SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru 25, and the Suffolk County Department of Planning issued its reply dated January 7,2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 40,000 square foot parcel located in the R-40 Zoning District. The northerly property line measues184.33 feet, the easterly property line measures 217.00 feet,the southerly property line measures 184.33 feet and the westerly property line measures 217.00 and is adjacent to Pequash Avenue(aka Fleet's Neck Road). The property is currently vacant. A survey has been prepared by John T.Metzger,LS, dated December 10,2020,to show the proposed property improvements. BASIS OF APPLICATION: Request for Variance from Article III, Sections 280-15 and the Building Inspector's December 2, 1010, Amended December 8, 2020 Notice of Disapproval based on an application for a permit to construct an accessory garage in conjunction with a new single-family dwelling; at 1) located in other than the code permitted rear yard; located at: 1895 Pequash Avenue, Cutchogue,NY. SCTM#1000-103-7-15. RELIEF REQUESTED: The applicant requests a variance to construct an accessory garage in conjunction with a new single-family dwelling to be located in the side yard instead of being located in the code required rear yard, as shown on a survey prepared by John T. Metzger,LS, dated December 10,2020. ADDITIONAL INFORMATION: One neighbor testified at the Public Hearing and voiced concerns for her privacy, and asked the applicant to consider planting landscape screening between their adjoining properties. The applicant was asked if amending the design to conform with the Town Code's requirement for a maximum size breezeway of Page 2,March 18,2021 #7466,Brodsky SCTM No. 1000-103-7-15 80 square feet in area, or to possibly attach the garage to the dwelling would be acceptable. The applicant did not wish to change the proposed design. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 4, 2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed plans show a 180 square foot breezeway connecting the front yard to the back yard with the roof line contiguous from the dwelling over the breezeway to the garage. Town Code does not allow a breezeway to be more than 6 feet wide or larger than 80 square feet in size. Due to the requested oversized 180 square foot breezeway,the garage then becomes an accessory structure in a side yard which is not permitted by code. While the visual impact of the proposed design on the streetscape is not significant, the precedent set by granting variance relief would be substantial because it would effectively permit accessory structures in a side yard, in contravention of the existing code.Additionally,garages on Pequash Avenue are generally attached to principal dwellings. 2. Town Law 267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue,other than an area variance. The applicant can reduce the size of the breezeway or attach the garage to the dwelling which would eliminate the need for variance relief. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief from the code. The proposed garage, if attached to the dwelling, or connected by a code conforming breezeway, could alleviate the need for the variance relief requested. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law§267-b(3)(b)(5). The difficulty been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief IS NOT the minimum action necessary to enable the applicant to enjoy the benefit of a breezeway connecting a residence to an accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. One of the defining design features of this house is the breezeway bisecting the house and the garage, while-connecting the-front and rear,yards. This exterior walkway Is integrat to the overall,design-and•possibly the,most important exterior design element,in the way it softens the length of the ranch with space and right,white distinguishing it visually with space and tight.To lose the breezeway, by relocating the garage to the rear yard or by attaching it to the house to establish code compliance, is essentially to lose the centerpiece of-the whole exterior design. 3, in order to proceed with this design,we need a variance to permit the garage(connected to the house by a single continuous roof yet considered an accessory structure for lack-of sharing a war with a door directly into the house}to be located in the side yard The street view of the breezeway would be like many breezeways in the area.
