B.Town Engineer As per a request from your office, I have reviewed the As-Built(Drawing S-1) for the Boisseau Avenue Farm prepared by Charles W. Southard Jr., R.A., dated March 10, 2021, last revised January 5, 2022. Based on my review I make the following comments: 1. One 10' diameter x 12' deep leaching catch basin has been installed to the south of the structure labeled "60x42 Unheated BARN". 2. One 10' diameter x 12' deep leaching catch basin has been installed on the "Gravel Access Roadway' approximately 105' east of the curb cut on Boisseau Avenue. This structure is incorrectly identified as a 10' diameter x 9' deep structure on the drawing and is incorrectly shown as located approximately 40'east of the curb cut. 3. The details provided for Test Hole B-1 and Test Hole B-2 indicate that the drainage structures have been installed into sand that is suitable for leaching structures. 4. The"Gravel Access Roadway" is currently constructed of compacted recycled concrete aggregate, not gravel. Staff: at the writing of this report, staff cannot confirm that these storm water items listed above were satisfactorily addressed. IV. Site Plan Approval expired Februa 2022: a. On July 25, 2023 Eleftherios Kougentakis, owner, submitted a request for Extension of Site Plan Approval; and b. The expired Site Plan remains in compliance with current rules and regulations V. Items to consider: 1. Grant an extension of Site Plan Approval for six (6) months in order to close out the application; 2. After verification is received from the Town Engineer regarding the items above, support the issuance of a Certificate of Occupancy (CO) from the Building Department; 2 FBI CEIVED ..L U 2'"'5-.. ?023--] A V E.'. . Based on my inspections I note the following: • A single 10' diameter x 12' deep leaching catch basin was installed near the barn where two connected 10' diameter x 9' deep leaching catch basins are shown on the approved plan (a deficit of 6 vertical feet of 10' diameter leaching structure). • The single 10' diameter x 9' deep leaching catch basin shown near the greenhouses was not installed. • A single 10' diameter x 12' deep leaching catch basin was installed on the access road. This does not match the drainage calculations (which require five 10' diameter x 11' deep leaching catch basins) or the site plan depiction of the access road (which shows five 10' diameter x 9' deep leaching catch basins). • The site plan shows the location of the test hole but not the test hole details so there is no way to determine if the structures may have been installed over soils unsuitable for drainage. Due to the deficiencies noted above, my office cannot approve the drainage structures installed at this site at this time. We are in agreement that the project should be approved in an expeditious fashion which we hope would be at the August meeting of the Planning Board. AAC feels that the Town of Southold should be doing everything in its power to continue to encourage and support farming operations, especially on a parcel such as this one, which, if the owner so chose, could be developed in any number of non-agricultural ways. Overgrown (and fully buildable) farmland such as this parcel are rarely brought back into agricultural production; usually they meet the builders shovel and become housing. Even with waiving many of the onerous site plan requirements, the applicant is still waiting for approval. We strongly object to the requirement to go before the Planning Board for simple ag structures like this one. Please note that the hoophouses on this site plan are not considered structures in the State of New York, and should not be subject to your review or permitting by any agency. Please approve the application as presented as quickly as possible! Thank you. ATTENTION:This email came from an external source. State Environmental Quality Review Act SEQRA 6 NYCRR, Part 617.5 (c), The proposed action is a Type II Action as it falls within the following description for 6 NYCRR, 617.5(c)(3) agricultural farm management practices, including construction, maintenance and repair of farm buildings and structures, and land use changes consistent with generally accepted principles of farming; f. Relevant farming Code sections include: o § 280-97 Right to farm 10 (A) The Town Board of the Town of Southold finds that farming is an essential activity within the Town of Southold. Farmers provide fresh food, clean air, economic diversity and aesthetic open spaces to all the citizens of our Town. In addition, land in agricultural uses requires less tax dollars for services than does land with residential or commercial development. Accordingly, farmers shall have the right to farm in Southold without undue interference from adjacent landowners or users. For the purpose of reducing future conflicts between people residing on tracts adjacent to farmlands and farmers, it is necessary to establish and give notice of the nature of the farming activities to future neighbors of farmland and farming activities. (B) Agricultural activities conducted on farmland, undertaken in compliance with applicable federal, state, county and Town laws, rules and regulations, are presumed to be good agricultural practices and presumed not to adversely affect the public health safety and welfare. We find that whatever nuisance may be caused to others by such uses and activities, so conducted, is more than offset by the benefits from farming to the community. Therefore, all such activities shall be protected farm practices within the Town of Southold. § 280-99 Right to undertake protected farm practices, (A) Farmers shall have the right to undertake protected farm practices in the active pursuit of agricultural operations, including, but not limited to: clearing; grading; plowing; aerial and ground spraying; the use of legal agricultural chemicals (including herbicides, pesticides and fertilizers); raising horses, poultry, small livestock and cattle; processing and marketing produce; installing water and soil conservation facilities; utilizing farm crop protection devices; designing and constructing and using farm structures, including barns, stables, paddocks, fences, greenhouses and pump houses; using water; pumping; spraying; pruning and harvesting; disposing of organic wastes on the farm; extensive use of farm laborers; training and others in the use and care of farm equipment, animals; traveling local roads in properly marked vehicles; and providing local farm produce markets near farming areas. (B) These activities can and do generate dust, smoke, noise, vibration and odor. These activities may occur on holidays, Sundays and weekends, at night and in the day. Such activities are presumed to be reasonable. Such activities do not constitute a nuisance unless the activity has a substantial adverse effect on the public health, safety and welfare.
