Prior to Final Plat Approval Proposed Standard Subdivision for Kenneth and Elizabeth Liebert Located at 6510 Hortons Lane, Southold SCTM#1000-54.-3-14.8 Zoning District: R-40 Dear Mr. Cuddy: The Planning Board reviewed the above-referenced application and the request for a certificate of occupancy (c.o.) for the house constructed on proposed Lot 1. The Board has agreed that a c.o. may be issued for the house. The following conditions, put in place to allow the construction of the house with an active subdivision application before the Board continue to be in place: 1. Driveway to be designed as a common driveway for the future,lots. Only one driveway will be permitted to access the public street. As such, Lots 1 and 2 are required to share a common driveway from the public street to the point where a right turn to access.Lot 2 would occur. The right of way for the common driveway must be 25' wide, and ownership must be split down the center line until the point where the driveway turns right to service Lot 2. This is required by Town Code §240 Article XII, which states "The boundary of each lot served by a common driveway shall extend to the center line of the common driveway with the right-of-way for ingress and egress across the common driveway granted to each lot served by such common driveway." The right of way and common driveway will be required to be designed as shown in Drawing 15-5 (see attached) as required by Town Code §161-15A , Construction Specifications. The actual design can be done later in the subdivision process. For the purpose of allowing the construction of the house to continue, the Board accepted the sketch of the 25' right of way on the clearing and house location Southold Town Planning Board Page 2 January 13, 2021 plan that was submitted on Friday, October 19, 2018'. The landowner may continue to use the existing entrance for construction of the house on Lot 1 with the understanding that the driveway will need to be designed and constructed as required above prior to a Final Plat approval being issued for the subdivision. 2. Use of an Innovative Alternative-On-Site Wastewater Treatment System (IIA OMITS)for the house on proposed Lot 1. 3. No further clearing. There will be no further clearing allowed beyond what is shown on the plan that was submitted on October 15, 2018 until the Planning Board has approved the Final Plat and the map has been filed and all necessary permits have been obtained. The Planning Board has agreed to allow a c.o. to be issued for the house with the conditions above.,The approval to allow the c.o. is not an approval of the proposed subdivision. I checked the insulation and caulking/sealing that have been installed in the first floor walls and ceilings and the second floor walls and ceilings. The work has been performed in a professional manner. The joints between framing members have been sealed. The joints between the framing and the exterior sheathing have been sealed with spray foam insulation. All framing cavities including around windows and doors have been filled with faced batt insulation to the R-value required. The installed insulation and sealing conform to the International Residential Code 2015 edition, Section N1102 (R402) Building Thermal Envelope and to NYS Building Standards and Codes, 2017 Uniform Code Supplement, Section 2.31. The following conditions are required for the Board to allow construction to continue on the property: 1. Driveway to be designed as a common driveway for the future lots. Only one driveway will be permitted to access the public street. As such, Lots 1 and 2 are required to share a common driveway from the public street to the point where a right turn to access Lot 2 would occur. The right of way for the common driveway must be 25' wide, and ownership must be split down the center line until the point where the driveway turns right to service Lot 2. This is required by Town Code §240 Article XII, which states "The boundary of each lot served by a common driveway shall extend to the center line of the common driveway with the right-of-way for ingress and egress across the common driveway granted to each lot served by such common driveway." The right of way and common driveway will be required to be designed as shown in Drawing 15-5 (see attached) as required by Town Code §161-15A Construction Specifications. The actual design can be done later in the subdivision process. For the purpose of allowing the construction of the house to continue, the Board will accept the sketch of the 25' right of way on the clearing and house location plan that was submitted on Friday, October 19, 2018. Apply for approval from the Suffolk County Department of Health Services (SCDHS) Office of Wastewater Management for an Innovative Alternative On- Site Wastewater Treatment System (I/A OWTS) for the proposed house on Lot 1. A traditional septic system will not_be allowed due to concerns about water pollution from wastewater, and an I/A OWTS will remove more Nitrogen than a traditional septic system, thus reducing water pollution. For the purpose of continuing construction on the house on Lot 1, the existing building permit may be resumed, however an official indication that an application has been made to the SCDHS to use an I/A OWTS must be received by the Planning Department within 30 days of this letter. 3. No further clearing. There will be no further clearing allowed beyond what is shown on the plan that was submitted on October 15, 2018 until the Planning Board has approved the Final Plat and the map has been filed and all necessary permits have been obtained. The only exception will be the clearing necessary to move the driveway to meet the common driveway requirement. The Planning Board has agreed to allow the construction of the house with the conditions above. The approval to allow construction of the house is not an approval of the proposed subdivision. The Planning, Board retains all of its discretionary review options with regard to this subdivision application.
