A meeting of the Southold Town Conservation Advisory Council was held Wed., January
13, 2021 via the Zoom Online Platform.

CALL TO ORDER
Chairman Peter Young called the meeting to order at 4:33PM.
CLIMATE SMART COMMUNITIES PROGRAM
Carol has been working with Lloyd Reisenberg on the website and will soon have a draft
for review. The CAC web page will have a link to the Climate Smart Communities. Carol
asked the members to review the draft and provide comments.
Peter Meeker asked if the CAC could apply for a grant. He will share the specifics of the
grant with the CAC members for their review then present to the Town Board for their
approval. Carol Brown has experience in grant writing and willing to assist.

REPORTS
John Stein attended the Board of Trustees meeting held on Mon., December 21, 2020. He
participated in the meeting via Zoom and was given an opportunity to speak on a number
of applications. The Board agreed to his request to increase a buffer on a proposed
project on the Sound.
APPROVAL OF MINUTES
Moved by John Stein, seconded by Carol Brown, to Approve the Minutes of December 9,
2020.
RECOMMENDATIONS -WETLAND PERMIT & COASTAL EROSION PERMIT
APPLICATIONS
Moved by Carol Brown, seconded by John Stein, it was
RESOLVED to SUPPORT the application of DOMELUCA II LLC c/o ISABEL SOUSA,
DOWBUILT to construct a single-family dwelling, driveway and accessory structures.
Existing building to be demolished and proposed pool and enclosure to be submitted
under separate permit application.
Located: 14895 Main Rd., East Marion. SCTM#23-1-2.10

The CAC Supports the application and recommends the applicant consider the installation
of an I/A wastewater treatment system.

Moved by John Stein, seconded by Caroline Burghardt, it was
RESOLVED to SUPPORT the application of JOHN ELENTERIO & JUAN JARAMILLO
for the removal and replacement of 67 If. of existing timber bulkhead with new vinyl
bulkhead in same location as existing and raised height of 8" above existing. Project
includes the removal of existing timber deck landward of bulkhead and installation of 6'
wide stone/gravel walk along the landward side of the bulkhead to act as a non-turf buffer.
In addition, a 90'X 18" tall timber landscape retaining wall will be installed parallel to the
property line landward of the proposed non-turf buffer.

vegetated non-turf buffer.

Moved by John Stein, seconded by Carol Brown, it was
RESOLVED to SUPPORT the application of STUART THORN for the ordinary
maintenance and repairs to the existing platforms and staircase as needed. Remove and
dispose of 8 retaining walls. Construct 8 new retaining walls, inkind/inplace. Construct
new 4' walk on top of the bulkhead leading to new 3'X 5'X 10" stairway from bulkhead to
beach. Install an additional 64 ton rock armor in front of east bulkhead and an additional
144 ton of rock armor in front of west bulkhead.

The CAC Supports the application with retractable stairs at the base and parallel to the
bluff, the bricks around the pool should be pervious, and the lights on the staircase are a
navigation hazard and should be dark skies compliant.

RESOLVED to SUPPORT the application of MICHAEL & ELLEN CARBONE to construct
an 18'X 30' in-ground swimming pool with proposed at grade patio surround, with
proposed pool compliant fence, equipment area and drywell.

The CAC Supports the application consistent with the LWRP and recommends a setback
of 50' in accordance with Ch. 275.

RESOLVED to NOT SUPPORT the application of WILLIAM & JEANNETTE AYERS to
install a 16'X 32' in-ground swimming pool, shed and surrounding fence.

The CAC does Not Support the application and found it be incomplete. The applicant
should be required to submit an updated survey/site plan with all proposed structures.

Moved by John Stein, seconded by Carol Brown, it was
RESOLVED to NOT SUPPORT the application of LAURA SOLINGER to construct 87 If.
of new bulkhead with 15' return, seaward armor protection, and new slope restoration.
Bulkhead and return to be constructed using vinyl sheathing. Approx. 273 cy. of clean fill
to be placed behind the bulkhead and the bluff face. Rock armor to consist of 2'-3' cap
rock (1 to 2 ton), 2' of core stone and filter fabric. Slope restoration area will be graded,
backfilled and restored with a mix of beach grass, Rosa Rugosa, Bayberry, Virginia Rose
and Pitch Pine. Slope stabilization shall incorporate board and stake terracing with
vegetation.

The CAC does Not Support the application because the bluff is a healthy, pristine and
functioning bluff. There is no necessity for a perpendicular hard structure and the area
should remain in its natural state. There was no sign of erosion and the staircase was not
found to be undermined. The CAC requests this area be listed as a sensitive area as
defined in the LWRP.

RESOLVED to SUPPORT the application of LAUREN PRAUS & MARK SCHWARTZ to
reface approx. 265 If. of existing bulkhead, remove 28.5 If and 67 If. of existing bulkhead
in two (2) locations. Construct 34 If. of new vinyl bulkhead in place of removed bulkhead
along easterly side of property. Remove approx. 15 cy. of fill, prepare sub grade slope
from top of bulkhead to shoreline. Place approx. 7 cy. of clean course sand on the sub
base to create extension of beach line from neighboring property. Install two (2) 8" dia.
double set dauphin pilings for anchorage where 67 If. of bulkhead removed. Construct a
4'X 16' fixed dock, install a TX 14' aluminum ramp, 6'X 20' floating dock, with (6) 8" dia.
pilings and one 8" dia. double set dauphin piling.

15' vegetated buffer landward, and removal of the boat slip.

RESOLVED to SUPPORT the application of GLORIA NIXON for the in-place replacement
of dilapidated 57 If. bulkhead, grading of area, installation of coir log, planting of Spartina

alterniflora and Spartina patens, installation of an 8' return on the southerly side of
bulkhead, in-place replacement of existing "L" shaped fixed timber dock consisting of a
3'X 10' fixed dock off of bulkhead to a 4'X 16' fixed dock, using Thru-Flo decking.

RESOLVED to take NO ACTION on the application of NEW SUFFOLK PROPERTIES,
LLC for the existing 120 docks, including catwalks, ramps, access ladders, water and
power, fuel dock, fuel tanks and pumps plus mechanicals, bulkheads, accessory
structures, and tie-off pilings.

The CAC was unable to render a decision based a lack of information and recommends
utilization of best management practices and review under all applicable code
requirements.

RESOLVED to SUPPORT the application of PAT J. IAVARONE for the installation of a
20'X 40' gunite swimming pool with associated pool code fence and drywell 83' behind
existing bulkhead.

The CAC Supports the application with the installation of a drywell for the pool backwash
and questions the legality of the boat lift.

RESOLVED to NOT SUPPORT the application of JANE G. WEILAND to demolish and
remove existing cellar entrance and 60' section of existing 1.5 story dwelling; construct

additions and alterations to existing 1.5 story dwelling, including 415 second-floor dormer
addition, 170 sf. deck in place of portion of existing roofed-over porch, 60 sf. first floor
addition, and 1,044 sf. one and two-story addition to south end of dwelling with attached
377 sf. raised patio and steps, deck, retaining wall, and 6'X9' roofed-over entry porch and
steps with grade-level masonry path; maintain existing hot-tub and outdoor shower on
north side of house; install 500 gallon underground propane tank; underground utilities,
A/C unit on grade-level slab; remove existing septic system and install I/A sanitary
system, and regrade to accommodate new system using 126 cy. excavated on-site soil
and 56 cy. of clean ratable soil to be trucked in. Install stormwater drainage system; install
6' high fencing along southerly property line; and establish 10' wide non-turf buffer
adjacent to top of bluff to be planted with native vegetation.

the top of the bluff.

RESOLVED to SUPPORT the application of ALISON M. BYERS C/O ALISON M. Byers,
PsyD, VP to demolish existing one-story dwelling, 2,254 sf. located 28.6' from top of bluff
and patio located 15' from top of bluff and construct one-story, 4,929 sf. single-family
dwelling, carport and covered decks a min. of 50' from top of bluff; install pervious gravel
driveway and parking area, 5' wide landscape steps to dwelling, 3' high landscape
retaining walls, landscape beds, and 4' wide earthen pathways, including path to existing
bluff stairway; remove existing nonconforming septic system 71' from top of bluff and
install new I/A sanitary system more than 100' from top of bluff; relocate public water
service and install underground electric service; install stormwater drainage system; clear
approx. 5,390 sf. of existing vegetation for new construction and revegetate approx. 8,195
sf. area; truck in approx. 187 cy. clean fill from an approved upland source to achieve
proposed grades; and establish and perpetually maintain a 3,785 sf. non-turf buffer within
15' of top of bluff, and remove existing invasive vegetation/add native vegetation.

Moved by John Stein, seconded by Peter Meeker, it was
RESOLVED to SUPPORT the application of MICHAEL KREGER to Amend Wetland
Permit#9433 to expand the footprint of the proposed pool terrace with relocation of stairs
and addition of new stairs; removal of infinity edge trough from the plan; increase in total
pool area; reconfiguration of pervious driveway; relocation of pool equipment; expansion
of non-disturbance areas.

The CAC Supports the application, however the proposed location of the pool is less than
the required setback as referenced in Ch. 275 Wetlands, consistent with the CAC review
dated May 9, 2018.

Peter Meeker will participate in the next Board of Trustees meeting scheduled for Wed.,
January 20, 2021 via the Zoom Online Platform.
The next meeting of the Conservation Advisory Council will be held on Wed. February 10,
2021 via the Zoom Online Platform.
There being no further business to come before the Council, the meeting was adjourned
at 6:15PM.
