MEMORANDUM OF AGREEMENT
The undersigned have entered into an executory contract, dated September 2,
2020 (the "Contract") in which the following information, inter alga, is contained:
PARTIES TO THE CONTRACT:
Judith M. Frederic and Michael A. Levy, both residing at, and jointly in possession,
as tenants-in-common, of premises No. 10 Harvest Pointe Lane, Cutchogue, New
York 11935 (together the "Parties" and individually, a "Party).
DESCRIPTION OF PREMISES (the "Premises"):
Condominium Unit 83 in the premises known as HARVEST POINTE CONDOMINIUM I,
Town of Southold;County of Suffolk, State of New York, said Unit being designated and
described as Unit No. 83 in the declaration establishing a plan for condominium
ownership of said premises under Article 9-B of the Real Property Law of the State of
New York, dated November 7, 2017 and recorded in the Office of the Clerk of Suffolk
County on January 9, 2018 in Liber 12945 Page 279 and on the Map of Harvest Pointe
Condominium I filed on January 9, 2018 as Condominium Map Number 471_._
TOGETHER with an undivided 1.5625 interest in the common elements as defined in the
Declaration.
The land upon which Unit is located is more particularly described as follows:
ALL that certain plot, piece or parcel of land, situate, lying and being at Cutchogue, Town
of Southold, County of Suffolk and State of New York, being more particularly bounded
and described as follows:
BEGINNING at a point, said point being the following three (3) courses from the
intersection of the Northwesterly line of School House Lane also known as Schoolhouse
Road and the Southeast corner of the premises herein described, adjoining land now or
formerly of the Town of Southold on the Southeast;

AGREEMENT RESTRICTING ALIENATION AND GRANTING LIFE ESTATE:
The Contract provides, inter alfa, that neither Party may alienate his/her interest in
the Premises during his/her lifetime without consent of the other, and upon the
demise of either Party or in the event of certain other occurrences more fully
described in the Contract, the surviving/other Party shall, for no consideration, be
entitled to exercise a life estate in the deceased or other Party's undivided interest
as a tenant-in-common in the Premises.
IN WITNESS WHEREOF, the Parties to the Contract have duly executed this
Memorandum of Agreement on September 2, 2020.
