A reversal of the Board of Trustees May 19, 2021 determination preventing the issuance of a coastal erosion permit in'`accordance wil Chapter 111 of the Town Code. FACTUAL BACKGROUND-ANI) PROCEDURAL HISTORY A. Description of'the propert* and applicants: The property that is the-subject of this'application is located at Off East End Road, Fishers Island,NY SCTM#1000-3-2-2. The property is currently improved with a single family home, decks and foundation. The property is located-in`the'resdential zone. As confirmed by the Board of Trustees, and acknowledged by the applicant, the property where the proposed work is to be performed is located within the Coastal Erosion Hazard Area as established by New York State in 1991. The•applicant'subriiitted'an'application to the Trustees seeking to constructer 105 linear feet of 4" wide'wood pile and timber pier of which±-65 N, linear feet is waterward of the apparent/spring"high water-line, including five associated M ladders, rails, electric and water utilities; construct'a±-9' x± 10 ( 90sq.ft.) wide boulder mounded wood platform/dock with a 4' wide xf 7 linear foot long access walkway with rails and three new tie-off piles, waterward-of the apparent high water line; with the condition of the use of thru-flow decking'on the entire dock; and as depicted on the site plan prepared by Docko, Inc., dated December 12, 2018; on parcel SCTM# 1000- 3- 2- 6 off 12244 East Main Road,Fishers Island , New York. B. Trustees Procedural History: I. Application The applicant filed an application with the Board of Trustees on February 17, 2021 to construct to construct± 105 linear feet of 4" wide wood pile and timber pier of which± 65 N, linear feet is waterward of the apparent/spring high water line, including five associated M ladders, rails, electric and water utilities; construct a± 9' x± 10 ( 90sq.ft.) wide boulder mounded wood platform/dock with a 4' wide x± 7 linear foot long access walkway with rails and three new tie-off piles, waterward of the apparent high water line; with the condition of the use of thru-flow decking on the entire dock; and as depicted on the site plan prepared by Docko, Inc., dated December 12, 2018; within a near shore area in a Coastal Erosion Hazard Area located on property on parcel SCTM# 1000- 3-2- 6 off 12244 East Main Road, Fishers Island ,New York. II. Public Hearing: The Trustees held a public hearing on this application on May 19, 2021 at which times all those interested were given the opportunity to speak. Keith Neilson PE on behalf of the applicant addressed the Town Trustees' concerns with regards to the application. It was described that the proposed structure would be the dock extending out in to the waters of Fishers_Island Sound in the Coastal Erosion Area. III. -Trustees Determination and Certificate of Compliance. On May 19, 2021 the Trustees issued a determination stating that the proposed construction fell outside the jurisdiction,of the Board of Trustees due to-the proposed application being located within the designated Coastal Erosion Hazard Area and square footage proposed exceeding 200 square feet, and therefore the Trustees could not issue a permit under the tidal wetlands act denied the application without prejudice, and as such further application would need to be made to the Town Board. IV.The Town Board Proceeding On June 8, 2021, the property owners timely filed an appeal of the Trustee's determination pursuant to Town Code Chapterl 11 with the Coastal Erosion Hazard Board of Review (the Board) seeking the reversal of the Trustees denial. The Board held a duly noticed public hearing on July 27, 2021, at which time all interested parties were given the opportunity to present testimony on the application. Keith Neilson PE of Docko Inc. on behalf of the applicant addressed the Town Board's concerns with regards to the application to construct± 105 linear feet of 4" wide wood pile and timber pier of which± 65 N, linear feet is waterward.of the apparent/ spring high water line, including five associated M ladders, rails, electric and water 2 utilities; construct of 9' x± 10 ( 90sq.ft.)wide boulder mounded wood platform/dock with a 4' wide x± 7 linear foot long access walkway with rails and three new tie-off piles, waterward of the apparent high water line; with the condition of the use of thru-flow decking on the entire dock; and as depicted on the site plan prepared by Docko, Inc., dated December 12, 2018; within a near shore area in a Coastal Erosion Hazard Area located on property on parcel SCTM# 1000- 3- 2- 6 off 12244 East Main Road, Fishers Island , New York. This initial application being made within the Costal Erosion Act as well as the Tidal Wetlands Act. Members of the public had the opportunity to appear and the record was closed on July 27, 2021. APPEAL OF THE TRUSTEE'S DETERMINATION Pursuant to §111-24 the Town Board is designated as the Coastal Erosion Hazard Board of Review and has the authority to "[h]ear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by the Administrator in the enforcement of this chapter."See, Town Code §111-24 (B). Furthermore, the Coastal Erosion Hazard Board of Review has the authority to "reverse or affirm, wholly or partly, or may modify the order, requirement, decision or determination of the Administrator, including stop or cease-and-desist orders." See, Town Code §111-25. When considering appeals pursuant to §§ 111-24 & 25, the Board is limited to the record on appeal and the arguments made before the Board of Trustees. In this instance, this Board finds, based upon the record before it, that the applicant has supplied the sufficient information regarding the criteria set forth in §111-9(A-C) of the Town Code to support the granting of a Coastal Erosion Management Permit. CONCLUSION Therefore, in the interests of justice and for the reasons set forth herein, this Board grants the appeal of the Applicant pursuant to Chapter 111 of the Town Code to construct± 105 linear feet of 4" wide wood pile and timber pier of which± 65 N, linear feet is waterward of the apparent/spring high water line, including five associated M ladders, rails, electric and water utilities; construct of 9' x± 10 ( 90sq.ft.) wide boulder mounded wood platform/dock with a 4' wide x± 7 linear foot long access walkway with rails and three new tie-off piles, waterward of the apparent high water line; with the condition of the use of thru-flow decking on the entire dock; and as depicted on the site plan prepared by Docko, Inc., dated December 12, 2018; within a near shore area in a Coastal Erosion Hazard Area located on property on parcel SCTM# 1000- 3- 2- 6 off 12244 East Main Road, Fishers Island ,New York. SCTM# 1000-3-2-6 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested.- A. uggested.A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The proposed dock structure is within the Coastal Erosion Hazard Area (CEHA). All development is prohibited in the nearshore area pursuant to11� 1-11. unless specifically provided for by Chapter 111, COASTAL EROSION HAZARD AREAS. Pursuant to § 111-6, allowable activities in these areas maV include open timber piles or other similar open work supports with a top surface area of less than 200 square feet which are removed in the fall of each year. The proposed action is prohibited in the nearshore area pursuant to Chapter 111, COASTAL EROSION HAZARD AREAS as it is greater than 200 square feet and not removable. § 111-6. Definitions. UNREGULATED ACTIVITY -- Excepted activities which are not regulated by this chapter include but are not limited to elevated walkways or stairways constructed solely for pedestrian use and built by an individual property owner for the limited purposes of providing noncommercial access to the beach; docks, piers, wharves or structures built on floats, columns, open timber piles or other similar open work supports with a top surface area of less than 200 square feet or which are removed in the fall of each year;normal beach grooming or cleanup; maintenance of structures when normal and customary and/or in compliance with an approved maintenance program; planting vegetation and sand fencing so as to stabilize or entrap sand in primary dune and secondary dune areas in order to maintain or increase the height and width of dunes; routine agricultural operations, including cultivation or harvesting; and the implementation of practices recommended in a soil and water conservation plan as defined in § 3, Subsection (12), of the Soil and Water Conservation Districts Law; provided, however, that agricultural operations and implementation of practices will not be construed to include any activity that involves the construction or placement of a structure. 6.2 Protect and restore Significant Coastal Fish and Wildlife Habitats. A. Protect Significant Coastal Fish and Wildlife Habitat values from uses or activities that would: 1. Destroy habitat values associated with the designated habitat through. a. direct physical alteration, disturbance, or pollution, or b. indirect effects of actions, which would result in a loss of habitat. 2. Significantly impair the viability of the designated habitat beyond the tolerance range of important fish or wildlife species which rely on the habitat values found within the designated area through: a. degradation of existing habitat elements, c. functional loss of habitat values, or d. adverse alteration of physical, biological, or chemical characteristics. Alteration of tidal patterns in the Fishers Island Beaches, Pine Islands, and Shallows habitat could have negative impacts on the fish and wildlife communities present. Construction of shoreline structures, such as docks and piers in areas not previously disturbed by development may result in the loss of productive areas which support the fish and wildlife resources of the Fishers Island Beaches, Pine Islands, and Shallows habitat. Physical disturbance to sensitive habitats could occur. Unrestricted use of motorized vessels including personal watercraft in the protected, shallow waters of this habitat can have adverse effects on aquatic vegetation and fish and wildlife populations. Use of motorized vessels should be controlled (e.g., no wake zones, speed zones, zones of exclusion) in and adjacent to the area's shallow waters and vegetated wetlands. Eelgrass beds are particularly sensitive to alterations in water quality parameters including temperature, salinity, light penetration, organic matter concentration, and the presence of pollutants. The use of the boulder in public waters for a private wood platform/dock with a 4' wide x ±7 linear foot long access walkway with rails is unsupported. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction It is recommended the Board assess the dock structure to § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code; in particular: [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; The dock structure is proposed in the New York State Significant Coastal and Fish and Widlife Habitat Area/ NYSDEC Critical Environmental Area. At the discretion of the Board of Trustees, any operations proposed in critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of structures, and increasing the width of non-disturbance buffers. [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including eelgrass (Zosters marina) and widgeon grass (Ruppia maritima) or shellfish; Information submitted to the Board (New Fixed Dock SAV Exhibit Sheet 1 of 1) verifies that vegetated wetlands (spartina alterniflora), eelgrass and habitat occurs in the area where the dock structure is proposed. The exhibit does not include the dock schematic. Based on information submitted, it appears that the proposed dock could have a large, direct, adverse impact on eelgrass and habitat(New Fixed Pier and Platform Sheet 3 of 4). Eelgrass beds and habitat are aapear to be located under, adjacent and surrounding the proposed dock. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and The continued construction of dock structures within a Significant Fish and Wildlife Habitat/Critical Environmental Area will affect the public use of the area and degrade the ecological quality of the area through introduction of contaminants, disruption of marine life habits etc. .... No adverse impact on tidal or submerged vegetation is anticipated as a result of the posed project. In addition,the NYS DEC prepared a study showing that the proposed pressure-treated Southern Pine timber products construction materials are suitable for this type of project in this location, except for decking which will be of untreated woods or composite (or plastic)materials. There is virtually no public use of the waterfront in this area and the construction of the pier and landward extension above the apparent high-water line are not likely to influence or change this fact or these conditions.
