review this easement also. Land Preservation Coordinator Melissa Spiro presented easement and LPC discussed. Discussion to continue at next meeting.  NYS AGRICULTURE & MARKETS Round 18 Farmland Protection Implementation Grants (FPIG) th Information from April 13 Webinar NYS Agriculture & Markets has recently announced funding opportunities available in Round 18 Farmland Protection Implementation Grants (FPIG). Land Preservation Coordinator Melissa Spiro gave highpoints from webinars she attended regarding this State grant. Melissa will continue review regarding potential projects and will discuss again with LPC. Land Preservation Applications & Potential Applications  EXECUTIVE SESSION MOTION made by Eric Keil, seconded by Anne Murray, to enter into EXECUTIVE SESSION – Proposed Acquisitions of Real Property Where Publicity Would Substantially Affect the Value Thereof Motion carried: 7/0 The LPC members entered in EXECUTIVE SESSION at 8:42 p.m. Meeting locked and recording stopped.  Land Preservation Coordinator gave updates on inquiries, new applications, appraisals and current applications.
