SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated February 18, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD PLANNING BOARD: This application was referred for review and comments to the Town of Southold Planning Board who issued its response dated March 23, 2021 stating that there are no objections to an extension of the existing variance relief issued. The applicant submitted a valid SCDHS permit for the project. PROPERTY FACTSMESCRIPTION: The subject property is a non-conforming 10,664 square foot parcel located in a Limited Business (LB) Zoning District. The parcel measures 66.10 feet fronting NYS Route 25 (Main Road, the northerly property line), 164.44 feet along the Easterly property line; 64.53 feet along the southerly property line;, and 163.57 feet along the westerly property line. The parcel is improved with a one-and one-half story frame house and a concrete block garage all as shown on a survey prepared by John T Metzger, last revised February 9, 2021 which depicts the proposed improvements. BASIS OF APPLICATION: Request for Variances from Article IX, Section 280-42A and the Building Inspector's January 25, 2021 Notice of Disapproval based on an application for a permit to demolish an existing single family dwelling with a business office and construct a new single family dwelling with a business office (pest control); at 1) located less than the code required front yard setback of 100 feet; 2) located less than the code required rear yard setback of 75 feet; 3) located less than the code required single side yard setback of 20 feet; 4) located less than the code required combined side yard setback of 45 feet; located at: 36230 NYS Route 25, Cutchogue,NY. SCTM No. 1000-97-3-2. Page 2,April 15,2021 #7483,Mattituck 2012 SCTM No. 1000-97-3-2 RELIEF REQUESTED: The applicant requests variances to demolish an existing single-family dwelling with business office that will require relief for a non-conforming front yard setback of 78.7 feet where the code requires 100 feet, rear yard setback of 53.1 feet where code requires a minimum of 75 feet, a single side yard setback of 11 feet where code requires a minimum of 20 feet and a combined side yard setback of 22 feet where code requires a minimum of 45 feet. The footprint of the structure will not be altered. The Board notes that the current survey, submitted with this application, last revised February 9, 2021, shows a single side yard setback of 10 ft., and a combined side yard setback of 21 feet, in conflict with the issued Notice of Disapproval. ADDITIONAL INFORMATION: This application is in response to a similar application #7098 granted in November of 2017 for an application to make additions and alterations to an existing single family dwelling with business office that will maintain the existing non-conforming rear yard setback of 60.7 feet where code requires a minimum of 75 feet,a single side yard setback of 11 feet where code requires a minimum of 20 feet and a combined side yard setback of 25.2 feet where code requires a minimum of 45 feet. The footprint of the structure will not be altered. The applicant allowed the permits and variances to elapse. The Building Department has determined that this new application should be considered a demolition since the total cost of the reconstruction was estimated to exceed 50% of the market value of the existing structure. (Section 280- 4 of the Town Code amended 2/14/2017). However, the applicant's architect submitted a letter dated January 15, 2021 and numerous photographs affirming that the existing building is structurally viable and, although considered a demolition based on the appraised value,much of the structure will be preserved and renovated The applicant submitted to this office a survey prepared by John Metzger, L.S., dated January 5, 2021, stamped by the Suffolk County Department of Health Services on February 22, 2021 approving the sanitary system for a non- medical office and apartment. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 1,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family homes,a winery,and farms. The easterly property line is screened by fencing; the rear yard adjoins a wooded property. The applicant proposes to maintain the existing setbacks and the legally established uses as a residence and professional office. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's lot is a small non-conforming lot and the applicant is maintaining the existing setbacks. Any proposed alterations and additions will require variance relief for pre-existing nonconforming rear yard and side yard setbacks. 3. Town Law X267-b(3)(b)(3). The variance for the front yard setback granted herein is mathematically substantial representing 21.3%,the single side yard setback granted herein is mathematically substantial,representing 45%relief from the code. The combined side yard setback granted is substantial representing 51%relief from the code and rear yard setback granted is substantial representing 29.2%relief from the code. However,the applicant is proposing to maintain all existing setbacks which were established in 1959 when the structure was originally built. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The building has a certificate of occupancy. The applicant's representative indicated that no demolition is proposed,only rehab is planned; and further remarked that the building is viable when asked about its structural integrity. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The applicant has applied to the Southold Town Planning Board and the NYS Department of Transportation for approvals. It is believed that approvals from both agencies are forthcoming. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The uses of the site are allowed pursuant to Business LB Zoning District. The current setbacks were established when the dwelling and professional office received a building permit and certificate of occupancy in 1959. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a renovated structure containing a single-family dwelling and a professional office while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The LB Business Zoning District allows the proposed uses. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Lehnert, seconded by Member Dantes, and duly carried,to GRANT the variances as applied for and shown on the survey prepared by John Metzger,L.S. and dated February 9, 2021 and Architectural Drawings prepared by Mark K. Schwartz,AIA, dated February 4,2016. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The proposed use must obtain site plan approval from the Southold Town Planning Board. Failure to do so will render the variances granted herein null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that an approval is granted subject to conditions, the approval shall not be deemed effective until the required conditions have been met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 2,2017 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes, a winery, and farms. The easterly property line is screened by fencing; the rear yard adjoins a wooded property. The applicant proposes to maintain the existing setbacks and the legally established uses as a residence and professional office. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's lot is a small non-conforming lot and the applicant is maintaining the existing setbacks. Any proposed alterations and additions will require variance relief for pre-existing nonconforming rear yard and side yard setbacks. 3. Town Law &267-b(31(b)(3). The variance for the single side yard setback granted herein is mathematically substantial, representing 45% relief from the code. The combined side yard setback granted is substantial representing 44% relief from the code. The rear yard setback granted is substantial representing 20% relief from the code. However, the applicant is proposing to maintain all existing setbacks which were established in 1959 when the structure was originally built. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The building has a certificate of occupancy. The applicant's representative indicated that no demolition is proposed, only rehab is planned; and further remarked that the building is viable when asked about its structural integrity. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The applicant has applied to the Southold Town Planning Board and the NYS Department of Transportation for approvals. It is believed that approvals from both agencies are forthcoming.
