My ,impression was that, the state asked for concurrent jurisdiction. Mr. Tasker: We will act under the laws we have enacted until such -time as- the court says we cannot. ' Mr. , Rich: We are carrying out the ,,dpplication. according to our law." We are not breaking or enforcing the state law. `. "It is up to the, applicant to know all the laws. Terry: Have the trustees' indicated -what`their feelings were on this subject •to you? ' Mrs Martocchia:' ' We have recommendations from them.. , ,Mrs. Terry: -In approving them, , they are 'resporisible', to .no one but- themselves,? Mr-:.iDemarest: It A's outside of their jurisdiction. This _ is actually an added duty. It is an �advisory• from two, advisory group's'.. Mrs. Tiedke: Is <there a way of mriting in that there will not be any filling done at -all? Mr. ` Ma-rtocchia: If .he plans to fill, he has; to apply.- 'Mr. Demare,st: If he � fills he is violating the wetlands ordinance. Mr., Homan: -It reads in the application, "no, yards ,excavated and none -filled". Mrs. Wacker: From here on -any decisions- that are' made on the wetlands will not be sent to _the DEG. The decisions will continue - to 'be made until some time the' `DEC "says' we will take you to, court. Mr. Martocchia: We will operate the ._same as we are right now. If permit is being sought for a more sizeable excavation than the construction of a private single dock or jetty, then this application must be accompanied by a survey and topographical map certified by a registered land survey or Professional Engineer. The horizontal control of survey shall be based upon an approval local coordinate system. The vertical control for elevation and sound- ings shall be based upon United States Coast and Geodetic Survey and/or United States Geological Survey datum. F. A statement must accompany the application describing any known prior operations conducted on the premises in question and whether any prior licenses or permits have been issued to erect structures or to dredge or deposit fill on said premises and whether any such permits or licenses were ever revolted or suspended by a governmental agency. G. A filing fee of $25.00 shall accompany the application. This filing fee includes one inspection, there is a $5.00 fee for each additional inspection. H.
