RESOLVED,-that the Southold Town Board'of Trustees APPROVE the request for a
Transfer of Wetland Permit#5 from Richard E. Reunis to Darcy Gazza, as issued on
August 20, 1973.
Any other activity within 100'.of the`wetland boundary requires a permit from this office.

Homan, Councilman; and -James Rich, Jr. , Councilman.
Mr. Rich read- the notice of -hearing. Affidavits of publica
tion 'were , presente,d signed by C. Whitney Booth of the Long Island ;
Traveler-Mattituck Watchman and Stuart Dorman of the Suffolk Times.
Also presented was the affidavit. of posting on� the Town- Cl erk-I s
bulletin board at the Town Clerk's, Office in Southold signed by
Albert- W. Richmond,, Town Clerk. , There was also presented an
affda.vi't by Frank A. 'Ku'jawski, Jr.,' Chairman of the Conservation
Advisory' Council; - recommending approval.

Mr. Tasker: -It has not ;been decided.' There, is tremendous,
confusion between the authorsties- of• lodal governments to act and
the state and,_the answer -will not, come, until it is decided and
until then -we have to go_along as we have been. ' Do we or the
- state have jurisdiction or- do we have concurrent jurisdiction,
-it 'has - to be decided 'by' 'a- court.
Mrs. Tiedke: How" can it be decided by the court?
`Mr. Tasker: , -We take "the` -p'osition we have exclusive juris-,
diction.
Mrs. Tiedke :' Why?
Mr.,: Tasker::, How else can• we act?
Mrs. Terry: This would hold true' ,in any law?-
Mr. Tasker:- ,- In any such case, 'we _are two jurisdictions.
Mrs® Tiedke: In other words ' -it is up to people 'like us to
know these thing's are •coming 'up' and -notify -,the DEC? How would a
conservation man sittin9; in, his- house know- that this person was "
considering such a move?
Mr.- Dbmare:§t: He can read the legal -notice in the paper.
Mr. Homan: The -proper officials would- give, it, if asked®
Mrs- Demarest-:�- They have been-`asked to- notify'all the towns.' -
that they consider'- they have jurisdiction over but they haven'tt
done it, We spoke to Larkin,,,and -Culvin and told them if they-
wanted- to know, to -make a request- bf--the town.
Mrs. Tiedke : If' the -DEC' wants' to know they have "to read` it
-in` the newspapers
MrDemarest: We say we `have jurisdiction with our Wetlands
Ordinance® 'If it takes. another -p-,ermit' they are going to'"have to
get it:
Mrs,. Tiedke :' Would, the trustee's inform them that they may r "
need another 'permit?
Mr. -Demarest:' The •st,at"e regulates the ba'yana' we -regulate
--the creeks. Just to write a law and claim to does -not automatically

-give .them the right.
-Mrs. Tiedke: -I think- you .better take a court case right now. , .
My ,impression was that, the state asked for concurrent jurisdiction.
Mr. Tasker:- The act is very" confusing as'-t,o whether or not
they purported to have 'exclusive, or concurrent jurisdiction.
-Mrs. Tiedke: Do we say we are not going to act under - the' -
laws`?
Mr. Tasker: We will act under the laws we have enacted until
such -time as- the court says we cannot. '
Mr. , Rich: We are carrying out the ,,dpplication. according to
our law." We are not breaking or enforcing the state law. `. "It is
up to the, applicant to know all the laws.
Mr. 'TAsker: ' Usually, at any governmental "level it is their._
5 responsibility .to enforce the law that they pass. We do not
enforce laws passed by the state where they have exclusive juris
diction; "only penal laws. ;
Mrs. Tiedke: As a matter- of pure courtesy, the board should
"inform him that he, may have -a -problem. I think leaving a citizen,
in limbo is not,'fair. "
Mr." Martocchia-:,,7 . This is .a catwalk. where you are not
destroying- any wetlands and has "been accepted by' the Conservation
Advisory Council.
. Prior to ' the -St"ate Wetlands Act what did you' do
Mrs. Terry:
before?_ , Did, you" need some,.recommendation from the Hoard of
Trustees to -grant this? ; -
Mr. Martocchia: Y&s!. ,
Mrs'. Terry: Have the trustees' indicated -what`their feelings
were on this subject •to you? '
Mrs Martocchia:' ' We have recommendations from them.. ,
,Mrs. Terry: -In approving them, , they are 'resporisible', to
.no one but- themselves,?
Mr-:.iDemarest: It A's outside of their jurisdiction. This _
is actually an added duty. It is an �advisory• from two, advisory
group's'..
Mrs. Tiedke: Is <there a way of mriting in that there will
not be any filling done at -all?
Mr. ` Ma-rtocchia: If .he plans to fill, he has; to apply.-
'Mr. Demare,st: If he � fills he is violating the wetlands
ordinance.
Mr., Homan: -It reads in the application, "no, yards ,excavated
and none -filled".
Mrs. Wacker: From here on -any decisions- that are' made on the
wetlands will not be sent to _the DEG. The decisions will continue -
to 'be made until some time the' `DEC "says' we will take you to, court.
Mr. Martocchia: We will operate the ._same as we are right
now. 'Is there anyone else `who wbuld Tike to speak in' favor-. or
in opposition to this proposition?
_ There being no-one else who, wished to speak, Mr.- Martocchia
declared the hearing closed and indicated that the board would,
make a decision 'in the. near future.;

The Board of Southold Town Trustees recommends
the approval of Wetland Application No. 11 by Richard
E. Reunis, for permission to build an open dock across
the meadow at his property on Beebe Drive, Cutchogue.
This type of open construction has been urged
by the Town Trustees in the past, prior to the passage
of the Wetland Ordinance. It allows for the rise and
fall of tide and will in no way interfere with the
ecology of the area.

INSTRUCTIONS FOR PERMIT
A. This application is to be completely filled in by typewriter or ink and submitted to the Town
Clerk in quadruplicate, accompanied by writter permission from the owner of the property if not
the some as the applicant.
B. Pilot Plan must be drawn to scale on the reverse side of this application showing the location
of property, the names and locations of owners of adjoiriing properties, and a detailed description
of proposed project. (Note: Copies of the Pilot Plan may be made by a copy machine and attached
to the Permit Application.)
C. No operation shall be initiated by the applicant until all permits that are required are issued.
D. A detailed statement of the rehabilitation and proposed condition of the premises after the
work is completed must be given, including a survey if required.
E. If permit is being sought for a more sizeable excavation than the construction of a private
single dock or jetty, then this application must be accompanied by a survey and topographical map
certified by a registered land survey or Professional Engineer. The horizontal control of survey
shall be based upon an approval local coordinate system. The vertical control for elevation and sound-
ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological
Survey datum.
F. A statement must accompany the application describing any known prior operations conducted
on the premises in question and whether any prior licenses or permits have been issued to erect
structures or to dredge or deposit fill on said premises and whether any such permits or licenses
were ever revolted or suspended by a governmental agency.
G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection,
there is a $5.00 fee for each additional inspection.
H. The Town Board upon request of the applicant for a• permit, may waive in whole or in part,
the provisions of Article 11, Section 210, subdivisions (d) and (g) where it finds that nature of the
proposed operations are such. that the requirements of such provisions are not necessary for a
proper consideration of a permit application.
I. Upon approval of this application the Town Clerk will issue a permit to the applicant. Such
permit shall be available for inspection at any time, upon request.
