Section 1 Purpose WHEREAS on October 22,2019 the Town Board of the Town of Southold adopted the Marine III Zoning District(M-III);and WHEREAS the purpose of the Marine III (MIII)District is to provide a waterfront loca- tion in the portion of the Town located on Long Island for ferry service to and from Plum Island;and WHEREAS the primary access to and from Long Island to Plum Island is currently pro- vided by a ferry operated by the federal gov- ernment on a 9 Os acre parcel located in Orient Point and identified on the Suffolk county Tax map as parcel#1000-15.-9-9;and WHEREAS the federal government,which currently owns Plum Island,has announced its intention to close the research facility on Plum Island and eventually sell the island; and WHEREAS the Town Board has pre- viously requested the Planning Board to pre- pare a"report and recommendations on the rezoning,and WHEREAS the Planning Board in a memorandum dated March 6,2020 recom- mended that the zoning of the aforementioned parcel be changed from M-II to M-III,and WHEREAS the Town Board of the Town - of Southold has considered the change of zone of this parcel of property from M-II to M-III,and WHEREAS that pursuant to the requirements of NYS Town Law and the Code of the Town of Southold, Suffolk County, New York,the Town Board of the Town of Southold held a public hearing on a proposed Local Law entitled"A Local Law to amend the Zoning Map of the Town of Southold by Changing the Zoning Designation of SCTM 1000-15.-9-9 from Marine II to'Ma- rine III"at which time all interested parties were heard,no therefor be it RESOLVED that the Town Board of the Town of Southold hereby ENACTS the pro- posed Local Law entitled A Local Law to amend the Zoning Map of the Town of Southold by Changing the Zoning Designa- tion of SCTM 1000-15.-9-9 from Marine H to Marine III". There are two other parcels,providing integral services to Plum Island; a 9.02 acre waterfront parcel containing the ferry•terminal for Plum'Island and a.2 acre parcel afthe tip of Orient Point(an in- holding in Suffolk County's Orient Point County Park containing the electric power transfer station). The island contains the,Plum Island Animal Disease Center(PIADC)which,occupies approximately 215 acres overlooking Long Island Sound and Plum Gut at the southwest corner. The primary access to and from Long Island to Plum Island is provided by a ferry(Plum Island Ferry)operated by the,federal'government from Orient Point, Long Island to Plum Island on a parcel referred to as the Orient Point,Facility (SCTM#1000-1,5.-9-9). The Plum Island Ferry is the principal, water dependent transportation for personnel, equipment, vehicles and-supplies to and from Long Island and Plum Island. The Orient Point Facility is located on a=9.02 acre parcel and,is comprised of an 80,000 square foot harbor, a parking area,',indoor and outdoor storage and an administration building. The ferry dock on Plum Island is located in a protected harbor measuring 240,000 square feet on the south shoreline if the island. Each harbor includes four vessel berths and two movable boat ramps for loading and unloading freight and vehicles.Vessels up to 200 feet can be accommodated'. 1 Altematives,for Final Disposition of Plum Island.2016.Prepared by United States Department of Homeland Security.: It is the position of the Planning Board that the viability of the current and future uses on Plum Island are dependent upon maintaining and-retaining a ferry terminal at the Orient Point Facility parcel for the sole purpose of accessing Plum Island,to service the continued operation of the PIADC and the development of future uses under the Plum Island Research(PIR) and Plum Island Conservation(PIC)Zoning Districts. It is therefore the recommendation of the Planning Board to retain the ferry terminal use at the Orient`Point Facility parcel and support the concerns raised by the United States Department of Homeland Security in a report titled Alternatives for Final Disposition of Plum Island(2016). And that a Change of,Zone of SCTM#1000-15.-9-9.from the MII Zoning District to the MIII Zoning District is contemplated. "The close-proximity of and multiple amenities of the Orient_Point facility make it an ideal gateway to Plum Island for the transport of personnel, vehicles,,equipment and supplies. The ample parking, indoor and outdoor and areas and administration building complement the harbor operation and can support a broad range of activity and uses on, Plum Island "The continued relationship between Plum Island and the Orient Point Facility.would benefit any alternative for the final disposition of the Property and is a vital link to those' interested in the future reuse of the existing buildings and infrastructure on the Property. There likely would be a significant-adverse impact on the value and utility of Plum Island if rights of access to.and use.of the Orient Point Facility are not included,in future conveyance documents. The MII Zoning District requires'a minimum of 80,000 square feet per use (excluding the transient hotels and motels which requires a 3 acre minimum),therefore the parcel could be improved with up to five separate uses under the MII Zoning District. The MII zone does not recognize the importance of the current use or role of the Plum Island Ferry or ferry terminal. Under this zoning the use could be extinguished or replaced with multiple uses.on the parcel. Recognizing the critical importance of retaining a committed ferry use from Long Island to Plum Island, in 2019 the Southold Town Board adopted the Marine III (MIII) Zoning District to protect the viability of the current and future uses on Plum Island in the event of property sale. As you know, Save the Sound and The Nature Conservancy, members of the PPIC, have undertaken an Envision Plum Island process over the last year, involving almost 200 people from around the region.They released the results this summer on July 22.The Envision Plum Island document,'available at www.preserveplumisland.ore/envision-report, promotes the concept of Plum Island Preserve, wherein the island would be conveyed to the State of New York.To create Plum Island Preserve,the current Orient Point ferry facility would be conveyed along with Plum Island's PIR District, at the least, and, preferably, with both the PIR and PIC District.Such a full conveyance of the entire island with the ferry parcel could help assure,future public access to the island, employee commutation to new jobs, ecological resource management-and study, historic preservation activities,and archaeological investigations. Through the nearly two-year Envision Plum Island process,the PPIC has developed a concept for the Plum Island ferry parcel that would include a small Plum Island museum,which also could serve as an assembly area or visitor center for people going to Plum Island and, perhaps through passenger tickets,could control the number of people visiting the island on a given day. Further, it could host exhibits or lectures related to Plum Island and its relationship to the other islands in Southold's archipelago. We note our vision conforms to the language of the Marine III zoning district: Marine III zoning is perfect for Plum Island's ferry parcel at Orient Point. In the document called,Alternatives for Final Disposition of Plum Island, written by the U.S. Department of Homeland Security as a Report to Congress, dated June 27, 2016,there is a paragraph on p. 25 worth noting. The heading is, "Synergistic Relationship between Plum Island and the Orient Point Facility." It says the following: Letter to Town of Southold Supervisor Scott Russell 2 of 2 Application of Marine III District to Plum Island Ferry Parcel "The closeproximity and multiple amenities of the Orient Point Facility make it an ideal gateway to Plum Island for the transport of personnel,vehicles, equipment, and supplies.The ample parking, indoor and outdoor storage areas, and administration building complement the harbor operation and can support a broad range of uses and activities on Plum Island. "The continued relationship between Plum Island and the Orient Point Facility would benefit any alternative for the final disposition of the Property and is a vital link to those interested in the future reuse of the existing buildings and infrastructure on the Property.There likely would be a significant adverse impact on the value and utility of Plum Island if rights of access to and use of the Orient Point Facility are not included in future conveyance documents." We continue in our efforts to move Congress to pass federal legislation that will remove the current requirement of disposing of Plum Island at a public sale, or auction.The Envision Plum Island report presents a unified, stakeholders'vision for the future of Plum Island and a variety of options to convey Plum Island into beneficial reuse, assuming that public sale requirement is lifted.
