Resolution Number 2020-173 of the Fishers Island Ferry District adopted November 9, 2020

Whereas Captain Ryan Healy has decided to resign from his position as full-time Captain (FIFD) and part-
time Deckhand (FIFD); and
Therefore it is RESOLVED that with effect the end of business on October 31, 2020 Ryan Healy has
voluntarily resigned from his part-time Deckhand (FIFD) and full-time Captain (FIFD) position. Mr. Healy

as a depository of Town of Southold, and that funds of this Corporation deposited in said
Bank, be subject to withdrawal upon checks, notes, Resolution drafts, bills of exchange,
acceptances, undertakings of other orders for the payment of money when signed on behalf of
this Corporation by any one 1 of its following officers to wit:

BE IT FURTHER RESOLVED,that the above Bank, is hereby authorized to pay any such
orders and also to receive the same for credit of or in payment from the payee or any other holder
without inquiry as to the circumstances of issue or the disposition of the proceeds even if drawn
to the individual order of any signing officer or tendered in payment of his individual obligation.
Borrowing Resolution.
BE IT FURTHER RESOLVED, that the Supervisor and Deputy Supervisor be end they hereby
are authorized to borrow from time to time on behalf of this from the above Bank sums of money
for such period or periods of time, and upon such terms, rates of interest and amounts as may to
them in their discretion seem advisable and to execute notes or agreements in the forms required
by said Bank in the name of the Corporation for the payment of any sums so borrowed.
That said officers are hereby authorized to pledge or mortgage any of the bonds, stocks or other

securities, bills receivable, warehouse receipts or other property real or personal of the
Corporation, for the purpose of securing the payment of any moneys so borrowed; to endorse
said securities and/or to issue the necessary powers of attorney and to execute loan,pledge or

That said officers are hereby authorized to discount with the above Bank any bills receivable
held by this Corporation upon such terms as they may deem proper.
That the foregoing powers and authority will continue until written notice of revocation has been
delivered to the above Bank.

I. PURPOSE
A Local Law to amend the Zoning Map to change the zoning of the parcel known as SCTM
#1000-102-2-5 from Residential Low-Density (R-80)to Affordable Housing District (AHD)
II. CODE AMENDMENT
Based on the goals of the Town, and upon our consideration of the recommendations of the
Town Planning Board,the Suffolk County Planning Commission, and the public comments
taken at the public hearing and otherwise, we hereby amend the official Zoning Map of the Town
of Southold as adopted to change the parcel known as SCTM#1000-102-2-5 from Residential
Low-Density (R-80)to Affordable Housing District (AHD)".
III. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE

Comments regarding resolution 765
COUNCILWOMAN NAPPA: I support efforts to create affordable housing in our town, I
believe that the size and the scope of this project is too big for the location, so I vote no.
COUNCILMAN DINIZIO: I abstain.
COUNCILWOMAN DOHERTY: No.
COUNCILMAN GHOSIO: I vote yes, I support the application, I think the opportunity for
private sector individuals coming to the town offering to build affordable or workforce housing
is rare, in my opinion I think that this particular application would be appropriate in this spot, it
is an area where there is quite a bit of mixed use. There's restaurants, there's commercial on that
street. Frankly, I didn't think in my opinion that it was going to be too big for that parcel, so I am
all for it.
JUSTICE EVANS: I agree with Councilwoman Nappa's remarks and vote no.
SUPERVISOR RUSSELL: Yes, I just want to touch on two quick points, before I vote. First,
there's two fundamental, two issues that has come out of this, we've gotten a lot of comments and
a lot of submissions both for and against it and I think it sort of reveals two things. First, I think
there's probably a general lack of understanding or misunderstanding of the town's affordable
housing program. Some of the comments were directed more towards what people might have
perceived as what traditionally is considered low income housing. The town's program isn't that
at all. I also think there's a misunderstanding, floating zones do not create precedence, that's the
whole intent. In fact they are generally the opposite of traditional spot zoning. With spot
zoning, you usually identify the parcel and the allowed uses, get approval after that zoning. This
is the opposite. You identify the project first and then assign the zoning to that project and it
becomes something in perpetuity. Also, I am going to really ask people in the future, we are
trying to encourage developers to submit affordable housing projects to the town, we have issued
rfp's ad infinitum trying to generate interest, we've only gotten three applications for affordable
housing zoning in the past 15 years. It is very difficult and I think people need to understand that
the developers know there isn't a lot of money to be made, this isn't going to line the pockets of a
developer. The zoning designation has so many restrictions in terms of rental income allowed,
sales price, most developers shy away from that because it isn't feasible for them from an
economic perspective. We also think there's a lot of misunderstanding on how halo zones are
supposed work, every hamlet has (inaudible). Southold has had the most so far, Mattituck,
Greenport,--C-utehogue-has-had-none-and-I-think-we-need-to-come-to-an-understandings grew-up
in Cutchogue, (inaudible) we have obligations there and it's not likely that housing can be
located in the halo zones, there is simply no property available in the halo zone in Cutchogue to
make it feasible. And I would like to have a community discussion and I would like to schedule
that in the next few weeks so everyone has an understanding of the program but a second, more
important issue for everybody is this specific project. At 251 feet from the halo area, I don't

believe this is, I think that is perfectly within the periphery of what the intent of the halo zoning
is. But the project itself though, it's too big, it is out of scale for a couple of reasons. And I am
sorry I am talking a long time but we got weeks and weeks of comment and I think'people
deserve a comprehensive answer. What's insurmountable for me is that we have an 124 unit
condominium complex being built in Cutchogue, it has 50 acre hamlet density zoning attached to
it, it's been there since the early 80's that's the largest piece of property in Southold Town
designated as hamlet density, it's creating a very, very large community down there. We have a
recent subdivision of vacant commercial property that was approved. The one thing I can't get
past is that how much change has taken place in such a small area plus we have the uncertainty
of the future of the school there, it's balancing affordable housing needs versus community
character. I think the character has changed very dramatically already and I think adding this to
the equation is going to make it change much more and I think in the interest of balancing that
out, community character has to weigh more heavily which is why I am opposing the
application as submitted. I vote no.

SUPERVISOR RUSSELL: I am going to invite anybody that would like to address the Town
Board on any issue to please feel free?
Arlene Castellano
ARLENE CASTELLANO: Hi, good afternoon. I would like to get an update on the New
Suffolk parking study. I called into the August 25th Town Board meeting and was told it was a
top priority. It's been three months, so I would just like to know what progress has been made
since then. I looked over the town's request for bid and the contract with AKRF from June 2019,
I have them here in front of me and both documents clearly state that two public meetings were
to be held before the completion of the report. The consultant was contracted to hold one public
meeting at the beginning of the study and another at the end. AKRF expected both meetings and
the final report to be finished by September 2019. As you know, there were no public meetings
and the report went through numerous changes before it was finally released to the public and the
Transportation Commission in February 2020. There are just a few things that were,said in
August that I would like to address. The contract was brought up by a few of you at that
meeting. It was implied that the contract needed to be completed before anything would be
shared with the public. Now that I have seen the contract, I know that the opposite is true. The
public meetings were supposed to be held while the-study was being conducted. The community
was suppose oe included in the process. Stakeholder interviews were not to eone in lieu
of public meetings but only as an additional resource. The corona virus was mentioned, this
study was scheduled to be completed by September 2019, so if the corona virus played a role it
was only after the report was unnecessarily delayed for other reasons. I believe the Board said it
is waiting for the Transportation Commission's report in order to schedule a public meeting. But
obviously a public meeting is not contingent on a report from the Transportation Commission
and members of that commission would only benefit from hearing from the consultants and the

public. So my question is, what happened? Why didn't the Board adhere to the contract and
hold the public meeting when they should have been held?
COUNCILWOMAN NAPPA: Well, it's the same answer as in:August, we have had some
changeovers in the committee and this Board feels it's very important to get their input before we
bring everything to the public and that's where we are.
SUPERVISOR RUSSELL: I also do want to mention that we did find the work insufficient,
which is why we sent it back to the consultant. Also the consultant really,the Transportation
Commission was more or less, maybe unintentionally but excluded from the study and they are
instrumental in all things with regard to parking, local traffic, etc., that's why they are there and
they are very committed, so they needed to be included in the process. Obviously there was no
plan to adopt because you develop a plan, it gets submitted for public comment and then
submitted back to the town. After the public comments are received, it gets sent back to the
consultant, who has to factor that comment into the report, make revisions if necessary then
submit back to the Town Board for adoption and approval. The process was delayed,no doubt,
it was underway again, we didn't find the original, either the pace or the product sufficient. It was
all underway though. The problem is that it got pushed into the spring and the reality is, is that
whether it is a satisfactory answer or not, that everything came'to a grinding halt as a result of the
corona. And what happened was a lot of the consultants with all the firms have gotten so backed
up, all the studies they are doing and all of the towns and all of,the jurisdictions that they were
trying to dig out from under the pile just as much as Town Half but hopefully we can get that
moving shortly.
COUNCILWOMAN NAPPA: Arlene, I will just mention also that the Transportation
Commission still has not had a meeting and when we do I will make sure that this parking study
is on the agenda for that discussion. I am working to get that meeting scheduled, it just hasn't
happened yet.
MS. CASTELLANO: Okay, so my understanding is that you don't need to have a report from
the Transportation Commission in order to have a meeting andI am, that is my understanding
because I am just going to read a bullet point from the comprehensive parking study proposal
and the contract 'hold an initial public meeting with residents to introduce the study and its
scope, schedule and goal and encourage the public to comment(:on their issue while the
consultants listen. Consultants will do this in a constructive way to reach out to local residents in
a manner such as a work shop or other format of their choosing,to glean input from the
community.' So it is my understanding from the proposal that the town sent out and the contract
that is signed with AKRF that an initial public meeting was supposed to be held, the other thing I
want to talk about is the Transportation Commission has not met in 9 months. Should
t7ust-shut dowirwhile-we-wait-forthe-Trarrsporta io
just going to halt everything until the Transportation Commission finally meets? Nine months.
The public figured out how to work zoom, there are six employees from the town on that
committee, they know how to work zoom, you know, this is ridiculous, that we are waiting to
hold a public meeting that should have been held initially and the consultants were supposed to
be there to present it to the public and the Transportation Commission could have been there at

that meeting and would have benefited from it. I mean, it's absolutely absurd. Personally I have
given up. I don't believe that this Town Board is ever going to address the problem with parking
and beach overcrowding in New Suffolk. But I do feel that an explanation, a real explanation is
due the public. And I am not getting that. I am not getting the truth and it's a shame.
COUNCILWOMAN DOHERTY: A comment on the contract. I read that different. It doesn't
say that they have to hold a meeting first. They reached out to different stakeholders and they
are still, we reached out to them through our engineers and they agreed that even though the
timeline of the contract is up, they will still come and hold their two meetings and make changes
that are necessary but that just hasn't happened yet for various reasons, one is COVID and I
explained there was a change over with the Transportation Commission and we are,you know,
Sara is working diligently to get them together to get them working on starting meetings again. I
don't know why you don't accept that as truth. It might not be acceptable to you but it is the
truth.
SUPERVISOR RUSSELL: Let me just touch on the beach issue, we took very dramatic steps
this year to reduce the population at the beaches. We eliminated a year ago, the ability to get a
daily guest pass at New Suffolk beach while all other beaches you were allowed to and trust me,
they have overuse issues as well. We spent a great deal of time trying to resolve a lot of issues,
trying to find answers to some of these questions that have been challenging for years. This
study was trying to develop, it's trying to develop a cohesive, comprehensive answer but it's very
difficult. It's not that we are ignoring New Suffolk, we spent a great deal of time discussing New
Suffolk, it's been on the agenda, every aspect of it, many times over the years and we have taken
action in the past as we could.
William Wallace
WILLIAM WALLACE: Hi, about a month ago, my wife addressed you all about a couple of
issues in relation to the Harbes Farm barnyard adventure. Now that was, we are waiting on a
couple of things, Supervisor Russell you had mentioned, thank you for letting me address you by
the way and good evening, about getting a study done by the state as to the agricultural activity
that or not that is occurring there. But subsequently we got, a few other issues that I would
quickly like to mention,regarding the property and some of the activities that are going on there.
Three things quickly, one, if there is a site plan that was for the property that was filed in 2013
that identifies it as a winery. There is a building on the property that is designated as a
production facility. No production goes on as far as I can tell and certainly nothing occurs in that
building. What is happening in that building though, that was identified on the site plan is there
has been for two years a commercial kitchen that has been operating there. As you know,
--comme-rcial Kitchens re notall-owe—d-oni-t -nery s tZsT—r t wn rules,, m#ttet-ff-moe
enforcement violation on that building the beginning of October of this year. You had an
inspector out there, he called us because he couldn't find the building, about a month ago. We
signed it because that would allow us to get an answer back as to what the findings but we
haven't gotten anything back as of yet. So I had a question about that. Second point is, the site
plan also states that that parcel of land, the entire farmstand and winery, it has been designated
anywhere from, I am going to say at the outside, as I read it, that there are 78 parking spaces that

are approved for that site plan at that site. So for the entire business operation, there are 78 spots
that are allocated to it. Now at any one weekend, there is a spot that is allocated for 50 spots so
there are three parking areas, one of them which borders Hallock Lane which most of you are
probably familiar with Harbes farmstand, there is a lot that's allocated for 50 spots and any given
weekend there are four times that amount of cars that are parked there. So when we, and again
it's out of season right so you may expect not to hear complaints about parking and traffic, well,
if we wonder why that spot is such a choke spot well there's probably a reason for that because
the property is allowed to have 78 cars parked there and there is well in excess of that parked
there every weekend. So that's my three points, one, why is there a winery that produces no wine
and the building that is supposed to be producing wine they are making, it has basically turned
into a snack bar and why are we allowing a business that has been allocated to be near 100 spots,
generously, to park three, four, five times that? I have sent a, I think my wife had sent around
some pictures, some overheads that we had done of the site, so'it's hard to, when you are driving
by the site it looks like one thing but when you see it from above it's something else. So I am not
exaggerating on that count. You know, at it's height, the town has police there. Riverhead has
police along Sound Avenue directing traffic to a business that's not supposed to be getting that
kind of traffic. So it's almost as if the town is (inaudible) is going on in this business, so I am
just not, I am wondering why that is, for this long because all it looks like from, and I am biased
of course because I am a neighbor, all it looks like to me is an amusement park because it is not
farming. It is a bar because it's not a winery and it's a snack bar because they are not supposed to
be preparing food there. It looks like one thing from the outside but what it actually is, is
something entirely different. I am just wondering why this is going on and am I just a voice
calling out in the wild or do other people see this, it needs to be reined in. And I am not some
ranting neighbor, I am trying to give you some very objective points that are easily looked up,
you can easily look at, I am just wondering why this is and what can we do about it?
SUPERVISOR RUSSELL: I had mentioned a few weeks ago there is a couple of issues here, I
highlighted three issues and those are it's going to be a comprehensive review and I assure you
every aspect of that, actually the commercial kitchen, the first time I heard about it was when
you just mentioned, that is distressing to me. I do want to sit down with the owners and talk
about exactly what is going on. There was an issue a couple of years ago when (inaudible) was
being hosted and what I was just recently presented with seems to be a free market difference.
The winery itself is allowed, you are not required to produce wine on site or grow grapes on site.
That's a matter of town code. You can have a winery without doing either, so that was permitted.
They went through the site plan, that was permitted. It looks like the production, what you call
the production facility, if that was converted to a commercial kitchen that would be in violation
of site plan and that will be addressed. I can't speak to that, the Town Attorney's office oversees
code enforcement. But (inaudible) all these other issues.

your wife when she called a few weeks ago, it actually is going to involve multi jurisdictional
review, the Building Department, the Assessors, and New York State Ag and Markets.
MR. WALLACE: That's great,thank you so much. I just want to add one thing, I don't want to
get technical but they have a farm/winery license which requires that at least, I don't mean to be a
stickler but at least 50 gallons are made on site, that's one of the main, one of the small hurdles
they give you in order to get one. So again, I am not trying to be, you can make off-site, you
don't even have to grow grapes, that is true but if you want a farm/wineiy site, you have to have
some production on site.
TOWN ATTORNEY DUFFY: Inaudible.
COUNCILWOMAN DOHERTY: Inaudible.
TOWN ATTORNEY DUFFY: That is a state requirement not necessarily a town requirement.
COUNCILWOMAN NAPPA: For the farm/winery license but 50 gallons is not a lot, one barrel.
As long as they have a barrel of wine that they are aging there, that falls under the state
requirement.
MR. WALLACE: True but if you have got that low of a bar, it would be nice to meet it. You
know, if they made it that easy then do it.
SUPERVISOR RUSSELL: You know, there's a lot of issues that I agree with here...
MR. WALLACE: You are right, I am not going to nitpick. That's it. That's my perspective.
SUPERVISOR RUSSELL: There's a lot of issues but I will say 50 gallons is a very, very low
almost inconsequential threshold and also when you are talking about production of the wine,
the aging of the wine, I mean,you know 50 gallons. Again, there's a lot of jurisdictions that are
going to have to be involved in doing a thorough examination.
MR. WALLACE: That's great. Alright, thank you.

hope that this has already happened, that every member of the Town Board read the

came from the office of the engineer in Southold. I didn't write it, what I read to you, it was
written by the office of the engineer. So it is really not my interpretation, it is what the town
wrote. It is what is listed in the contract. I had a hard time getting the contract because all the
other contracts are on laserfiche, Love Lane, all of them are listed in the town clerk, not New
Suffolk. The New Suffolk study was not on laserfiche. I called the Town Clerk, it took a week
because it was never sent to the Town Clerk to be put on laserfiche and I was ready to FOIL it

and had asked how do I go about FOILing it to get the contract. Finally I was able to get it. I
urge everyone who is interested in New Suffolk and the parking and the overcrowding at the
beach to please go to the Town Clerk site on laserfiche, read the request for bid, read the
contract. It's all there, everyone can see what was supposed to have been done, what was done
and when it was supposed to be done. So it is not my truth, it's what happened. And you are
right, I don't like it, I am not happy because there was no transparency. The Transportation
Commission was left out of it. The public was left out of it. Why, I don't understand, you did a
comprehensive plan, you included the public. You welcomed public input but not in New
Suffolk, no, we had to do things behind closed doors and the public was kept out of it. I know
it's hard for a lot of people to navigate laserfiche and but I think it's really, really important that
everyone who is interested at all in solving the problems in New Suffolk go on laserfiche and
look it up. I am sorry I took so much time tonight. Thank you for listening and I hope some
progress is made soon. Thanks a lot.
SUPERVISOR RUSSELL: The issue of transparency, know the issue of perhaps of(inaudible)
or delay is unacceptable, I agree with you buy you know, honestly, I met at your house, we had
you come in to the conference room. We have been transparent. It might not as gone as
efficiently as any of us would have like but again, Sarah assured us that the Transportation
Commissioner, and it's hard, they are all volunteers and a lot of them are older and they did have
genuine COVID concerns, so we also went through a transition with a long-standing chairman
who had stepped away and we had to get a new chairman. No delay or anything was intentional,
okay? Perhaps was it wasn't as efficient as it should have been but there was no effort to hide
anything, no effort to deliberately delay anything.
COUNCILMAN GHOSIO: I seem to recall we had a big meeting with the folks from New
Suffolk here at town hall.
SUPERVISOR RUSSELL: Yes, we did. We had a community meeting right here at town hall
to discuss it.
COUNCILWOMAN DOHERTY: And the plan is not, we are not finished with the process. It
is just delayed, we will have other meetings on it.
