SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25,and the Suffolk County Department of Planning issued its reply dated February 1, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 10, 2021. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 76,198 square foot parcel located in the R-80 Zoning District.The northerly property line measures 194.77 feet and is adjacent to Long Island Sound, the easterly property line measures 399.58 feet,the southerly property line measures 182 feet and is adjacent to a 25 feet Right of Way(Castle Hill Road), and the westerly property line measures 447.06 feet. The parcel is improved with a one-story framed dwelling with an attached below the first level garage and an attached wood deck in the rear of the dwelling with fenced in in-ground swimming pool in the rear yard, as shown on the survey prepared by John Gallagher,LS, and dated March 4, 2015. BASIS OF APPLICATION: Request for Variance from Article XXIII, Sections 280-124 and the Building Inspector's January 19, 2021 Notice of Disapproval based on an application for a permit to construct a front porch addition to an existing single-family dwelling; at 1) located less than the code required front yard setback of 55 feet; located at 450 Castle Hill Road, (Adjacent to Long Island Sound) Cutchogue,NY. SCTM No.#1000-72-1-1.8. RELIEF REQUESTED: The applicant requests a variance to construct a front porch addition measuring 6 ft. by 21 ft, and having an area of 126 sq. ft. in size, attached to an existing single-family dwelling resulting in a front yard Page 2,April 15,2021 #7478,McKay SCTM No. 1000-72-1-1.8 setback of 49.6 feet instead of the required front yard setback of 55 feet, as shown on the Site Plan prepared by Elizabeth Thompson,Architect and dated October 20, 2020. ADDITIONAL INFORMATION: The prior owner built the dwelling within the front yard setback without a front door. A nearby property(lot 72-01-1.6 and 1.9)has a front yard setback of 47 feet granted by a variance. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 1,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This property is at the dead end of a private road and barely visible to any other nearby property. The lot opposite to the subject dwelling is undeveloped woods. Covered front porches are not out of the ordinary in the community. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject dwelling has a conforming front yard setback, so any additions on the front of the house will require variance relief. The existing dwelling was built without a front door. A new front entrance will add to the esthetic look of the home and provide weather protection. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 9.5%relief from the code.However,the dwelling was originally built without a front entry and the applicant wishes to improve the exterior appearance of the house and the functioning of the home relative to the interior layout.A front door entry with a covered porch is a common feature on many homes. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a front entry with a covered porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Acampora, seconded by Member Dantes, and duly carried, to GRANT the variance as applied for,as shown on Site Plan prepared by Elizabeth Thompson,Architect,and revised October 20, 2020. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use,setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The evaluation was done in response to the homeowner's appeal to the Zoning Board of the Town of Southold.The notice of disapproval from the Zoning Board initially denied the permit to install a front porch on the grounds that a front yard setback of 55 feet is required for properties measuring between 60,000-79,999 feet in total. (Article XXIII Section280-124)The construction of the front porch will result in a setback of only 50 feet. During the inventory and evaluation,the property and the bluff face were surveyed in its entirety to determine the erodability, and overall health of the surrounding landscape.The backyard is vegetated with both grasses and shrubs.There are knolls in the backyard that slope away from the bluff and towards the house.This slop will help mitigate erosion events on the bluff. It is important to routinely check the system's water pressure for leaks, and to make sure that the area is not being irrigated when it is unnecessary to do so.This should be done by a qualified individual. • Water runoff is a major contributor to bluff destabilization. Impervious surfaces and lack of vegetative ground cover encourage the formation of rills and gullies in the landscape, eroding soil away as they develop.Vegetate bare soil with native species to mitigate the effects of runoff. • Use of heavy machinery can affect the stability of soils.Soils risk structural damage near the bluff from the vibration of running equipment, machinery should not be left to idle. Heavy machinery compacts soil increasing the chance of surface runoff on the property. Compaction can be minimized by using the same route to enter and exit the property. Unnecessary areas of compaction will be avoided. Equipment should not be stored near critical areas of bluffs or near any unstable soils. Irrigation installed within 10 feet of the bluff edge decreases ground stability.This is due to the initial installation of plumbing disturbing the ground. The face of the bluff has a considerable amount of vegetative cover directly behind the property as well as the neighboring properties.The area of coverage encompassed 80%and above of the bluff face. Vegetative cover is important for stabilizing the face of the bluff. It can keep the area stable especially during storm and runoff events. Most of the species were tall grasses and shrubs.They were not identified because of the lack of foliage during this season. To avoid weather damage to your sign please affix it to a sturdy surface such as Plywood. If your sign is damaged please call the office and we will provide you with another one.
