The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action of replacing the stairs is CONSISTENT with the LWRP. Note that the protective function of any vegetated or non-turf buffer in between the retaining wall and the bulkhead will be reduced by the new deck, which will cover approximately 20% of that area. Consider a smaller deck to improve the function of the buffer. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. cc: Damon Hagan, Assistant Town Attorney Cantrell, Elizabeth From: Cantrell, Elizabeth Sent: Monday, March 1, 2021 10:40 AM To: jjpatanjo@gmail.com Subject: KELSEY Property; SCTM# 1000-128-6-4 Jeff, I don't know if Amanda spoke to you but she had reviewed the survey last dated November 5, 2020 and determined that the project does not need a variance from Zoning Board of Review. I am reviewing the Trustees application for proposed work at 3790 Peconic Bay Blvd., Laurel. There is an "as built" deck addition to the house that does not meet the required 15'side yard setback. This would require a variance from the ZBA or they could cut it back. In addition, the surveyor needs to indicate whether or not there is a bluff on this lot as defined by the Town Code definition (see below). The survey indicates it's a bluff but your plans display it as a bank. If this is a bluff, then the "as built" deck and the proposed 6.50.5 covered deck will require variances from ZBA. Please provide the Trustees with a revised survey that displays the topography and slope of the area in question. Town Code definition of bluff: Land presenting with a precipitous or steeply sloped face adjoining a beach or a body of water. For the purposes of this chapter, a precipitous or steeply sloped face shall be a face with a slope of 20%or greater and a height of greater than 20 feet between the toe of the bluff and the top of the bluff.
