March 10, 2021 via the Zoom Online Platform. Present were: Peter Young, Chairman Carol Brown, Member John Stein, Member Peter Meeker, Member Caroline Burghardt, Member Lauren Standish, Secretary Absent: John Chandler, Member James Dinizio, Jr., Town Board Liaison CALL TO ORDER Chairperson Peter Young called the meeting to order at 4:34PM. CLIMATE SMART COMMUNITIES PROGRAM Chairman Peter Young shared an e-mail notice from the NYSDEC announcing recent changes to the pledge elements. Peter Meeker provided an update on his task of obtaining information from department heads. He received a document from the Dept. of Public Works, however, specific documents are required and compliance is still a problem. Specific information about the town's fleet was discussed such as cost effectiveness and whether or not they were environmentally friendly. The Highway Dept., Police Dept. Dept. of Public Works and the Human Resource Center have their own fleets. Peter Meeker mentioned that he has yet 2 to hear from Chief Flatley regarding the police department fleet. Peter Young will contact the Chief and schedule a meeting to go over the inventory. REPORTS Caroline Burghardt attended the Board of Trustees meeting held on Wed., February 17, 2021. The application made on behalf of North Fork Haven, LLC was approved, however, Trustee Krupski did agree with the CAC recommendations. Peter Meeker remarked that the Board of Trustees are "rubber-stamping" every application lately. The application made on behalf of Osbourne/Grella in New Suffolk was approved and is curious how a house of that size and lack of setbacks was approved. Peter Meeker shared his concern over SPEDES compliance after attending the Board of Trustees meeting last month. He believes point source drain pipes are in fact a large contributor to water pollution despite Michael Collins view point that they are not. The CAC should explore with Mr. Collins the number of point source problems that the CAC has witnessed and requested the CAC send him a letter. Chairman Young did not agree to a letter at this time would further discuss. NEW BUSINESS While inspecting properties last month, Carol Brown found that 50% of the properties were non-compliant with the LWRP, Ch.275-Wetlands and Ch.111-CERA. She suggested the CAC send a letter to the Board of Trustees. Chairman Young did not agree to a letter and stated that enforcement,and compliance is not the role of the CAC and that the Board of Trustees have the discretionary powers. APPROVAL OF MINUTES Moved by John Stein, seconded by Caroline Burghardt, to Approve the Minutes of February 10, 2021. RECOMMENDATIONS -WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by John Stein, seconded by Caroline Burghardt, it was RESOLVED to SUPPORT the application of STEVEN EISEMAN & VALERIE FEIGEN to remove approx. 200-250 cy. of driftwood debris from an approx. area of one (1) acre and a 10-year maintenance permit for future removal of driftwood and/or debris as necessary. Install 3' high chain link fence 110' in length with one double set of doors with one 3' door primarily surrounding existing deck and walkway. Located: 18603 Main Rd., East Marion. SCTM#17-5-3.2 Inspected by: John Stein, Caroline Burghardt Vote of Council: Ayes: All Motion Carried 3 Moved by John Stein, seconded by Caroline Burghardt, it was RESOLVED to SUPPORT the application of ORIENTAL UNICORN LLC to remove and replace (in-place) approximately 126 If. of timber bulkhead with vinyl bulkhead, construct two (2) 10' vinyl returns and backfill with approx. 15 cy. of clean sand/loam to be trucked in from an approved upland source; construct approx. 125 If. of timber landscape tie retaining wall with 4'X 3' steps along landward edge of 15' wide naturally vegetated non- turf buffer to be restored and maintained with native plantings upon completion of construction; and remove and replace Split rail fencing along property line as needed. Landscape and grade for lawn rear yard. Nothing done post construction of house and within 100' of top of bluff. Located: 980 The Strand, East Marion. GOULD to replace damaged stairs and brick patio with blue stone. Located: 1825 aka 1820 Truman's Path, East Marion. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Caroline Burghardt, it was 4 RESOLVED to SUPPORT the application of JAMES & KATHIE CAPOZZI for the removal and replacement of 102 If. of existing deteriorated bulkhead with new vinyl bulkhead in the same location. In addition, a proposed 10' wide non-turf buffer will be installed landward of proposed bulkhead. Located: 1525 Gull Pond Lane, Greenport. Retaining wall #1 is 30' with 20' return and retaining wall #2 is 40' with a 50' east return. Install an additional 64+/-ton of 1-3 ton rock in front of existing bulkhead. Backfill with approx. 3 cy. of clean trucked-in fill. Located: 19455 Soundview Ave., Southold. Abandon existing septic system and remove eleven (11) existing trees ranging in size from 6" to 24" calipers. Construct new two-story dwelling with partial full basement and two car garage. Construct second-floor deck, in-ground swimming pool, patio, spa, gazebo, pervious crushed bluestone walkways, concrete block retaining walls of varying heights, and new pervious driveway and parking area for garage. Install new I/A septic system and install new gutters, leaders and drywells for dwelling. Remove existing staircase, covered disturbed area with two layers of burlap over the disturbed area and plant American Beachgrass and/or indigenous vegetation. Install new staircase approx. 20' north of existing staircase with a removable wood or aluminum staircase to beach. SCTM#81-3-3 Inspected by: Peter Young, Peter Meeker, Carol Brown The CAC does Not Support the application. There is a serious concern with-the construction of a pool so close to the top of the bluff and not maintaining proper setbacks. There is also a concern with the removal of 11 trees. The CAC recommends aluminum retractable stairs parallel to the shoreline and an I/A sanitary system. Vote of Council: Ayes: All Motion Carried 6 Moved by Carol Brown, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of ANDREA COURT,PROPERTY HOLDINGS, LLC to remove and replace 12" higher, 96 If. of navy vinyl bulkhead and backfill the bulkhead with clean fill from the upland side. Remove the existing bulkhead return and install 75' of navy vinyl bulkhead. Install 4'X 96' grated boardwalk landward of the bulkhead. Install a 4'X 6' cantilevered platform and a 4' wide beach access stairs to grade. Establish a 10'X 96' native planted buffer landward of the bulkhead. Located: 280 Cedar Point Drive East, Southold. Vote of Council: Ayes: All Motion Carried Moved by Peter Meeker, seconded by Carol Brown, it was RESOLVED to NOT SUPPORT the application of MARK TURKEL & NEENA BEBER for the pre-existing 16'X 18' frame building on locust posts, pre-existing boat house on locust posts with 5'X 17' concrete retaining wall landward of boat house, 3'6"X 21' wood deck/platform and 11 stair treads and 12 risers from grade to top of bank. Pre-existing buildings to be repaired and maintained in-kind and in-place. Bury 210' overhead wires and remove two utility poles in the front yard. Located: 2221 Indian Neck Lane, Peconic. Any improvements to legalize the structure should be done using best management practices. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by Peter Meeker, it was RESOLVED to SUPPORT the application of ELLEN RILEY AS TRUSTEE OF SHANNON RILEY TRUST for the existing house, garage/cottage and shed. Construct additions consisting of a screen porch, roofed patio, raised patio and spa. Revised driveway and parking area, removal of existing sanitary system and installation of new I/A sanitary system on landward of the house and greater than 100' from surface water, new patio at cottage entrance, walk and steps, and entertainment patio w/outdoor kitchen. Retaining wall, gravel area, masonry steps and gravel area west of house. New access to the beach will be constructed consisting of new steps/landing, new gravel area, new masonry 7 retaining walls and resurfacing of wood steps. Existing AC units and cellar entrance will remain. Spa filter, spa heater and 1000 gallon propane tank will be installed. Retaining walls will be constructed along south property line and along east/south side of driveway. Site drainage will be provided for a 2" rain, and a line of proposed native vegetated buffer. Vote of Council: Ayes: All Motion Carried Moved by Carol Brown, seconded by Peter Meeker, it was RESOLVED to NOT SUPPORT the application of VASILIS & CHRISTINA FTHENAKIS to demolish and remove existing cottage, foundation, wood deck, and walkway at bluff. Two- story frame house, foundation and associated structures near Nassau Point Road. Construct new foundation, one-story frame house with new on-grade stone and/or brick patio. Removal of six (6) trees of varying calipers. Located: 6925 Nassau Point Rd., Cutchogue. SCTM#111-15-9 Inspected by: Peter Young, Peter Meeker, Carol Brown The CAC does Not Support the application as submitted. There is a concern with the destabilization of the bluff and the rear setbacks and their proximity to top of the bluff. Vote of Council: Ayes: All Motion Carried Moved by Peter Meeker, seconded by Carol Brown, it was RESOLVED to SUPPORT the application of STRONG'S MARINE INLET, LLC to maintain and improve the existing travel lift slip by replacing/extending the lift rails and replacing the bulkheading forming the slip, widening the slip by approx. 1 , and providing a new concrete boat launch; to replace/maintain adjacent bulkheading; and to maintain and streamline existing marina dockage by eliminating a 170' long floating dock, replacing the associated finger floats and relocating them to an adjacent floating dock, and permanently removing adjacent 166' in-water bulkhead. Vote of Council: Ayes: All Motion Carried 8 Moved by Peter Young, seconded by Carol Brown, it was RESOLVED to SUPPORT the application of ALISON BYERS & LAWRENCE BUSCH for the installation of 540 If. of untreated timber post and rail fence along the toe of the existing bank. Proposed no-entry signage will be fastened to posts every 100' along face of fence. Proposed fence is required to prevent unlawful entry to private property and degradation of existing stabilized bank and vegetation. There will be no obstruction to existing beach access along the shoreline due to proposed fence installation. Located: 10335 Nassau Point Rd., Cutchogue. New jetties to be no higher than 18" above existing sand elevation. Located: 610 Park Ave. Ext., Mattituck. Vote of Council: Ayes: All Motion Carried RECOMMENDATIONS-APPLICATIONS TO AMEND WETLAND &COASTAL EROSION PERMIT APPLICATIONS Moved by Carol Brown, seconded by John Stein, it was RESOLVED to NOT SUPPORT the application of SOUTHOLD SUNSETS HOLDINGS, LLC to Amend Wetland Permit#9752 and CEHA Permit#9752C to provide underground 500 gal. propane fuel tank anchored onto poured-in-place concrete counter weights with watertight containment sump, concrete vault and metal protective manhole with lid for nozzles. Located: 4200 Kenney's Rd., Southold. SCTM#54-4-3 Inspected by: Peter Young, Peter Meeker, Carol Brown, John Stein The CAC does Not Support the application and recommends the propane tank be elevated and fastened above ground with a break-away.
