The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP. This recommendation is based on the inconsistency with Policy 1 of the LWRP, which states that the pattern of development minimizes adverse effects of development on the environment. In this case the expansion of the deck will encroach into a 50' conservation easement area designated by the Planning Board to protect the tidal wetlands —an environmentally sensitive area. This conservation easement is described on the filed subdivision map of R.F. Blum and W. A. Littell. See attached copy of the filed map and note item 7 which states the following: "A conservation easement having a depth of 50 feet shall be established along the tidal wetlands." The tidal wetlands line is shown on the survey by Van Tuyl that was included in the Trustees application. We have registered that survey to the GIS aerial to show generally where the 50' conservation easement area is located. According to that map, the deck cannot be any closer than it already is to the wetlands or it will be in violation of that easement. RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled Minor Subdivision of Reynold F. Blum and William A. One involved building a berm along the back edge of our property in Cutchogue and planting a line of Leyland Cypress trees to work as a screen to the property behind ours. The other two were: we need to replace our existing deck with a new one that is two and a half feet wider than what is there now. The length stays the same. The third request was for permission to build a stone wall on the slope directly in front of the deck to prevent further erosion. The board gave us approval for the berm and plantings and asked for more specificity on the deck and wall with bullet points in a note. I am providing those below. However, we need to change plans on the tree planting. The nor'easter in December just before Christmas brought a lot of saltwater into the lower part of the property where we had planned for the berm and trees. Another high tide in January flooded that area as well. High tides are now higher, and this once dry area is now frequently wet and planting there would be a bad idea. Had we gone ahead with t'he berm and plantings after the Trustees approved it, the berm could very well have been badly eroded and soaked in salt water from the December and January high tides. We have to abandon this plan so as not to endanger an expensive berm and plantings. I W • I I However, w�'still need to scree x)4 our property from the area behind us.
