The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. The house construction is nearing completion and my client would like to purchase the house from the builder/current owner by the end of the year. I was made aware when I stopped into the Building Dept. and Trustees office this week that there must be a closed out Trustees Permit to get a CO for the residence. I was also told the only way to close out the Trustees permit (outside of having all things complete) is to say we decided not to install the pool and patio (which is pending Trustees admin approval). My understanding is that after getting a certificate of compliance from the Trustees without the pool and patio, my client would have to start a new application for the pool and patio as already approved(assuming the modification is approved). If there's no way to get a house CO while retaining the Trustees permission to build the pool/patio later...my question.for you is whether you and the Trustees would be agreeable to an administrative approval of the new application. Since it would be a re-application for the same pool and patio as already approved it seems like it would be unnecessary for there to be a public hearing, or to follow the same process as if it were an application that hasn't been heard. I know how many applications you get and I hope you agree there's little reason to go'through the same process to review something if this current Board of Trustees has already made a decision in favor of it. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2.
