On February 6, 2020, 1 called the Trustees office and was informed that the Trustees would be recommending the establishment of a ten foot (10')non-turf buffer landward of the wetland boundary to the subject property above. The property owners were anticipating a five foot (5') non-turf buffer request from the Trustees but after our further discussion and my recoanmendation, they accepted the ten foot(10') offer. I advised my clients there was no longer a need for them to physically attend the Trustees working session on February 10, 2020 or the February 12,2020 Trustees hearing as they had originally planned to do. However, as you may recall, during the public hearing regarding the above referenced property on February 12, 2020, Trustee Bredemeyer asserted that a prior owner of subject property extended their lawn ten feet (10.0') northward, and installed a fence, all within lands purported to previously be wetlands. After further research and analysis we have found this to not be the case. Supporting research and documentation details follows. As such I respectfully request that the property owners application be approved as is and the prior ten foot(10") offer be reinstated, which I am authorized to accept on my clients behalf. Details: Trustee Bredemeyer's assertion that 10-feet of wetlands was reclaimed by the former owner is based upon a scaled measurement derived from two (2) aerial images obtained from GoogleEarth, dated March, 2007 and September, 2010, indicating a distance from the existing flagpole within the rear of the property to an indistinct image of the existing fence line along the rear property boundary. The March,2007 aerial contains a legend indicating"Distance from Fixed Point 10.0'" and is drawn from the center of a white, circular structure thought to be the existing flagpole. The line drawn (by pencil) from the flagpole extends to the landward side of a blurry, dark, lineal area. It is unclear as to where this line terminates. The aerial contains a scale located at the lower right hand corner, which reads 30.0'. However, in applying an engineer scale, the 30.0' scale appears to be 28.3' and not 30.0', and the diameter of the flagpole is 2.0'. 1 The second aerial image, dated September, 2010,is more blurred than the 2007 aerial. Again, the 30.0' scale appearing in the lower right hand corner appears to be 28.3' and not 30.0', and the width of the flagpole is slightly more than 1.0'. The aerial contains a legend that reads "Distance from Fixed Point 10'and 15"'. Two (2)penciled lines appear on the September, 2010 aerial photo. It is noted that the landward starting point, presumably the flagpole, do not line up between the two (2) penciled lines. It appears that the shorter pencil line begins at a point 1.0' seaward than the longer penciled line located at the flagpole. The seaward reach of the shorter penciled line appears to extend across a lightened area whereas the longer line appears to extend beyond the darker swatch. Attached herewith,please find: (1) Aerial Photograph of subject property, obtained from GooglePro, at our office, dated April,2001,indicating an approximate distance of 12.92' (Ground Length) between the seaward fencing and the flagpole to the southeast; and (2) Aerial Photograph of subject property, obtained from GooglePro, at our office, dated March,2007,indicating an approximate distance of 11.2' (Ground Length) between the seaward fencing and the flagpole to the southeast. In our GooglePro program, we apply the available onscreen ruler to the March, 2007 aerial photograph resulting in a setback noted "map length" at 11.21', and "ground length" of 11.23', for which we report simply at 11.2'.' It is noted that the ruler contains a heading at 334.85°. Review of the GooglePro aerial photograph taken on April, 2001, shows the "map length" from the base of the flagpole to the base of the fence at 12.89' with a "ground length" of 12.92' which we conclude as an approximate distance of 12.9'. The ruler contains a heading of 334.58°, which is close to the heading used on the March, 2007 photo. Therefore, a comparison between the April,2001 aerial photograph measurement and the March, 2007 aerial photograph shows a difference of 1.68' (12.89 — 11.21 = 1.68), from the base of the flagpole to the base of the fence. *NOTE: "Map Length" is the straight line distance between two (2) points. "Ground Length" is the distance, including terrain, between the two (2) points (i.e., if you're on flat land, the difference between "Map Length" and "Ground Length" would be minimal). In our GooglePro program, we apply the available onscreen ruler to the March, 2007 aerial photograph resulting in a setback noted "map length" at 9.97, and "ground length" also at 9.97'. It is noted that the ruler contains a heading of 334.32°. Review of the GooglePro aerial photograph taken on March,2012,shows the"map length" from the base of the flagpole to the base of the fence at 10.02', and the "ground length" at, also, 10.02'. The ruler contains a heading of 334.27°. Therefore a comparison between the September, 2010 aerial photograph measurement and the March, 2012 aerial photograph shows a difference of 0.05' (10.02 —9.97= 0.05), from the base of the flagpole to the base of the fence. Actual field measurement shows a distance of 9.7 between the base of the flagpole and the base of the fence. Also, the base of the flagpole has a diameter of 2.5". Attached herewith please find a photograph indicating these measurements. In addition, if the fence was extended ten feet(10.0') into the wetlands between March, 2007 and September,2010,as alleged,there would be a corresponding fence return to connect the relocated fence to the fencing along the side lot lines. Attached herewith please find photographs of the fence in this area. You will note that there is no difference in the material and/or age-related conditions. It is important to consider the sources of error in these distance analyses. The first source of error is GoogleEarth itself. Attached herewith the Google Maps / Google Earth Additional Terms of Service, which states in item 3: "Actual Conditions; Assumption of Risk. When you use Google Maps/Google Earth's map data, traffic, directions, and other content, you may find that actual conditions differ from the map results and content, so exercise your independent judgement and use Google Maps/Google Earth at your own risk...". The second source of error results from a condition known as parallax. Parallax is defined as an apparent displacement or difference of orientation of an object viewed at two different locations during vertical aerial photography. The objects at a higher height lie closer to the camera and appear relatively larger than similar objects at a lower elevation. The tops of the objects are always displaced relative to their bases.' The third source of error is the headings among all photographs differ. The fourth source of error is the map ruler click (click at the fence; click at the flagpole). The fifth source of error is the diameter of the flagpole. The sixth source of error is 3 Swapan Kumar Haldar, Mineral Exploration (Second Edition) •2018 the clarity of the photograph itself (the fence is not distinguishable in the March, 2007 Google aerial photograph, and the September, 2010 Google aerial photograph, both placed into the regulatory record by Trustee Bredemeyer). It is noted that the GooglePro aerial photographs, dated March, 2007, April, 2001, September, 2010 and March 2012, are much clearer than the March, 2007 and September, 2010 aerials that were entered into the record during the public hearing of February 12, 2020. In any event,the actual measured distance between the flagpole and the black fence is 97. There is also one tree on the property that the property owners cherish. It is located on the landward side of the fence. The distance between the tree and the fence is less than one foot (1'). On each of the Google aerials,from what we see, that distance has not varied significantly over the years. Conclusion: Our position that a fair and unbiased analysis of the data would not, in any event, lead to the conclusion that the prior property owners extended their lawn ten feet(10.0') into the wetland boundary as alleged during the February 12th, 2020 public hearing. It was my understanding that the initial recommendation of the Trustees was to establish a ten foot (10.0') non-turf buffer landward of the wetland boundary, not the twenty feet(20.0') suggested during the February 12th, 2020 public hearing. The property owner accepts the ten foot (10.0') non-turf buffer extending from the wetland boundary. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law M7-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject proposed deck will replace an existing 12 feet x 19 feet attached wood deck with a slightly larger 14 feet by 27 feet attached wood deck, which will not be visible from the road because the attached proposed deck in the rear yard will maintain the same side yard setback as the applicant's dwelling. Neither will the proposed deck be visible to adjacent properties which contain undeveloped wooded buffers. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because if the applicant were to construct an attached deck on the rear of their house with a conforming 15 foot side yard setback,the deck would not line up with the exterior door and deck stairs and the railings would block the existing exterior windows. . 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 16.6% relief from the code. However, as indicated,the existing deck will be replaced by a new deck that will maintain the same existing non-confirming side yard as the dwelling and original deck, which historically has had no adverse impacts on the neighborhood 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The proposed deck is located at considerable distance from wetlands and the applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. There is no history of variance relief for the as built deck in the Town's records and the Certificate of Occupancy No. Z7168 dated August 9, 1976 for the private one family dwelling does not list an attached deck. Moreover, the applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase 6. Town Law §267-b. Grant is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an attached rear yard deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
