SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru 25, and the Suffolk County Department of Planning issued its reply dated January 12, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 1, 2021. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed second story addition is EXEMPT; and that porch addition is CONSISTENT with the LWRP since the porch is located on the landward side of the single-family residence. The proposed minor one-story addition with entry porch is recommended as INCONSISTENT due to the proposed 21-foot t setback to a freshwater wetland. This porch replaces an existing patio to be removed, and any adverse impacts could be mitigated and therefore made CONSISTENT by allowing the porch to remain open and remain unhabitable space. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 11,810 square foot parcel in the R-80 Zoning District. The northerly east property line measures 110.00 feet and is adjacent to Equestrian Avenue and runs to the northeast point of the property line that runs northeast and measures 105 feet where it then meets the southeast corner point of the property that measures 115feet and runs to the southwest point of the property which measures 105 feet and continues northwest to Equestrian Avenue. The parcel is improved with a framed two-story dwelling. There is a detached single car garage on the southeast corner of the property that is reached by a paved driveway from Equestrian Avenue. There is a freshwater wetland located on the subject property as shown on the survey prepared by Craig P.Bigger,LS and dated December 28,2020. Page 2,March 18,2021 #7474,Carney SCTM No. 1000-9-6-3 BASIS OF APPLICATION: Request for Variances from Article XXIII, Sections 280-124 and the Building Inspector's December 15,2020 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling;at 1)located less than the code required minimum front yard setback of 35 feet;2)located less than the code required minimum rear yard setback of 35 feet; located at Equestrian Avenue, Fishers Island,NY. SCTM#1000-9-6-3. RELIEF REQUESTED: The applicant requests variances to construct additions and alterations to an existing single- family dwelling with a front yard setback of 20.8 feet and a rear yard setback of 22 feet where the code requires a a minimum front yard setback of 35 feet and a minimum rear yard setback of 35 feet as shown on the Site Plan prepared by Sam Fitzgerald, Architect PC, dated November 15, 2020.The plans call for the conversion of a corner of the house to an open porch(46 sq. ft.), 2)remove a small portion of the existing roof to make an inset dormer, 3) construct a new covered porch at the rear of the property,4)construct a new one-story addition(96 sq. ft,)at the rear of the dwelling. The applicant's house is one of the smaller homes in the neighborhood. ADDITIONAL INFORMATION: Although the application submitted to the Building Department is for proposed construction, the applicant's builder started construction on the house without permits. This work was eventually halted by the Town's Chief Building Inspector, who submitted photographs of the"as-built"construction to members of the Zoning Board of Appeals. The applicant's neighbor testified at the public hearing in support of the application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 4, 2021 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The front yard setback is similar to other homes in the neighborhood. This is a very old home that the applicants wish to update and bring restore the architectural charm of the original Victorian dwelling. The prosed additions are all small and will not block any views from adjacent properties 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The non-conforming setbacks are existing so any work on the existing dwelling will require variance relief 3. Town Law X267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 40.5% relief from the code for the front yard setback and 37% relief from the code for the rear yard setback. However, the house was built in the 1800's before zoning laws were in place. The applicants wish to update the dwelling and restore it and only 60 square feet of livable floor area will be added. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The architect, stated at the hearing that the applicants plan to add a buffer to protect the pond on the property along will dry wells to prevent runoff from the roof to further protect the wetlands located on the property along with abandoning the old septic system and replacing it with anew system. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 3,March 18,2021 #7474,Carney SCTM No. 1000-9-6-3 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Acampora, seconded by Member Lehnert, and duly carried, to GRANT the variances as applied for,and shown on Site Plan and Architectural Plans(Pages 1 through 11)prepared by Sam Fitzgerald,Architect PC, dated November 15,2020. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The new open porch shall remain open and unenclosed. 2. The covered porch in the rear shall remain unenclosed and uninhabitable. 3. As a condition (No. 1) of variance relief by the Zoning Board of Appeals, dated March 18, 2021, the proposed open porch was to remain open and unenclosed. You explained in your letter that the owner installed screens to the porch and did not think that there may be a zoning issue. You further describe the porch as unheated, not fully enclosed and not livable floor area. The overall project is now substantially complete, the Chief Building Inspector conducted a final inspection, and he flagged the screened in porch as requiring'a ZBA de minimus approval. Since the amended improvements uphold the intent of ZBA Appeal No. 7474 and the new porch shall remain uninhabitable, I have determined that your request is de minimus in nature. Please advise your clients that all other conditions will still apply. Contact us if you have any further questions or concerns. The variance included the addition of an open porch. During the course of construction, the owners decided theywould like to screen in this porch, and theyworked with the contractor to do this work. I don'tthinkthe ownerand contractor realized there might be zoning implications. The overall project is now substantially complete, and Mike Verity conducted a final inspection. Mike saw the screened-in porch and flagged it as a potential zoning issue. We'd liketo see if screening this porch can be ruled a de minimis change. It is the same footprintas was approved. It is still an unheated porch;it is not a fully enclosed space, and it is not livable floor area. I have enclosed updated pages from the original variance application that include a site plan and floorplan, and I have also included as-built photos. Thanks very much for your consideration on this. CC: file,Z.B.A. REASONS FOR APPEAL (Please be specific, additional sheets may be used with preparer's signature notarized): 1.An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted, because: There are four projects within this variance:1)convert a comer of the house to an open porch(46 sq ft);2)remove a small portion of the existing roof to make an inset dormer,3)construct a new covered porch at the rear of the property;4)construct a new one-story addition(96 sq.ft.)at a rear comer of the house. The first two projects will be a reduction in overall construction. The last two projects are located at the rear of the house and, while visible from the road, are one-story in height and will block no views from any adjacent properties. The additions will be seamlessly integrated into the existing architecture of the house. No increase in the number of occupants of the house as a result of the proposed work, and no additional traffic will be created. 2.The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: Any work to a portion of a principal structure within non-conforming setbacks must go through the variance process. The lot is significantly undersized for its zone, and good portions of the existing house sit within required yards. 3.The amount of relief requested is not substantial because: Of the four individual projects in this application, two are within the building footprint and will result in a reduction in livable floor area. The proposed porch at the rear of the house will be built on the site of an existing patio and will be of roughly the same impervious coverage. The proposed one-story addition, also at the rear of the house, is only 96 square feet and will not increase the nonconformity of the setbacks. Overall, the proposed activity will increase the building coverage from 13%to 17%, well under the maximum allowed coverage of 20%. Overall, the livable floor area will increase by only 60 square feet. 4.The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: No adverse impact. The footprint of the applicant's existing house is the smallest of any house on the surrounding properties. With the proposed additions, it will still have the smallest footprint. There will be no new grading required for this project. The area of construction disturbance will be kept to a minimum, and all run-off from new roofed areas will be directed to drywells. 5.Has the alleged difficulty been self-created? {X}Yes,or{ }No Why: The existing house was legally built at its current site. The applicant is not seeking to legitimize any illegally built structures but is instead seeking the proper permits before undertaking the project. Are there any Covenants or Restrictions concerning this land? PQ No {}Yes(please furnish a copy) This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health, safety and welfare of the communitk.
