TERMS AND CONDITIONS The Permittee James Willse& Sharon Stack Willse, residing at 1665 Mill Creek Drive, Southold,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Box 1179 York 3' � � Southold,New York 11971 Michael J.Domino G Telephone(631) 765-1892 Greg Williams Fax(631) 765-6641 c4UNrl,� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD May 26, 2021 Jeffrey Patanjo P.O.-Box 582 Bohemia, NY 11716, RE: JAMES WILLSE & SHARON STACK WILLSE 1665 MILL-CREEK DRIVE, SOUTHOLD SCTM# 1000-51-6-31:4 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, May 19, 2021 regarding the above matter: WHEREAS, Jeffrey Patanjo on behalf of JAMES.WILLSE & SHARON STACK WILLSE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated February 12, 2021 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for.their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 14, 2019 and May 19, 2021, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of JAMES WILLSE & SHARON STACK WILLSE for the installation of 266 lineal feet of coir-log shoreline stabilization along existing eroded bank. Ehlers Land Surveyor dated January 23, 2012, and having considered the plans for this proposed project submitted by Jeffrey Patanjo dated April 26, 2021 at the Trustee's May 17, 2021 work session, and WHEREAS, on May 19, 2021 the Southold Town Board of Trustees declared itself Lead Agency pursuant to S.E.Q.R.A., and S _ WHEREAS, on May 19, 2021 the Southold Town Board of Trustees classified the application as an unlisted action under S.E.Q.R.A., and WHEREAS, in reviewing project plans submitted by Jeffrey Patanjo dated April 26, 2021 it has been determined by the Board of Trustees that all potentially significant environmental concerns have been addressed as noted herein: • A site inspection by the Southold Town Board of Trustees recognized erosion on this property and the need for a bank stabilization/erosion control plan. • As time progresses, continued soil loss at the toe of the bank may lead to habitat degradation and bank instability. • Protection of the toe of bank using natural, temporary structures including coir logs is necessary. • -Vegetative, non-structural measures are not capable of stabilizing the erosion of the bluff alone. THEREFORE, according to the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies provided that the Board determines that: 1. The use of vegetative, non-structural measures will not sufficiently protect the shoreline. 2. The enhancement of natural protective features using practical vegetative measures would not be effective in controlling erosion. LWRP policy 4.1.D supports the installation of hard structural measures in the bay only where: 1. Avoidance of the hazard is not appropriate because a structure is functionally dependent on a location on or in coastal waters; located in an area of extensive public investment; or reinforces the role of Maritime Centers or Areas for Concentrated Development. A residence does not need to be close to the shore to function. 2. Vegetative approaches to controlling erosion are not effective. See above. To be determined by the Board. 3. Enhancement of natural protective features would not prove practical in providing erosion protection. To be determined by the Board. 4. Construction of a hard structure is the only practical design consideration and is essential to protecting the principal use.
