Box 1047 Southold, NY 11971 'RE: SOUTHOLD SUNSETS, LLC 4200 KENNEY'S ROAD, SOUTHOLD SCTM# 1000-54-4-3 Dear Mr. Kimack: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Thursday, March 18, 2021: WHEREAS, Michael Kimack, on behalf of SOUTHOLD SUNSETS,ILC applied to the Southold Town Trustees for an Amendment to Wetland Permit#9752 and Coastal Erosion Permit#9752C under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated January 5, 2021, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Exempt from LWRP review, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 18, 2021, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposed structure, as applied for, is located in a dune area as per Definitions in Chapter 111 Coastal Erosion Hazard Areas of the Town Code and governed by Section 111-13 A. In primary dune areas: (5) excavating, grading or mining of primary dunes is prohibited,.and, WHEREAS, the proposed structure, as applied for as per Definitions in Chapter 275-12 Standards for issuance of Permit. A. Will adversely affect the wetlands of the Town; NOW THEREFORE BE IT RESOLVED, that for the foregoing reasons, and because the proposed action is located within the coastal erosion hazard area and in a primary dune area, and because the proposed structure, as applied for is a prohibited act pursuant to Chapter 111 of the Town Code, the Trustees deem the proposed project to'be impermissible under Chapter 111, and because the proposed action, as applied for, will adversely effect the wetlands of the Town, the Trustees deem the proposed project to be impermissible under Chapter 275; and BE IT FURTHER RESOLVED, that the Board of Trustees DENIES WITHOUT PREJUDICE based on no action the application of SOUTHOLD SUNSETS, LLC for an Amendment to Wetland Permit#9752 and Coastal Erosion Permit#9752C to install an underground 500 gallon propane fuel tank (3' diameter x 10') anchored onto poured in place concrete counter weights with watertight containment sump, concrete vault and metal protective manhole with lid for nozzles; and as depicted on the site plan prepared by G&A Land Surveying Inc., received on January 5, 2021. On February 14,2018, the Town Trustees issued a permit under the Town of Southold Wetland Ordinance, Chapter 275 giving permission to demolish and construct a new one-story dwelling in the same footprint, with conditions. On April 5, 2018, the Trustees issued a determination stating that because the proposed dwelling would be located entirely within the designated Coastal Erosion Hazard Area, they could not issue a permit under the Tidal Wetlands Act, and therefore denied the permit without prejudice. The applicants then filed an appeal with the Southold Town Board who is the Town's designated Coastal Erosion Hazard Board of Review and was issued a determination granting a Coastal Erosion Management Permit on June 19, 2018 with conditions. Page 2,March 14,2019 #7103, Southold Sunsets SCTM No. 1000-54-4-3 PROPERTY FACTS/DESCRIPTION; The subject parcel is a 13, 827 sq. ft. waterfront property located at 4200 Kenny's Beach Road, Southold (Suffolk County Tax Map Lot# 1000-54-4-3)within the Low Density Residential R- 40 Zoning District ("the subject Property"). The subject Property has a frontage of 109.99 ft. along Kenney's Road, then runs 88.65 ft. along Long Island Sound, turning south 109. 42 ft, and then west to Kenney's Road for 137. 02 ft. The subject Property is currently improved with a one-story residence, deck, and shed. The subject Property is located wholly within the Coastal Erosion Hazard Area. BASIS OF APPLICATION: Request for a Variance under Article XXIII, Section 280-124 and the Building Inspector's July 31, 2017 amended October 10, 2017 Notice of Disapproval based on an application for a permit to demolish an existing dwelling and construct a new single family dwelling; at: 1) less than the code required minimum front yard setback of 35 feet and 2)more than the code permitted 20% maximum lot coverage.. With regard to that portion of the Notice of Disapproval addressing lot coverage; the Town Code defines lot coverage as "that percentage of the buildable land existing on a lot which is covered by the building area". Since the subject Property is located entirely within the Coastal Erosion Hazard Area, without relief from the Town Board (discussed below)the subject Property had no buildable area, any construction would exceed the permitted 20% lot coverage requirement of the R-40 zoning district. Therefore, even though the survey submitted by applicant showed that the proposed building only covered 12% of the lot area, because the subject Property had no buildable area, the proposed building was in excess of the allowed lot coverage. RELIEF REQUESTED: The applicant requests a variance to demolish an existing one-story house, and build a new one-story house elevated on piles to.FEMA compliance and in the same footprint, located four feet from the front property line, as approved by the Town Trustees and the Town Board as shown on the survey cited herein. Although, as discussed above, the Notice of Disapproval also stated the proposed building exceeded the allowable lot coverage, due to the location of the subject Property with the Coastal Erosion Hazard Area; the issuance of a Coastal Erosion Hazard Area permit addressed the issue and therefore there is no need for relief from that determination from this Board (see "ADDITIONAL INFORMATION"below). ADDITIONAL INFORMATION: Testimony was given by the applicant's attorney as to the history of the property. The property has gone through multiple hearings with various agencies of the Town of Southold and has received the following permits: 1. The Southold Town Trustees issued Wetlands permit number 9161, on February 14, 2018 finding the action consistent with the LWRP policies. 2. The Southold Town Board granted an appeal and the issuance of a Coastal Erosion Hazard Area Permit, with conditions, pursuant section 111-20 of the Town Code on June 19, 2018 for the construction of a 957.77 square foot one-story single-family residence on the subject Property. 3. The Southold Town Trustees issued a Coastal Erosion Management Permit 9161C on September 24, 2018. At the public hearing questions were raised by neighbors about the height of the proposed construction. Their questions were answered by both the Board Members and the owner's attorney who explained that the proposed dwelling would be one story and elevated on pilings to comply with the requirements of FEMA and that as a condition of the granting of the Coastal Erosion Hazard Area Permit, the town Board required the filing of a covenant that prevents the property owner from adding a second story in the future. Page 3,March 14,2019 47103,Southold Sunsets S&M No. 1000-54-4-3 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 5,2019 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed new one-story elevated dwelling will be similar in design and scale to the existing one- story dwelling and located in the same footprint. The subject property is at elevation 16, or in other words, the location of the property is 16 feet above sea level. To be FEMA compliant the first floor of the building must be 7 feet above the grade of the land. Therefore, to be FEMA compliant, the proposed structure will only be 7 feet higher than the existing structure. The covenant required by the Town Board in granting Coastal Erosion Hazard Area Permit limiting the proposed structure on the subject Property to one story also further ensures that granting the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the Southold Trustees prohibition on disturbing the primary dune to the west, and building any structures seaward of the existing disturbance area; the proposed dwelling can only be built in the proposed location and with the approval already granted by the Town of Southold Coastal Erosion Hazard Board of Review. 3. Town Law 4267-b(3)(b)(3). The variance request for relief from the minimum front yard setback requirement is mathematically substantial in that it represents 88.6% relief from the Code required 35 feet minimum front yard setback However, as set forth above the existing structure on the subject parcel currently enjoys the same set back as is being requested for the proposed new structure. Moreover, approvals for a new dwelling in the location proposed herein, have been obtained from the Town Trustee, and the Town Board,and conditions have been' imposed to mitigate possible impacts. 4. Town Law 5267-b(3)(b)(4). t The granting of the requested variance in this residential community will not have an adverse impact on the physical or environmental conditions in the neighborhood. The dwelling will be built on pilings per FEMA compliance to eliminate flooding of the dwelling and reduce ground disturbance. In addition, permits have been issued by authorities having jurisdiction over the Town's wetlands and Coastal Erosion Hazard Areas, thereby making the application CONSISTENT with the LWRP. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and all conditions imposed by the Southold Trustees, and Southold Town Board and repeated in this determination. 5. Town Law 5267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 5267-b.
