That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That-there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest-in real or personal property held or vested in a person not a party to the permit. Box 582 Bohemia, NY 11716 RE: SHEENA ACHARYA &ADRIAN SAPOLLNIK 645 GLEN COURT, CUTCHOGUE SCTM# 1000-83-1-7 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, April 14, 2021 regarding the above matter: WHEREAS, Jeffrey Patanjo on behalf of SHEENA ACHARYA &-ADRIAN SAPOLLNIK applied to the Southold Town Trustees,for a permit under the,provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 28, 2020 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed actions of adding a 10'X10' platform is Inconsistent with the LWRP, and WHEREAS, the LWRP Coordinator issued a recommendation that the proposed action of replacing the stairs is recommended as Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the Board of Trustees has furthered Policies 6.3 of the Local Waterfront Revitalization Program policy to the greatest extent-possible through the imposition of the following Best Management Practice requirements: 10'x10' platform is permissible in the Coastal Erosion Hazard area; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 14, 2021, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS; the-structure complies with the standards-set forth in Chapter_-275_of_the_Southold_...._ Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of SHEENA ACHARYA& ADRIAN SAPOLLNIK for the removal of the existing bluff stairs and replacement of steps and platforms in same general location consisting of: a 4'x4' top platform to 4'x8' steps to a 4'x4' upper platform to 4'x18' steps to a 4'x4' upper middle platform to 4'x2' steps to a 4'x4' upper middle platform to 4'x18' steps to a 4'x4' lower middle platform to 4'x2' steps to a 4'x4' lower middle platform to 4'x18' steps to a 4'x10' bottom platform with 4'x8' steps to beach off bulkhead; and to construct a1 0'x1 0' on-grade platform directly landward of existing bulkhead; all decking to be un-treated and all work to be performed by hand methods; and as depicted on the,site plan prepared by Jeffrey Patanjo, last dated February 18, 2021, and stamped approved on April 14, 2021. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action of replacing the stairs is CONSISTENT with the LWRP. It is also my recommendation that the proposed action of adding a 10' x 10' platform is INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1.
