SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated December 1, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 18,305 square foot parcel located in an R-40 Zoning District. The parcel runs 140 feet fronting Racketts Court (a private road) along the westerly property line, runs 126.74 feet along the northerly property line, 146.79 feet along the easterly property line, and 128.80 feet along the southerly property line. The parcel is improved with a two-story frame house, and a frame shed. All is shown on a survey by Nathan Taft Corwin III L.L.S. dated April 27,2017. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building Inspector's October 28, 2020 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling; at 1) located less than the code required front yard setback of 35 feet; located at 265 Racketts Court, Orient,NY SCTM# 1000-17-6-9.1. RELIEF REQUESTED: The applicant requests a variance to construct first and second floor additions that will include a first-floor deck with an outdoor shower, and second floor open deck that will maintain the existing front yard setback of 21.2 feet where code requires a minimum front yard setback of 35 feet. ADDITIONAL INFORMATION: The proposed additions and alterations have received the required approval of the Historic Preservation Commission in Resolution#01.04.21.3 dated January 4,2021. Additionally,the applicant submitted prior ZBA decision #6756 for additions and alteration of a single-family dwelling located at 230 Oysterponds Lane, Orient, NY with a front yard setback of 27 feet and ZBA decision #6738 for additions and alteration to a single-family dwelling located 290 Skippers Lane, Orient with a front yard setback of 14.8 feet. Page 2,February 24,2021 #7452 Cavagnaro SCTM No. 17-6-9.1 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 4, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a residential neighborhood consisting of single-family homes in an historic district with homes that vary in style and size. The proposed additions will maintain the existing non-conforming front yard setback from Racketts Court, a private road that services very few homes. The existing dwelling faces open farm fields and will not change the character of the neighborhood or have any visual impact on any nearby properties. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The existing house has a non-conforming front yard setback so any addition in the front yard area will require variance relief. and the proposed additions maintain the existing setback. 3. Town Law§267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 39.4%relief from the code. However, the existing non-conforming setback is being maintained and the non-conformity is not being increased. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a larger home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried,to GRANT the variance as applied for, and shown on the Architectural Drawings by Anthony Portillo Architected labeled SPA, SD-1;2; 3 dated 1-5-2021. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Prior to receiving a building permit,the owner(s)of the subject property cited herein must sign a statement acknowledging: a. That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right, after a public hearing,to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXV, Section 280-141 of the Town Code. 2. The proposed first floor and second floor decks shall remain open to the sky. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Pursuant to Chapter,280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board granted variance relief to construct first and second floor additions that will include a first-floor deck with an outdoor shower,and second floor open deck measuring 9.0 ft. by 20.7 ft.that will maintain the existing front yard setback of 21.2 feet where code requires a minimum front yard setback of 35 feet. In your letter,you request a de minimus approval to increase the size of the approved second story deck from 4.8 ft. by 15.5 ft. to 9.0 ft,to 20.7 ft. You explain that the increased size of the second floor deck will provide an efficient means of drainage as well as a better structural design, and will provide an adequate means for rainwater to drain from this area by flowing off the side into the gutter. You further explain that the new design aligns the edge of the deck ori top of a wall below giving you an efficient means to support the load coming down from the'deck. Based upon the information provided,I have determined your request is de minimus in nature because the front yard setback relief granted will not be affected,the changes do not increase the degree of non-conformity, and;therefore,upholds the intent of the original ZBA decision. We are requesting a larger second story deck to provide an efficient means of drainage as well as a better structural design. By increasing the size of the deck from 4.8'to 9.0'we are bringing the edge of the deck in line with the exterior wall below. By doing this we can provide an adequate means for rainwater to drain from this area by flowing off of the side into the gutter. The smaller deck that was approved would require drain scuppers. Since this space is situated above first floor living space we are concerned that the scuppers will not provide adequate drainage leading to long term water damage of the finished living spaces below. The proposed additions will have conforming setbacks; however the minimum side yard exists at 4.4 feet and will not be changed. Although the lot is non-conforming in size at 12,344 sq. ft. it has a rather large rear yard. 3. Town Law 5267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 56% relief for the minimum side yard setback and 18%for the front yard setback. The combined side yard setback is not substantial representing 3.4% relief. However, the substantialty is mitigated by the fact the footprint will not be changing where the non-conformity exists. 4. Town Law 5267-b(3)(b)(4)\No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 5267-b(3)(b)(5). The difficulty has been self-created.
