This Special Meeting will be held virtually via the Zoom online platform. Pursuant to Executive Order 202.1 of New York Governor Andrew Cuomo in person access by the public will not be permitted. The public will have access to view and listen to the meeting as it is happening via Zoom. However, this meeting is not a public hearing and no testimony will be solicited or received from anyone in attendance. Okay having said that the Executive session has been held. Is there any item a Board Member would like to add to a future agenda? No, okay. We have a request for an extension but that's at the end it's on the work session, the resolution is at the end of the meeting so let's just get right down to the possible resolutions to close hearings. Regarding Vincent Bertault #7467 and Vincent Bertault #7468SE.The Board has received lots of information from the applicant's attorney which we appreciate and from the applicant. We've examined the Certificate of Appropriateness and its appeal to the Town Board for the denial and because we really can't tell what this thing is going to eventually look like, until such time that matter is resolved I'm going to suggest that we simply adjourn both of those without a date until such time as the attorney can indicate to us that the matter has been resolved successfully and a Certificate of Appropriateness is issued by the HPC on both the subject dwelling and the subject barn.There was a prior C of A on the barn however it would appear that HPC needs to look at the current plans because they are not in the same fenestration and so on as what was previously approved so we'll be in touch with the applicant's attorney. I'm going to make a motion on both of those to adjourn without a date subject to a determination by the HPC regarding a Certificate of Appropriateness for both structures. Is there a second on that? An interior inspection was conducted today by the Building Department and the Vice Chair Member Planamento and I think at this point we probably have everything that we need in order to make a decision. I see that Eric Bressler has his hand raised but I have to say that we can't discuss anything with any of the attendees. As you know it's not a hearing so if Eric if you have any questions perhaps you can give the office a call tomorrow and we can take it from there. So the next possible close is Suffolk County Energy Storage 11, LLC #7463SE,this was adjourned from March 4t". We just received literally at the last minute a very substantive letter from the Group for the East End literally a couple of hours ago. Board Members have not had a chance to review it, the public hasn't had a chance and as importantly Mr. Losquadro has not had a chance to look at it and make comments in writing if he chooses to do so or comments before the Board at a hearing if he chooses that. So based upon that I think what we need to do is simply adjourn to April 11t to give everyone involved an opportunity to read this very detailed letter which I certainly have not had a chance to digest. You've all gotten a copy right, Board members yeah? Okay. I think that that's really the appropriate thing to do is let everybody make the comments they wish to about that and us too we need to really look at it carefully and consider what's in that. I don't know if the Board wants to entertain this, Mr. Losquadro was saying he's asking that we close the hearing now and he can explain why that is his request. We really don't take testimony or discuss things with applicants at this public meeting but it's an opportunity for them to hear us deliberate. I think that's probably the prudent thing to abide by. Does the Board have any other thoughts about that that we should talk about? I'm not hearing anything but I think we have to because otherwise we're just letting ourselves open to just then why don't you want to talk to me and why can't you answer that we just can't do that. I'm sorry about that but that is the proper thing to do. MEMBER DANTES : Leslie, the only thing I would maybe we can make a deadline that if anyone wants to comment they have a week to do so because I don't want to get another letter five minutes before the next hearing and say no we can't close it again. We are now on the section of the draft decisions and we will be deliberating on seven this evening, Brodsky, DiMeglio, Drummond, Cottage on Third, Zappulla, Carney and Briggs. Let's take a look at everybody have application from Jim Brodsky #7466. It's an application on Pequash,we have a draft here. Pat do you want to maybe you can summarize a couple of these points here. MEMBER ACAMPORA :Sure,the applicant requested a variance to construct an accessory garage in conjunction with a new family dwelling and the configuration would put the garage in the side yard instead of being located in the code required rear yard. Unfortunately the plans shows that a 180 sq. ft. breezeway connecting the front yard to the back yard with a roof line contiguous to the dwelling over the breezeway to the garage.The town code does not allow a breezeway to be more than 6 feet or larger than 80 sq.ft.So due to the requested oversized breezeway the garage then becomes an accessory structure in the side yard and that's not permitted by code. When we had the public hearing we asked the applicant if there was any way they would want to reconfigure this plan to comply with the code. At that time the applicant said they weren't prepared to do that so I move that we deny the application. CHAIRPERSON WEISMAN : Any comments or questions or suggested changes to the draft? DiMeglio Jr. on Deep Hole Drive in Mattituck. This is for a combined side yard setback and a front yard setback. Eric do you want to summarize this for us. MEMBER DANTES : Sure,this was basically a house that was tear down or a vacant lot two years ago and they made an application to the Building Department for a building permit to build a house which was granted and they're in the process of building the house and now they want to add a covered porch but the problem is they've already used up the front yard setback and they already have the minimum 35 foot setback and the covered porch would extend past that. So the covered porch is characteristic of the neighborhood non-conforming front yard setbacks are not characteristic of the neighborhood. They had other designs they could have done when they designed the house to be code conforming and so I make the motion to deny the front yard setback. It looks like when they were building they might have poured the foundation a little bit too close to the side yard line and as it's only a matter of a couple of inches I make the motion to grant the non-conforming side yard setback. CHAIRPERSON WEISMAN : The combined side yard setbacks of 24.1 feet instead of 25. Okay so we have a deny in part and grant in part. MEMBER DANTES : I would like to add one more condition to it, that they submit a survey showing the exact side yard setback on the house without the front covered porch so we know exactly what it is cause if you look at the survey they submitted it shows the distance to the covered porch but it doesn't show the distance to the house itself. CHAIRPERSON WEISMAN :They could probably just add that to the-existing survey,that shouldn't be too egregious. Is everybody okay with that just so we confirm that it's 24.1 combined right? MEMBER LEHNERT : Yes. CHAIRPERSON WEISMAN : With the house without MEMBER DANTES : Showing what the side yard setbacks to the house are cause this survey is tough to scale that they gave and it shows the dimension to that covered porch not to the house. 7 ZBA Special Meeting March 18,2021 CHAIRPERSON WEISMAN : I don't know exactly how I guess the Building Department determined in their Notice of Disapproval that that was the case but it's not shown on that survey. I'm not sure there was no foundation plan I looked for it. MEMBER DANTES :There was no foundation survey so they never submitted it. CHAIRPERSON WEISMAN :So I'm goingto write down the applicant shall submit a survey showing the combined side yard setbacks without the proposed front porch. Does that work? MEMBER DANTES : Yes. The next one is for Robert and Donna Drummond #7471 on Private Rd. #12 in Southold. This is a relief for legalizing as built deck addition with 8 ZBA Special Meeting March 18, 2021 hot tub and existing single family dwelling having a side yard setback of 8.1 feet where the code requires a minimum of 10 feet and legalizing an as built accessory shed in the front yard. This is a waterfront property. Pat you want to summarize a couple of points. MEMBER ACAMPORA : In the case of the applicant who are new owners to this property, in 1975 the Zoning Board approved a shed variance for the location of the shed in the front yard to a previous owner and in 1990 the same previous owners were granted a variance for the second story deck and it was approved by the Southold Trustees to the required setback and the decks and the hot tub from the existing bulkhead that they receive that. Based upon the information the shed is quite old and it really it's been there for a long time, it's kind of dwarfed by the neighbor's large garage and the screening that's on the property so I move to grant the variance as applied for with the conditions that the second story deck shall remain open to the sky and unenclosed. Number two,the first floor deck shall remain unenclosed and number three, should the shed in the front yard need to be replaced the applicant shall locate any new shed in a conforming location on the property. CHAIRPERSON WEISMAN : Okay that says it all. Any discussion by the Board Members or proposed changes? MEMBER LEHNERT : Nope. MEMBER PLANAMENTO : Second. This is an application for the construction of a garage/pool house that will result in a lot coverage of 22.91%where the code permits a maximum lot coverage of 20%. Eric would you walk us through this one. MEMBER DANTES :Sure,this was basically a house that was applied for a new building permit to tear down the old structures on the property and build a brand new house. It did come for variance review maybe two years ago and the Zoning Board at the time denied the request for the increased lot coverage but we did approve a request for a non-conforming setback. So the applicant has built the house, built a swimming pool and nearly maxed up their lot coverage so now they're making a second request for increased lot coverage.The applicant did submit several past variances that we granted however those other variances they were mitigating factors for the increased lot coverage or a pre-existing history of a non-conforming increased lot coverage. None of them were for a brand new house on a new construction property and the reality is the zoning code was written and it allows for smaller houses on small pieces of property which this is. So I make the motion to deny the variance as applied for. CHAIRPERSON WEISMAN : Are there any comments or questions or discussions from Board Members? I do want point out that the Board took a great deal of time as did the applicant's agent in submitting priors and we went through every single one of them and we weren't really able in this decision to distinguish those prior decisions for approval from the particular subject application before us. It's variance to demolish and reconstruct a single family dwelling with a front yard setback of 15.3 feet where 35 minimum is required and a 26.9% lot coverage where a maximum of 20% is required. Rob walk us through some of these but I will say it's really not a demolition. MEMBER LEHNERT : It's a technical demolition, they're adding a second floor to the house and demolishing enough of the first floor to kick it into the demo category. It's an existing building with a PreCO and also a legal garage with a legal apartment with a PreCO in the back. The basis of the construction is basically a second floor so the setbacks remain the same where the existing house is and the same with the lot coverage. It's not changing from what's there. It's basically a second floor addition. CHAIRPERSON WEISMAN : It's a substantial renovation a big improvement. MEMBER LEHNERT:Yes but we're not going outside the existing footprints. So I make the motion to grant the variance as applied for. CHAIRPERSON WEISMAN : Okay, so any discussion from the Board Members? MEMBER ACAMPORA : Just a typo kind of a cleanup in property facts and description the third line down where it runs 50. there's a space and then 11 feet so 11 ZBA Special Meeting March 18, 2021 MEMBER LEHNERT : Yeah it should be .11 the space needs to be taken out. The next one is #7474 .lames and Laurie Carney on Fishers Island on Equestrian Ave. This is additions and alterations to an existing single family dwelling located less than the code required minimum front yard setback of 35 feet and minimum rear yard setback less than 35 feet. We had a really good presentation by the agent on this that allowed us to understand what we were looking at. We're very grateful to things like that because it's next to impossible for us to get over there so we always wind up 12 ZBA Special Meeting March 18, 2021 ask the Building Inspector to do it so it was pretty clear. Pat summarize some of this for us will you. MEMBER ACAMPORA : This is a very old home on Fishers Island as you said. The applicant's representative gave us a very good background briefing and also a lovely picture of what the home looked like and so they really were looking to do a lot and the Building Inspector did tell us that they did when they went there they put a Stop Work Order because construction had started without a permit so right now nothing is going on with the rest of the construction until we get to the rest of this. There is some wetlands property on the applicant's property there that does have to at least we should be paying attention to and they have said that they will stay away from the wetlands and they will screen it and make sure that the proper drainage will be away from that wetland part.So I move to grant the variance as applied for with the conditions that the new open porch shall remain open and unenclosed and that the covered porch in the rear shall remain unenclosed and uninhabitable, so moved. Application #7477 Christopher and Marian Briggs also in Fishers Island. Rob would you tell us a bit about this one. MEMBER LEHNERT:This is an application to legalize two as built deck additions and an accessory shed in the front yard. This is a basically triangular shaped lot with two front yards and really anywhere on the site would require a variance.The decks are both first floor decks open to above and according to the applicant they've been there for thirty plus years, the same with the shed which is also screened from view. So this was written to grant the variance as applied for. CHAIRPERSON WEISMAN : That's strange, I mean there's houses there but there's also a lot (inaudible) a church and it's more like a village green almost. MEMBER LEHNERT : It's like a little downtown area. MEMBER ACAMPORA : It's a very prominent area in•Fishers Island. CHAIRPERSON WEISMAN : Yep. Okay so since we're able to see it so well based on that excellent presentation so we have a motion to grant as applied for, there are conditions there's two conditions. Those are fairly standard though and it's just applying for the Building Department for as built improvements and obtaining a Certificate of Occupancy. So is there a second to that?
