SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 51,495 square foot water front parcel located in an R-40 Zoning District. The parcel runs 100.27 feet of bulkhead frontage along Little Peconic Bay,runs 106.14 feet along Nassau Point Road,501.11 feet on the North side,and 529.05 feet along the South side. The parcel is improved with a two story framed house with roof over attached wood decks, a frame garage, an in-ground swimming pool surrounded by an as-built vinyl fence measuring 5.2 feet in height and a slate patio. All is shown on a survey prepared by Nathan Taft Corwin,111,LLS dated November 2, 2020. BASIS OF APPLICATION: Request for a Variance from Article XXII, Section 280-105 and the Building Inspector's November 30, 2020 Notice of Disapproval based on an application for a permit to legalize an"as built" 5.2 feet pool fence in the front yard; at 1) fence more than the code permitted maximum four(4) feet when located in the front yard; located at: 9575 Nassau Point Road, Cutchogue,NY, SCTM No. 1000-119-1-3. RELIEF REQUESTED: The applicant requests a variance to legalize an as built 5.2 feet in height vinyl fence built on top of a stone wall of various heights where the code permits a maximum of four(4) feet in height fence in the front yard. ADDITIONAL INFORMATION: The survey's elevation data, the site inspection, testimony, and letter from Patrick's pools show that the pool and property are on a sloped elevation. The Pool is partially raised to compensate Page 2,April 15,2021 #7476,Miller SCTM No. 1000-119-1-3 for the elevational difference and the non-conforming fence height is caused by the sloping elevation in relation to the raised section of the pool. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 1, 2021 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Nassau Point is a residential community consisting of water front homes. A pool is a permitted accessory structure in the front yards of waterfront properties. The non-conforming as built fence is located 142 feet from the street and screened by vegetation. The fence is not visible from the street. 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. However, the property has a sloping elevation making a code conforming fence awkward. In order to be code compliant, the pool fence must be a minimum of 4 feet in height surrounding the pool, and a maximum of 4 feet in height in the front yard. The contractor would have to perfectly match the contour of the ground in order for the pool fence to be code compliant. 3. Town Law&267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief from the code. However,the as built fence only runs across a small section of the front yard in order to safely enclose the pool area as required by building code. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a pool fence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes,seconded by Member Planamento,and duly carried, to GRANT the variance as applied for, and shown on survey prepared by Nathan Taft Corwin, III, L.L.S. dated November 2,2020. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. The pool was constructed in accordance with the submitted plans . The pool is surrounded with a stone wall 81 feet long and 31 . 3 feet wide with various heights above the adjacent ground level . At the top of the stone wall is a five foot two inch white vinyl fence with decorative lattice work (See Exhibits #2 & #3) . On the completion of the pool area the building inspector denied the Certificate of Occupancy because the fence was greater than four feet in height (See Exhibit #5) . This requires your applicant to request relief from the Southold Town Zoning Board of Appeals for this as installed fence to remain in order to obtain a certificate of occupancy. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if the variance is granted, because: the applicant ' s swimming pool built with the surrounding stone wall and fence in the front 1 yard of the applicant ' s property, is barely visible from either of these adjacent residences and from Nassau Point Road. Each- of these three parcels front on Nassau Point Road which at this location has an elevation- of approximately 20 feet above sea level. The residences on 'your applicant ' s property and the two adjacent parcels are located approximately 300 feet easterly from Nassau Point Road at the top of a- bluff area common to the parcels which have an elevation of approximately 40 feet above sea level . The physical location and the use of this residential swimming pool with wall and fence in the front yard area have not created any detriment to the neighboring properties or have not made any changes in the character of this residential neighborhood. 2 . The benefit sought by the applicant CANNOT by some method feasible for the applicant to pursue, other than an area variance, because: due to the decision by the building inspector to deny the Certificate of Occupancy, it places your applicant in the position to request relief from the Board of Appeals for a variance. The reason being, pool fences pursuant to the Southold Town Zoning Code (§280-15 (4) ) must not be less than four foot in height, which is usually measured from the surrounding ground level. However, fences of any kind located in the front yard area cannot exceed four feet in height pursuant to §280-105 of the Southold Town Zoning -Code. Due to the degree of slope of the front yard of your applicant ' s property, the height of the pool wall ±2 . 6 feet above the grade at the easterly pool area and ±3 . 6 feet above existing grade at the westerly pool area. This is due to the degree of slope in this area where the land elevation changes approximately six feet in the eighty-one foot length of the pool wall . This degree of slope- creates a unique circumstance which is why the applicant ' s pool designer constructed the pool wall on a graduated basis in concert with the topography and placing the fence on -top of the pool wall rather than outside the pool wall at ground level. To take down the existing fence because it is greater than 4 feet in height and erect a new fence 4 feet in height would be an exercise in futility because it would not change the appearance or increase the safety because the top of the fence will always be above 4 feet from the surrounding ground level. The amount of relief is not substantial because: this requirement cannot be determined in a vacuum as the totality of the surrounding circumstances must be taken into account when evaluating substantiality. It is submitted, the pool fence with its 14 inch deviation does not have any impact on the neighboring properties due to the natural screening, making it barely visible from the neighboring properties as well as Nassau Point Road. The existing pool fence itself measures 5 ' 2" in. height with the trellis work which was selected to be aesthetically appealing. In evaluating the existing topography and the unique situation of the design of the pool wall, this deviation of 14 inches is not substantial, especially when it has absolutely no impact on the community or the surrounding properties . 4 . The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or, district because: where the pool is constructed in the front yard area, it is unobtrusive and has not and will not cause any adverse physical or environmental conditions in the neighborhood. This is especially true when considering that the 81 foot length of the pool wall with ,its 6 foot differential in land elevation from the easterly wall to the westerly wall, the surrounding -construction of the existing pool fence is- not only is protective from a safety point but it is attractive and blends in with the surrounding property. As demonstrated it has not caused any impact or created any adverse effect on physical or environmental conditions 'in the neighborhood. 5 . The Contractor claims that when the pool wall was completed a sample of the proposed fence with the lattice work was submitted for approval. The building department gave approval to proceed with this fence on the top of the pool wall . Now, the building department disagrees and will not issue a Certificate of Occupancy without a variance from the Board of Appeals because the fence is higher than 4 feet . My business is construction,renovation, maintenance and repair to gu lite and vinyl swimming pools of which I have built approximately 500 over the last 24 years. After visiting the Miller Property at 9575 Nassau Point Road, Cutchogue, and consulting with Emily Miller to analyze the dramatic slope of her property and design the in-ground pool, my company was hired to construct the swimming pool on her property. I only built the pool and I did not build the pool fence and stone wall around the pool which enclose the pool. I observed the construction of the stone wall and vinyl fence and in my opinion the pool wall and required fence are complimentary to the pool I built. The pool enclosure is not only attractive but in proportion in its current location due to the size of the pool area. The property has a very large slope so arranging a fencing design with 4-foot panels will result in areas of vertical change that will extend beyond the 4-foot panel design of the fence. I believe the installation was well done and done in the best manner possible. The fencing has very limited visibility from the neighboring properties and no visibility to mention from the street. It also provides sound deadening benefits to the neighboring properties. I understand there is an issue with the fence, in my opinion I would recommend it remain at the location on top of the pool wall should remain at its current height.
