The Board of Directors did not oppose the construction of a dock with a boat lift on non-HOA property and that has not changed. By letter dated June 27, 2023, Mr. Baptiste, on behalf of his clients,requested that my client reconsider its position and advised that litigation would be likely in the event that the Board did not so reconsider. Faced with the threat of costly litigation, this letter will serve to advise that the Board of Directors withdraws the June 20, 2023 letter and neither supports nor opposes the owners' application for the dock construction on the Association's property as submitted. The Board of Directors represents a Not-For-Profit Homeowners Association and believes that its members are better served by using its limited financial resource, protect the environmental integrity of its property rather than pursue costly litigation. Because the application has been postponed for over two years, a new application fee will be due ($250.00), and the new proposed project will have to be re-noticed. At this time, a new LWRP or CAC review may not be required but may be requested by the Trustees upon further review. Also, because the proposed project has changed and there is also a proposed boat lift, a new letter from the underwater land owner(s)will have to be submitted for the record as to whether or not the underwater land owners would allow the newest proposed project as submitted. Both walkway and pier deck are to be 60%minimum open grate to allow light penetration; install electric to the pier. Located: 1295 Island View Lane, Greenport. SCTM# 1000-57-2-16 Conklin Point Creek is a shallow body of water that is somewhat unique because the water is over privately owned land. There are 7 close neighbors with existing docks/piers in the same part of the creek. At the heart of the considerations are the relatively shallow water depths. To minimize the adverse impact, the previous 02/17/21 proposal was for a float with dredging to maintain the boat and float 30" min. above the marine bottom. The current revised proposal, as approved by DEC, is for a fixed pier with boat lift or cradle to maintain the boat 30" min. above the marine bottom. Objective: Due to physical disabilities, access to our boat, which we have kept in front of our bulkhead for over 26 years, has become increasing difficult and dangerous for us to accomplish. Our goal is to make our boat accessible so we can safely continue using it. At the February 17, 2021 Trustee hearing, our proposal for a floating dock was heard.* Per the notes from that hearing the Trustees found the proposed floating dock with dredging to be of negative environmental significance: "...that all potentially significant environmental concerns have been addressed as noted herein:... " Scope: the proposed dock is comparable to docks on neighboring-properties in an area where docks historically are used.for commercial,and recreational purposes. Scope in relation to the riparian rights of shell fishers: The plan allows a.standard fixed catwalk to float design that will not impede access for those seeking shellfish and crustacean in season. Environmental upkeep: The dock design projects a usual lifespan of 30 years with limited pile replacement so as to minimize disturbance of the bottom..." Per Trustee Krupski at the hearing: "...your client has made a pretty good effort to try to figure out how to put a dock in this location that would fit within our code, this seem to be an application I would think would be most appropriate to be heard by the DEC first, and upon submission of a DEC permit, the Trustees would move from there, I mean at the face of it we don't see a tremendous issue but it would make sense I think to go through DEC approval first". DEC did not approve dredging, or therefore a float. For over 26 months we worked with DEC and Jennifer Aspell, (Marine Biologist, Marine Habitat Protection)in particular, to find a plan that would both afford us safe accessible access to our boat and minimize the adverse impact to the wetlands. In those regards, DEC has approved the plans submitted herewith for a fixed pier with boatlift or cradle. Essentially the footprint of this proposal is very similar to that of the one referenced at the 2/17/21 Trustees' hearing. The pier length remains at 20' but its width was reduced from 6' to 5', the minimum needed for accessibility. The access walkway was extended from 20' to 24', in order to reach slightly deeper water, and its width increased to 4' for safer wheelchair/walker access. And,the boatlift or cradle at the end of the fixed pier was added to maintain the boat 30" minimum above the marine bottom. * For your reference, pages (pg. 6-8, and 46 and 47)from the minutes of the February 17, 2021 Trustee hearing, where the proposal for this property were discussed, have been enclosed. Wood Preservatives a. Pressure treated wood used for construction of in-water stvctures must have Undergone a treatment process approved (stamped or otherwise marked as certified) by the American Wood Preservative Association. b. Wood treated with Peltachlorophenol (PCP) must not be used in marine or brackish waters. Wood treated with PCP must be aged in the open air for at least three months prior to in-water use. c. The use of e•cosote treated wood is prohibited both in the water and upland areas. d. Chromated Copper Arsenate(CCA) pressure treated wood must be clean and tree of CCA surface deposits. Wood with sU•face deposits must be washed for at least 5 minutes under running water prior to use. The washing must occur greater than 100 feet landward of any regulated wetland and/or water body. TRUSTEE KRUPSKI:While I believe that, or I can appreciate the fact that your client has made a pretty good effort to try to figure out how to put a dock in this location with that would fit within our code, this seems to be an application I would think would be most appropriate to be heard by the DEC first, and upon submission of a DEC permit, the Trustees would move from there. I mean at the face of it we don't see a tremendous issue, but it would make sense I think for it to go through DEC approval first. TRUSTEE GOLDSMITH: Do they already have a DEC permit to do the dredging? MR. PATANJO: No. The current status is the DEC has it and are currently reviewing it. TRUSTEE GOLDSMITH: That's the issue for us. Originally this didn't have the water depth, so its kind of contingent on the fact that the DEC does allow them to dredge this area.
