Located: 375 North Parish Drive, Southold. SCTM#: 1000-71-1-4 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. A Wetland Permit was not found for the structures.. Further, the shed is located within the FEMA Flood zone VE (Velocity Hazard) and is not consistent with Policy 4. Structure within these zones should be relocated, or if that is not possible; be minimized. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The fiberglass arbor measures 16.0'x 9.5;overall. The total size is 152.0'sq.ft. The support columns are located 1' inside the overall dimensions,allowing for a 1'overhang. The(4)support columns have code compliant footings,each being 3'deep. In addition,the existing patio was extended,the bluestone patio measures.27.2'x 20.6; With a 5.3'x 32.9'connecter patio. The total coverage of the patio is 836.74 sq.ft. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk_ County Administrative Code Sections A 14-14 to 25and the Suffolk County Department of Planning issued its reply dated January 30, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated June 16, 2020 Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us,it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. However, upon personal inspection of the subject property and the surrounding neighborhood, the Board has determined that, although the as built pergola is located within a FEMA VE flood zone,the side yard location locates it farther away,from the flood zone than the conforming rear yard location and the small open structure has no adverse impact on the environment, therefore, it is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 31,771 square foot parcel located in the Residential R-40 Zoning District. The northerly property line measures 104.35 feet and is adjacent to Southold Bay,the easterly property line measures 302.80 feet,the southerly property line measures 100.00 feet and is adjacent to North Parish Drive, and the westerly property line measures 332.60 feet. The property is improved with a two-story framed residence with two first floor decks and an upper story deck. The "as built" accessory pergola is located on the westerly portion of the property in the side,yard as shown on the survey map prepared by John T.Metzger,P.C,LS,last revised October 30,2019. BASIS OF APPLICATION: Request for Variance from Article 111,�Sections 280-15 and the Building Inspector's November 21, 2019 Notice of Disapproval based on an application for a permit to legalize an"as built" accessory pergola; in other than the code required rear yard; located at: 375 North Parish Drive, (Adj. to Southold Bay) Southold,NY. Page 2,July 16,2020 #7389,Benic SCTM No. 1000-71-1-4 RELIEF REQUESTED: The applicant requests a variance to legalize an"as built" accessory pergola located in the side yard which is not permitted pursuant to Article III Section 280-15, which states, accessory building and structures shall be located in the required rear yard, or in the case of a waterfront parcel, accessory buildings and structures may be located in the front yard, if they meet the fi•ont yard principal setback requirements.. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 9, 2020_at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The residence and the accessory pergola are both accessed via a very long gravel driveway and are not visible from the road. The waterfront subject property is improved with a large dwelling and small outdoor recreational area on the seaward side, which is typical of other dwellings in the neighborhood that also are sited to take advantage of water views. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property has open decks on the second story with little area away from direct sun. The applicant would like to be able to have a shaded area for family diners and entertaining space outside. Although the code does not allow for the structure to be located in the side yard, there is no other part of the property suitable. The rear yard which is adjacent to Southold Bay has little room for the structure and would interfere with the bank on the waterside, and the front yard contains a large driveway,parking area 3. Town Law X267-b(3)N(3). The variance granted herein is mathematically substantial, representing 100% relief from the code.However,since this is waterfront property and the top of the bank is located approximately 10 feet from the protective Rip-Rap wall, and because the home is sited on the property at a sharp angle to the property lines,the placement of a shade structure in a conforming location is very restricted The side yard location is the most suitable for the shade structure/pergola to be located on an existing stone patio. The pergola is open on all sides,the roof consists of open rafters and the structure has a minimal footprint at 154 square feet. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. purchased the parcel after the Zoning Code was in effect and it is,presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to The applicant or at the time of purchase. 6. Town Law §267-b. Grant of or the requested relief is the minimum action necessary to enable the applicant to enjoy the benefit of an "as built" accessory pergola while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
