COUNCILMAN DINIZIO: I don't know, I thought we were putting him on hold because we had to wait for an academy that's not coming till the fall. COUNCILWOMAN DOHERTY: I thought, wait, oh, I didn't hear. So they are not having one in the fall now? COUNCILMAN DINZIO: I don't know that the Chief knows. SUPERVISOR RUSSELL: Inaudible. COUNCILWOMAN NAPPA: These are the seasonal officers. SUPERVISOR RUSSELL: They would be required to go through an academy. Usually the academy starts in October. The county hasn't announced yet whether they are going to be able to have the academy in October based on obviously pandemic concerns and fiscal concerns. So we Page 11 Southold Town Board Regular Meeting March 9, 2021 page 12 are hiring them now although they can't start working for the town until they complete the academy. COUNCILWOMAN DOHERTY: Right,the Chief said that and he also implied that he thought it would start this spring since they didn't have one last fall. That's the last I heard. I guess it's changed? SUPERVISOR RUSSELL: They might. They might very well. COUNCILWOMAN DOHERTY: Okay. COUNCILMAN DINIZIO: We can always change it. Town Attorney E-Filing for Tax Grievances WHEREAS, the County of Suffolk and each of the ten Suffolk County Towns are in a State of Emergency with the entire State of New York as declared by the Governor as of March 7, 2020, due to COVID-19; and WHEREAS, in light of the foregoing, the Town of Southold, the Supervisor, the Board of Assessors and the legal representatives of the Town recognize the need to reduce expenses, to conserve resources and to maintain some type of"social distancing" into the future. Therefore, there is a need to make certain changes to the current procedure for service upon the Town of administrative complaints challenging the assessment of real property as authorized under Article 5 of the Real Property Tax Law. The address is 24085 Main Road (NYS Route 25) in Cutchogue. The property is located in the Agricultural- Conservation (A-C) Zoning District and is situated on the northerly side of Main Road (NYS Route 25) approximately 1332 feet westerly from the intersection of Alvah's Lane and Main Road (NYS Route 25) in Cutchogue,New York; and WHEREAS, the proposed acquisition is for a development rights easement on a part of the property consisting of approximately 64± acres (subject to survey) of the 77.8± acre parcel. The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land Preservation Committee and the property owner; and WHEREAS, the easement will be acquired using Community Preservation Funds. The purchase price is $64,203.00 (sixty-four thousand two hundred three dollars) per buildable acre, estimated at $4,108,992.00 (four million one hundred eight thousand nine hundred ninety-two dollars) for the 64± acre easement. PH - 3/9 4:30 pm WW Farms Dev Rights Easement Acq COUNCILWOMAN DOHERTY: NOTICE IS HEREBY that pursuant to the provisions of Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands) of the Town Code, the Town Board of the Town of Southold hereby sets Tuesday, March 9, 2021, at 4:31 p.m., Southold Town Hall, 53095 Main Road, Southold, New York as the time and place for a public hearing for the purchase of a development rights easement on property owned by WW Farms, LLC, Said property is identified as part of SCTM#1000-109.-1-11. The address is 24085 Main Road (NYS Route 25) in Cutchogue. The property is located in the Agricultural- Conservation (A-C) Zoning District and is situated on the northerly side of Main Road (NYS Route 25) approximately 1332 feet westerly from the intersection of Alvah's Lane and Main Road (NYS Route 25), Cutchogue, New York. The proposed acquisition is for a development rights easement on a part of the property consisting of approximately 64f acres (subject to survey) of the 77.8 acre parcel. The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land Preservation Committee and the property owner. The easement will be acquired using Community Preservation Funds. The purchase price is $64,203.00 (sixty-four thousand two hundred three dollars) per buildable acre, estimated at $4,108,992.00 (four million one hundred eight thousand nine hundred ninety-two dollars) for the 64± acre easement. Purchase price will be adjusted at time of closing based on final survey acreage determination, plus acquisition costs. The property is listed on the Town's Community Preservation Project Plan as property that should be preserved due to its agricultural value. MELISSA SPIRO: Melissa Spiro,Land Preservation Coordinator. First I would like to share my screen, okay, great. I wanted to zoom out from the subject property. The subject property is the small red dot here and I will zoom in in a few minutes. What I wanted to show, the map on the left is from the year 2000 and the map on the right is from 2020, just about 20 years later. This area here is Main Road, Mattituck Creek, Goldsmiths Inlet and the Long Island Sound. This area is the area of the town that is the most significant agricultural area, it is predominantly zoned agricultural conservation. The green represents preserved land,the light green town preserved parcels, the dark green are county. Most of this area that I am showing here contain prime agricultural soils, the contains the town groundwater protection area. The Land Preservation Committee and the Town Board over the years have focused on preserving prime agricultural soils, have focused on expanding blocks of preserved farmland and these maps, side by side from 2000-2020, show and I think really show what the town has achieved in this area in the past 20 years. You can see the blocks of green preserved farmland are expanding and covering almost this entire area. I would like to now zoom into the subject farm, this is WW Farms here, the parcel that the description was read for. This farm, as you can see from the picture, preservation of this farm achieves the town's goals, it expands the blocks of preserved farmland and in this case, it connects and almost completes this block of farmland between the two roads. This is Main Road over here, this is the Long Island Railroad and CR 48.... MODERATOR: Melissa, I wanted to just say, if you are pointing with your mouse I don't know that everyone can see that. MS. SPIRO: I was pointing with my mouse but I can just kind of describe, I did scroll down to another image,you can't see that. How's that? Is that better? MODERATOR: Yes,we can see that. Thanks. MS. SPIRO: Is that working now? SUPERVISOR RUSSELL: That's a pretty screen saver. MS. SPIRO: How's that? Okay, great. So now you can see my picture. Here is the subject property and you can see from the green on both sides of this that preserving this property will connect the entire block. This is Main Road, Long Island Railroad and CR 48. Without crossing the railroad or any other road, there are over 100 acres on the west side of this property that are already preserved, over 100 acres on the east side that are already preserved and once we preserve WW farms the block will exceed 270 acres of farmland. So achieving the town's goal of creating these blocks of farmland and as I showed you, filling in all of the green. As you know,the property is over 77 acres and with an exception of a small area right here in the middle, the property is made up of prime agricultural soils. The landowner is selling the development rights on 64 acres,they are retaining the development rights on approximately 13 acres. The house on Main Road is not part of this project, everything within the red line is part of the project. The 13 acres that are being splitted are shown within this blue dotted line, the 13 acres were designed by the land owner to include the land that was not under cultivation. As part of the purchase, there is a restriction on here that should the 13 acre parcel ever be subdivided down further, at least 80,000 square feet which is the equivalent of about two acres will remain attached to the farm as a development area. I am happy to present this project today, it really is a wonderful farmland project to preserve 64 acres, the preservation of this farm will bring the total amount of preserved within the Town of Southold which are both town and county owned development rights to over 4,600 acres. I am thankful to the landowner, I Page 25 Southold Town Board Regular Meeting March 9, 2021 page 26 can't tell whether or not she is signed on to this meeting but I am very thankful to the land owner for giving us this opportunity to protect this farm. Without the landowners offering their development rights to the town, we cannot succeed. The Land Preservation Committee and I ask the Town Board to proceed with this acquisition and I am here to answer any questions. Karen Wallace KAREN WALLACE: Thank you for the opportunity to address you. I am Karen Wallace and I live at 2000 Hallock Lane in Mattituck. I would like to discuss the evolution of the town's perspective on agricultural land use over the past 15 years. It's an important issue obviously because 30 percent of the town's land is dedicated to agricultural use and many of the recent goals across the chapters in the towns comprehensive plan emphasize the importance of farming operations, supporting farming operations. However, it's also important to recognize the town's policy regarding agricultural land has changed over the past 15 years, in 2016 the building department wrote the following to a row crop farmer 'I cannot assume anything but a blatant disregard for the code of the Town of Southold on the part of the property owner, we ask that for the sake of the Town of Southold, the future of this property and most importantly for the sake of the general public, that an inventory of uses and buildings be submitted immediately.' In 2019, Supervisor Russell in connection with the purchase of development rights from a similarly situated farmer said 'I think you will find that the agricultural community are an excellent stewards of the land. If we get into the habit of micro-managing how they run their business, we might see the end of the PDR program and that is a bad, bad precedent for the policy of this town.' The towns policy has gone from expressing specific concerns over changes in land use and consideration of the impact of those changes on the public, to a position that it is in the publics interest not to enforce some of its property rights over that land and not to enforce zoning or other restrictions in place, that are currently in place through the town code to protect the publics welfare. And the town has rationalized this transition by regularly misrepresenting New York State's legal definition of farming in an effort to not micro-manage. I think it is important to bring the Board's attention to what this policy shift looks like on the ground and I will do so over your future meetings, by coming back to show you how farm operations that the town is representing as protected under New York State law are actually impacting the community. The first quarter mile of Sound Avenue in Southold Town provides some excellent illustrations of the activity the town is rationalizing as protected farming. The stretch has been prioritized through Page 26 Southold Town Board Regular Meeting March 9, 2021 page 27 the PDR program and I am sure that some properties in that immediate vicinity are on your near term list for purchases. It's also a scenic byway and a road that's regularly traveled by many (inaudible). So I don't want to take more of your time today but we will be back to explore how the town is operationalizing the shift in priorities. Thanks for your time. SUPERVISOR RUSSELL: I just want to quickly say that that quote of mine was on a completely unrelated issue, (inaudible) the article that appeared in and what the issue was there? MS. WALLACE: It was in connection with the PDR purchase of the DiVello property rights on Sound Avenue in 2019. SUPERVISOR RUSSELL: Yes but what was my reference, what was I referencing when I made that comment? MS. WALLACE: You made the comment, I have the extraction of the minutes right in front of me,you made the comment in the exactly the same kind of fashion that you made the comment to support the PDR you just discussed. You followed up Councilman Ruland who followed up Melissa who said it's a gateway to the border of the towns of Riverhead and Southold. And when you transition the corridor, you come from Riverhead and you see how much that corridor has changed and farming today is driven by sound agricultural practices and no one is going to know when we do something that is detrimental or is going to cause harm. And you immediately followed up with I am going to second that and say that I think you will find that the agricultural community are excellent stewards of the land etc., as I just quoted. SUPERVISOR RUSSELL: I will read that and (inaudible) when I get a chance. I am actually meeting with you to discuss what's going on, it looks like there's been a bit of a shift in some of that, particularly the maze that went from a lavender maze to a hedge maze. I plan on meeting with the landowner, I am going to sit down with the building inspector and determine what's allowed and not allowed by town code and make a thorough review of the whole thing. MS. WALLACE: That's terrific to hear. But it's important for the community at large and the Board to understand the burden that the town has chosen to shift to private property owners. If the burden of protecting our quality of life and our property values is now in our hands and the town and the state have paid close to the $2,000,000 that I know of and I will round it up (inaudible) so, we are probably pushing $3,000,000 in a quarter mile stretch and the town has an obligation of economic stewardship, quality of life stewardship and it's unacceptable that the cost of that stewardship is now being shifted to private property owners and I going to bring examples that have been outstanding in this immediate vicinity for the past three years, five years of the town shifting course over PDR land.
