party of the first part,and KRISTEN TODEBUSH RYAN, residing at 180 Remington
Road, Manhasset, New York 11030, as Trustee of the RESTATEMENT TRUST
AGREEMENT ESTABLISHING WEST CREEK AVENUE TRUST, MARY HAWKE TODEBUSH,
GRANTOR, dated February 19, 2020,
party of the second part,
WITNESSETH,that the party of the first part,in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate,
lying and being in the Town of Southold, County of Suffolk and State of
New York, at Fleet's Neck, near Cutchogue, bounded and described as
follows:

BEING AND INTENDED TO BE one of the parcels of the same premises as
conveyed to the West Creek Avenue Trust by deed dated December 8, 2007
and recorded in the Suffolk County Clerk's Office on June 17, 2008 in
Liber 12554 Page 909; as confirmed by deed dated December 22, 2008 and
recorded in the Suffolk County Clerk's Office on December 24, 2008 in
Liber 12575 Page 882.
This deed is given to confirm Kristen Todebush Ryan as Trustee of the
Restatement Trust Agreement Establishing West Creek Avenue Trust, Mary
Hawke Todebush, Grantor, dated February 19, 2020, as the owner of the
premises described in the attached Schedule A.
TOGETHER with all right,title and interest, if any,of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.

BEGINNING at a monument on the east side of West Creek
Avenue at the southwest corner of land now or formerly of
Brooks; running thence along said last mentioned land and land
now or formerly of Seligman North 86° 03' 40" East a distance of
300.00 feet to a monument set in the west side of Holden Avenue;
running thence along the west side of Holden Avenue South 03'
56' 20" East 200.00 feet to land now or formerly of McIntosh;
running thence along said last mentioned land and land now or
formerly of Sweeney South 86° 03' 40" West 300.00 feet to a
monument set on the east side of West Creek Avenue; running
thence North 03' 56' 20" West along the east side of West Creek
Avenue 200.00 feet to the monument at the point or place of
BEGINNING.
TOGETHER WITH the use in common with others of a right of.
way thirty-five (35) feet in width as now marked out at a point
about five hundred (500) feet southerly from the premises
conveyed to Ottomar J. Gebhardt and wife, by deed recorded in
the Suffolk County Clerk's Office in Liber 2075 of Deeds at Page
595 and extending from the westerly line of West Creek Avenue at
right angles thereto about fifty (50) feet to West Creek.
