Box 1047 Southold, NY 11971 RE: PATRICK & EVA FLANAGAN 325 WELLS ROAD, PECONIC SCTM# 75-6-3.2 Dear Mr. Kimack: The Board of Town Trustees took the following action during its regular meeting held ,on Thursday, March 18, 2021 regarding the above matter: WHEREAS, Michael Kimack, on behalf of PATRICK & EVA FLANAGAN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, original application dated October 20, 2020 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed action be found Inconsistent with the LWRP, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 17, 2021 and March 18, 2021, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the structure, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275-11(C)(2)(b)(1) — "No dock shall be erected or extended if, in the opinion of the Trustees, such structure would adversely affect navigation, fisheries, shell fisheries, scenic quality, habitats or wetland areas, and the structure, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275-12. Standards for issuance of permit. A. Adversely affect the wetlands of the Town, B. Cause damage from erosion, turbidity or siltation; D. adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vegetation or the natural habitat thereof,• WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, adversely affect the wetlands of the Town. RESOLVED that the Board of Trustees DENIES WITHOUT PREJUDICE based on no action the application of PATRICK & EVA FLANAGAN to construct a 4'x80' fixed catwalk with Thru-Flow decking and staircase (320sq:ft.); construct a 4'x20' fixed dock (80sq.ft.) with Thru-Flow decking (400sq.ft. total); and as depicted on the plan submitted by M.A. Kimack, dated November 1,,2020. POSITIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE: WHEREAS, the Southold Town Board of Trustees are familiar with this project having visited the site on February 9, 2021, and having considered the survey of property by Nathan Taft Corwin III Land Surveyor received on October 20, 2020, and having considered the plans for this proposed project submitted by Michael A. Kimack last dated November 1, 2020 at the Trustee's February 11, 2021 work session, and WHEREAS, on February 17, 2021 the Southold Town Board of Trustees declared itself Lead Agency pursuant to S.E.Q.R.A., and WHEREAS, on February 17, 2021 the Southold Town Board of Trustees classified the application as an unlisted action under S.E.Q.R.A., and WHEREAS, in reviewing project plans submitted by Michael A. Kimack last dated November 1, 2020 it has been determined by the Board of Trustees that the proposed dock could have potentially cumulative, significant environmental adverse impacts: Impact on Surface Water Potential moderate adverse impacts to surface water quality could occur as a part of this action. The water depth at the end of the dock is inadequate for most vessels. Moderate adverse impacts could also occur from the repeated scarring of the bottom through the operation of a vessel and increased, repetitive turbidity capable of harming marine life. Impact on Plants and Animals The proposed dock is located within a within a New York State Department of State Significant Fish and Wildlife Habitat Area, New York State Critical Environmental Area and a Peconic Estuary Critical Natural Resource Area. The proposed dock will cause habitat degradation and fragmentation of high quality, vegetated tidal wetlands in these -areas: Impact on Open Space and Recreation The,proposed dock will extend into,public waters and could'result in adverse impacts.to recreational user groups of such waters. Consistency with Community Plans The proposed dock is inconsistent with the-Town of Southold Comprehensive Plan (2020): Chapter 6: Natural Resources & Environment I Water Resources Section; Goal 5. Protect Freshwater and Marine Habitat Objective 5.2 Protect tidal and freshwater wetland habitats. A. Continue to achieve a "no net loss"policy of tidal and freshwater wetlands. Objective 5.4. Promote sustainable use of marine habitats and resources in Southold Town. C. Preserve ecological quality of public lands and waters by reducing the density of future dock structures in Town creeks and/or water bodies through the establishment of common easements and common docks. Access to the dock from the subject parcel is not permissible due to a 50' wide non disturbance buffer created by the Planning Board. Access to public waters from this parcel is restricted to one pedestrian access easement on Lot 3 established in the original Standard Subdivision of John Scott. Access to the proposed dock from the one pedestrian access easement would result in the loss of high quality, vegetated tidal wetlands from traversing to and from the proposed dock location. The proposed dock is inconsistent Policies 6 and 9 of the Town of Southold Local Waterfront Revitalization Program. Consistency with Community Character The proposed dock is located near the headwaters of a creek in an undeveloped coastal landscape historically absent of,dock structures. THEREFORE, according to the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of a Positive Declaration pursuant to SEQRA for the aforementioned project. It appears that the applicant is in potential violation of Planning Board Covenant and Restrictions (L D00012570 P 644) filed in 2008 for the Standard Subdivision of John Scott. The C&R's created a 50' non-disturbance buffer on this lot and a common access on Lot 3 (at the time) for a future dock. Landward of the 50' buffer is a 25' wide "non-turf' buffer with rough mow requirements to preserve the water quality of Richmond Creek. Potential violation includes: 1. Establishing a path through the buffers to access a newly constructed dock (2020 photo). 2. It appears that the dilapidated dock structures that were sitting on the marsh have been replaced with a newer floating dock. The dilapidated docks were sitting on the marsh from 2001 and predate this owner. The new dock will need to be moved prior to April 1. The intent of the Planning Board decision was to limit this subdivision to one common dock. Although the applicant is applying for a dock on this lot, it is not possible to access it. Any alternative access scheme would set an extremely, bad precedent. Another large somewhat related concern in this creek is water quality. As you will see in the third photo below—there is a significant algal bloom showing as a red tint in the upper reaches of this creek. I suspect that this year will be much worse due to increased sanitary loads. Kimack, last revised Nov. 1, 2020, and stamped approved by NYSDEC on Dec. 8, 2020. 4, No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas. 5. Materials Disposed at Upland Site Any demolition debris, excess construction materials, and/or excess excavated materials shall be inlinediately and completely disposed of in an authorized solid waste management facility, These materials shall be suitably stabilized as not to re-enter any water body; wetland or wetland adjacent area. 6. No Disturbance to Vegetated 'Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. 7. Dock, Catwalk Size Dock or catwalk shall not exceed 4 feet in width and shall be a mininium of 4 feet above grade (as incasui ed from ground to bottom of(lock/catwalk decking) over ticlal wetland areas. 10. Wood Preservatives a. Pressure treated wood used for construction of in-water structures must have undergone a treatment process approved (stamped or otherwise marked as certified) by the American Wood Preservative Association. b. Wood treated with Pentachlorophenol (PCP)must not be used in marine or brackish waters. Wood treated with PCP must be aged in the open air for at least three rnontlis prior to in-water use, C. The use of creosote treated wood is prohibited both in the water and upland areas. d. Chroniated Copper Arsenate (CCA) pressure treated wood must be clean and free of CCA surface deposits. Wood with Surface; deposits must be, washed for at least 5 minutes under running water prior to use. The washing must occur greater than 100 feet landward of any regulated wetland and/or water body. (Note "E." below for handling wash water.) e. Any wood debris such as sawdust or wash water must not enter any water body, including wetlands or protected buffer areas. 11. Catwalk Decking- 60% Open Space The catwalk decking shall he constructed of fiberglass grating With a nifflimuin of 00% open space to reduce shading impacts. 12. No Floats This permit does not authorize the installation of floats. 13. Use of Structure The authorized structure is provided for access to the waterway and is not intended for the mooring or launching of vessels. Prop dredging, resulting from motorized vessels intentionally powering in shallow waters, is a regulated activity and is not authorized by this peiu)it. 14. No Dredging or Excavation No dredging, excavating or other alteration of shoreline of- Underwater areas is authorized by this permit, nor shall issuance of this permit be construed to suggest that the Department Will issue a permit for such activities in the future. 15. Incidental Disturbance to Vegetation It is the responsibility of the applicant to remedy any incidental disturbances resulting in damage or removal of wetland vegetation. Upon completion of construction activities, any disturbed areas shall be planted with the appropriate marsh vegetation. Maintain Erosion Controls All erosion control devices shall be maintained in good and functional condition until the project has been completed and the area has been stabilized. 21. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents; lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious rnatcrials associated with the project. 22, State Not Liable for Damage The State of New York shall in no ease be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State [-or the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 23. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in 1he opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of'said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to rcruove or alter the structural work, obstructions, or haiards caused thereby without expense to the Statc, and if, upon the expiralion or revocation of this permit, the struCurc, fill, excavation, or other modification of tlic watercourse hereby authorized shall not be completed, the owners, sha11. without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. It is hereby understood that the 50 foot Non Disturbance/non-fertilization Vegetation buffer area is intended to preserve the existing trees and natural growth. Vegetation within this area shall remain in its natural state in perpetuity. Permitted activities within the buffer are limited to the removal of dead, diseased trees that are hazardous to life or property. Notwithstanding the above, the Non Disturbance/non-fertilization Vegetation buffer area may be supplemented with additional native vegetation subject to review and approval of the Southold Town Planning Board and Southold Town Trustees pursuant to Town Code 275-3 . (9) There shall be no disturbance of any kind (i.e. mowing, clearing, grading) within the 50 foot Non Disturbance/non- fertilization Vegetation buffer area, except as provided herein. This includes, but is not limited to, the prohibition of structures or clearing of any kind, except to establish a 4 foot wide unimproved, natural access path located within the 10 foot pedestrian access easement on Lot 3 . Pursuant to Chapter 275 Wetlands and Shorelines; the access path must be reviewed by the Southold Town Trustees and other jurisdictional agencies. (10) Landward of the 50 foot buffer, shown on the filed map��� h f�� Declarant is permitted to undertake seasonal mowing (farm cut) to control seasonal growth of such noxious plants as briers and poison ivy. As stated in Clause 9 above, this 50 foot buffer is to remain in an "undisturbed buffer" , therefore mowing, clearing or grading is not a permitted activity. (11) The Declarant covenants to retain all marked existing trees on-site to comply with Section 161-44 . Street trees of the Southold Town Code, as indicated by the attached aerial, dated October 29, 2008 and agreed upon by the Declarant and the Southold Town Planning Board. The attached aerial, dated October 29, 2008 (Schedule B) indicates the location of both individual trees and clusters of trees both on the property and along the perimeter of the property on State Route 25 and Wells Road. The trees consist of the following species : Birch, Cherry, Norway Maple, Red Cedar and Red Maple. Clearing of the trees or any action made to cause the death of the mapped trees is prohibited. The Declarant further covenants that once the existing trees naturally expire, they shall be replaced with the same or similar species to comply with the Southold Town Code Section 161 .44 . (12) Prior to issuance of a certificate of occupancy, the respective owners of lot 2 and 3 shall plant their respective portion of a "Planted Cluster" , as shown on the filed map, which is intended to mitigate the visual impacts of the new home along Wells Road. There shall be a 60 foot wide landscaped buffer planted with native vegetation located on lot 1 adjacent to New York State route 25. The buffer shall run north to south along the i + western property line of Lot 1 for a distance of 150 feet in length. (13) Declarant grants the continuing right in perpetuity to the Town of Southold, any of its designated representatives or any owner of property within the subdivision to enforce the conditions and restrictions of the covenants and to take any legal action it deems necessary to enforce the conditions and restrictions of the covenants. These rights of inspection and enforcement shall be binding upon declarant, their heirs, executors, legal representatives, distributees, successors, assigns and transferees. This parcel was created in the Standard Subdivision of John Scott SCTM#1000 75.-6-3 Due to environmental sensitivity of Richmond Creek, the Planning Board required certain protective clauses (8, 9 and 10) filed in a Covenant and Restriction to establish a 50' wide non- disturbance buffer. Protect and restore the quality and function of the Town of Southold ecosystem The upper reach of Richmond Creek has extreme shallow water conditions that could not support a dock structure for mooring and use of vessels that would require one. Note that small manual powered vessels (kayaks and canoes) do not require dock structures for launching and retrieving. The Town of Southold offers numerous public locations and waterfront access points for launching of these types of vessels. w sr ; 1r i r� Representative extreme shallow water conditions of upper reach of Richmond Creek. 6.3 Protect and restore tidal and freshwater wetlands. The proposed action is located within a New York State Critical Environmental Area. At the discretion of the Board of Trustees, any operations proposed in critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of structures, and increasing the width of non-disturbance buffers. The need to construct a dock into an ecologically sensitive New York State Critical Environmental Area with no to highly restricted navigability during tidal regimes is unsupported and inconsistent with this policy. As indicated above the dock is also proposed within a New York State Coastal Fish and Wildlife Habitat Area. When establishing this area, the NYSDOS assesses the ecological significance and publishes an accompanying form. The NYSDOS COASTAL FISH & WILDLIFE HABITAT ASSESSMENT FORM states: "Unrestricted use of motorized vessels including personal watercraft in the protected, shallow waters...tidal creeks can have adverse effects on aquatic vegetation and fish and wildlife populations." There is no to little ability to control the operation of a vessel in this area and repetitive, adverse impacts from the operation of a vessel are expected. There is no to little ability to control what type of vessel is moored at a dock either temporarily or long term. Richmond Creek water quality shows evidence of decline due to anthropogenic influences (see 2020 Google Earth Aerial Photo). The photo shows that algal blooms harmful to shellfish and fish species are occurring in the upper reach of the water body. Docks in this area could alter tidal flow; damage marine species habitat, effect wildlife use and introduce pollutants in low flushing areas capable of further impacting water quality. The NYSDOS COASTAL FISH & WILDLIFE HABITAT ASSESSMENT FORM states: "Any activity that would substantially degrade the water quality of Richmond Creek would adversely affect the biological productivity of this area. All species of fish and wildlife are affected by water pollution, such as chemical contamination (including food chain effects as a result of bioaccumulation), oil spills, sedimentation, excessive turbidity, stormwater runoff, and waste disposal(including boat wastes). Impacts to water quality in the creek should be minimized or eliminated to enhance locally important shellfish and crustacean populations. Barriers to fish migration, whether physical or chemical would have a major impact on the fisheries in Richmond Creek." Due to the high-quality marine wetlands and other habitats of Richmond Creek, moderate, cumulative impacts from the placement of docks in areas with physical conditions that do not support them (extreme shallow water conditions, low flushing conditions, concerning water quality conditions etc.) are expected. Impacts to finfish, shellfish and crustaceans and their habitats are also expected from the construction and use of a dock structure. There is a high probability that commercially valuable shellfish species occur in the proposed location of the dock structure. The NYSDOS COASTAL FISH & WILDLIFE HABITAT ASSESSMENT FORM states: "Richmond Creek is also a productive habitat for finfish, shellfish and crustaceans, including blue claw crabs, clams and scallops. The creek is one of the top two creeks for crabbing in the town and is also important for clamming." The proposal to construct a dock in this location is inconsistent with this policy. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. A net loss in public use of waterways is expected as a result of a dock in/on public waterways. The construction of this proposed, private residential dock structure on public trust lands and/or waters would result in a net loss of public recreational use of such waters. Waterfront access is available to the landowner. Wells Road end provides adequate waterfront access to Richmond Creek for the launch of kayaks and other small vessels (See photo of road end below). The proposal to construct a dock in this location is inconsistent with this policy. Potential cumulative, moderate, adverse environmental impacts (repetitive) to a Significant Coastal Fish and Wildlife Habitat Area, NYSDEC Critical Environmental Area and high value tidal wetlands over short and long duration are expected due to: 1. Adverse impacts to water quality with an increase in turbidity and introduction of pollutants; a. from introduction of materials, expected low flushing rates and inadequate, extreme shallow water depths in the area, and b. from the construction and the repeated suspension of sediments from operation of vessels. 2. Adverse impacts to marine species (finfish, shellfish and crustaceans) and habitats due to inadequate, extreme shallow water depths, construction of the dock and potential repetitive bottom scarring from the operation of a vessel; 3. The interruption of tidal flow from the introduction of structure in the narrow, upper reach of this creek. 4. Impacts to high quality tidal wetlands (low and high marsh) through the construction of the dock and potentially accessing the dock. 5.
