This Special Meeting will be held virtually via the Zoom on-line platform. Pursuant to Executive Order 202.1 of New York Governor Andrew Cuomo's in person access by the public will not be permitted. The public will have access to view and listen to the meeting as it is happening via Zoom. However this meeting is not a public hearing and not testimony will be solicited or received. Let's get on with the first matter that's before the Board on the Agenda, is there any request from Board Members that you would like an item to be posted on the next Agenda? Nope, okay. So then we have a Resolution to possibly close the following hearing, ADF Ventures, LLC#7475. 1 believe we have received everything that we were looking for. We were I believe waiting for a comment some information from the Board of Town Trustees which we received so having received that I'm going to make a motion to close that hearing, is there a second? We do have a draft prepared because we received what we needed in a timely way and so the first decision before us is for ADF Ventures, LLC #7475. Everyone read it? It's a lengthy draft as you know and I guess on page three there's just an "f" floating around at least on the version I received. It's at the bottom margin there's just an "f'. BOARD SECRETARY : I see it yes. CHAIRPERSON WEISMAN : I don't know where that came from it's just left over from the tracking version. BOARD SECRETARTY : Anything else? Oh you know where it came from, it came from Findings and Facts if you look on page four MEMBER PLANAMENTO : Oh right. One other thing, under Town Law number five one, two, three it's the fourth line down it starts with, the applicant under building permit it says the applicant under building and then number add the word permit. I BOARD SECRETARY : Okay gottcha. CHAIRPERSON WEISMAN : This is why we all have to proof read these very'carefully. By the time these drafts gets written and re-written little dangling typos creep in and We don't want anything like that in these decisions. Okay well Nick since you're talking do you want to give us the salient points about this application, review it for the Board and for the public record. MEMBER PLANAMENTO : Absolutely. So it's a .67 acre 29,000 sq. ft. waterfront lot located on Soundview Ave. It's accessed by a right of way to access the home lot where there's actually a house currently under construction with an open building permit. The applicant is seeking relief to have an in-ground swimming pool on the water side of the residence where the pool measures 16 feet by 32 feet and there's a large terrace surrounding it also on the water side. The request was to have the swimming pool placed at 73.2 feet from the top of the bluff where the code requires a minimum setback of 100 feet from the bluff. I would just want to also point out that there is a discrepancy made in the original Notice of Disapproval where the survey erroneously or the survey submitted had the proposed pool 65 feet from the top of the bluff and it was revised to illustrate 74.6 but then during the Public Hearing if you all remember, it was discussed that there's actually a corner of the pool was closer to the bluff than that at 73.2 feet.So we discussed it, we did not believe as a Board that an updated or a corrected Notice of Disapproval was needed. It's in error that MEMBER LEHNERT : Nick's frozen. MEMBER DANTES : Yeah there was a little power surge for me too. MEMBER DANTES : Nick while we have you just keep going with your synapsis and let's just MEMBER PLANAMENTO : So I think we were speaking about ADF Ventures where it's an application for a swimming pool 16 by 32 feet on the waterside of the residence. The submitted survey did not illustrate a non-disturbance buffer which exists on the site which is recorded at the County Clerk's Office relative to the C&R's for the development. Prior relief was also granted for the right of way allowing access to this lot so that it can be developed over the neighboring residence to the south. The applicant at the Board's request submitted five prior decisions 4 ZBA Special Meeting April 15, 2021 granting relief where they included a cover letter to support their case and three of those decisions unfortunately were for swimming pools other than waterside locations. Two were for a side yard location, one was for a front yard location and the two other decisions additionally one that was remotely similar. In either case the draft decision as written is for a denial for the variance as applied for. So I would like to make a motion to deny the variance as applied for. Let's move on to the second decision that's in front of us and that is for Emily Miller #7476. Eric will you do the review on that for the Board please. 5 ZBA Special Meeting April 15, 2021 MEMBER DANTES : Emily Miller is a waterfront property where they're allowed to put the swimming pool in the front yard and when they put the pool in the front yard they ended up with a fence that was 5 feet in height where they're only supposed to have 4 feet in height maximum. It's a sloping property and they just having trouble maintain the 4 feet in height because they need to have at least 4 feet in height for the pool fence and most 4 feet in height to maintain to meet the town code and so it conforms to the character of the neighborhood because it's setback from the street by about 140 feet and it's hardly seen from the street. (inaudible)to the applicant they really don't have an alternative because it's a slope and they had to maintain that 4 feet height and so going over by about a foot is reasonable. It's mathematically substantial because it's a 25%variance but it only runs across a small section of the front yard and there's no impacts to storm water management and so I would make the motion to grant as applied for. The only change I would make is in town law iii, it says 100% relief from the code but it's really 25%. CHAIRPERSON WEISMAN : Where are we Eric? BOARD SECRETARY : Town Law III he wants to change the percentage of the relief from 100 to 25. CHAIRPERSON WEISMAN : Why is that? MEMBER DANTES : Well I mean you're allowed four feet, they applied for 5.2 so wouldn't that be 25 or 28%? CHAIRPERSON WEISMAN : No it would still be 100% because they are beyond what the code permits period. Anything over 4 feet is not permitted it's (inaudible) complete relief. MEMBER DANTES : Oh okay. CHAIRPERSON WEISMAN : So I think it's probably accurate. Alright so are you making a motion then to grant it? MEMBER DANTES : Yep I made the motion. MEMBER ACAMPORA :The applicant requests a variance to construct a front porch addition that would measure 6 feet by 21 feet. It's an area of 126 sq. ft. attached to the dwelling. This house was built with the required front yard setback so that's basically why a variance request is needed here and the house was built with really no front door. So the applicant would like the house number one to have a front door entrance so it's aesthetically looks like the rest of the houses in the neighborhood and there are houses in the neighborhood who do have a setback of less than the required 55 feet.So I make the motion to grant the variance as applied for with the condition that the proposed covered front porch shall remain open and non-habitable space. This one is the one on Peconic Lane. Eric can you give us a synapsis please. MEMBER DANTES : This is an application for a non-conforming setback for a garage as well as a non-conforming side yard setback for an accessory shed. It's a long narrow property and they're supposed to have a 20 foot setback for the garage and a 20 foot side yard setback for the shed and the garage being like 4 feet and the shed they have about 11 feet and the garage has been there for a long time at least since 1971 and was built under an older section of the code. As far as character of the neighborhood it doesn't affect the character of the neighborhood cause the house doesn't have any real neighbors. It's bordered by a farm and by a park and the non- conformities is in part due to the just the narrowness of the property. So I make the motion to grant the application as applied for. MEMBER LEHNERT : This property is a technical demolition.They removed a bunch of the house without a permit, had a Stop Work Order because it's more than fifty percent. The Building Department is calling it a demolition so therefore the setback in question is to an existing part of the house that's going to remain in the new construction but it's still 12.6% relief from the code but it's not going to change the character of the neighborhood and like I said it's a technical demolition. The following conditions, the wood deck should remain,uncovered and unenclosed and the proposed covered porch again shall remain unenclosed, unconditioned space and non- habitable. Pat can you review and summarize the draft decision for us please. MEMBER ACAMPORA :Sure,the applicant requests a variance to make additions and alterations to an existing single family dwelling. This is a house that is located on a corner lot in Greenport and where the code states that property in the vicinity of improved with principle buildings in front yards less than the required provisions so they need a variance because the average setback on Eighth St. is 24.8 feet and where the code is required 35 feet.They're looking to build a second story with renovations on the first floor so they are staying within the footprint of the dwelling. The property across the street to the south is zoned industrial. There are other homes in the neighborhood that also have setbacks that are less than the required 35 feet. So I move to grant the variance as applied for subject to the conditions that we have where it states that an applicant who has to read the determination, it talks about the Building Department if it becomes a demolition. It's a regular template that we have of a condition when someone is doing a project like this. CHAIRPERSON WEISMAN : Okay, so do you make the motion to grant? We basically wrote it up the exact same way with conditions, they must obtain a site plan approval from the Town Planning Board. Should we put the demolition language in here. I think it was there when I originally wrote this draft. BOARD SECRETARY :The Notice of Disapproval has the demolition. CHAIRPERSON WEISMAN : It's not in there because yes it's no longer additions and alterations as the original one was. It is considered a demolition. We were told that they want to try and preserve some of it and the architect (inaudible) MEMBER LEHNERT: Okay yea so the one condition that they get Planning Board approval. Pat can you review that for us please. MEMBER ACAMPORA : The applicant is requesting a variance to convert an existing accessory farm building into an accessory agricultural production building. The required minimum setback by code is 25 feet,the structure that is existing has a setback of 17.8 feet from the property line. The applicants were granted a building permit in 2017 to convert an existing garage into a farm stand and all the existing buildings on the property were given a Certificate of Occupancy in 2005. So this is merely taking an existing building and using it for farm production for an established farm by the applicants. This is just an application for their mother/mother-in-law to live in the accessory apartment in existing garage and in the application the size of the garage is 753 sq. ft. where the code only requires 750 but the extra 3 sq. ft. is deminimus and so they meet all of the criteria including (inaudible) meet the criteria for the Special Exception. Nick can you please do a little review of this for us. MEMBER PLANAMENTO : Absolutely. Like the last application this is for a Special Exception for an accessory apartment in an accessory structure. The applicant recently purchased the residence and the residence had an existing apartment over the two car garage. Previously that apartment was granted a Special Exception use as an accessory apartment and the applicant wished to legalize it. During the public hearing the applicant indicated that they do not have a tenant in mind for the space but that they would work with the Government Liaison Officer to select a tenant from the Southold Town Affordable Housing Registry for placement in the unit and the unit conforms on all levels to the code. What I would like to do is to present a motion to grant the Special Exception as requested subject to and there's several conditions. Most of them are boiler plate which are part of any Special Exception, however I would just add or like to request that the Board decide to add that the applicant should submit a notarized affidavit to the Zoning Board of Appeals Office stating that the unit will in fact be rented to a resident who is currently on the Southold Town Affordable Housing Registry. Additionally that the applicant when they select a tenant from that registry to get a letter from the Town Government Liaison Officer and send it to the Zoning Board of Appeals to illustrate that a tenant was selected and a lease was completed.
