That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Herrmann En-Consultants 1319 North Sea Road Southampton, NY� 11968 RE: W12600, ,LLC c/o AMY WESSELL, MANAGER 1650 WEST CREEK AVENUE, CUTCHOGUE SCTM# 1000-110-1-5 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, February 17, 20212regarding'the'ab6ve matter: WHEREAS, En-Consultants on behalf of W12600, LLC c/o AMY WESSELL, MANAGER applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 16, 2020, and, WHEREAS, said application was referred to the Southold Town Conservation,Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations; and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 6.3 and 9.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the proposed location and construction elements of the catwalk sufficiently address the inconsistencies; and WHEREAS, a Public Hearing was held by the Town Trustees with-respect to said application on February 17, 2021 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED;-that-for the mitigating factors and based upon the-Best-Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of-W12600, LLC c/o AMY WESSELL, MANAGER to remove remnants of previously existing dock structure and construct a fixed timber dock structure, consisting of a 4'x8' landward ramp leading to a 4'x122' fixed timber catwalk�with a single handrail constructed with open-grate decking, elevated a minimum of 4 feet above tidal 'marsh, and 4'x8' stairs to grade at its seaward end; and to erect a 7'x14' storage shed; and as shown on the site plan prepared by En-Consultants, dated December 8, 2020 and stamped approved on February 17, 2021. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. The proposed action is located within a New York State Critical Environmental Area and a Peconic Estuary Critical Natural Resource Area. The proposed dock will cause habitat fragmentation of a high-quality, tidal marsh. Alternative access to the waterfront should be required through public access points. Dragging of vessels across the marsh should be prohibited. Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Further, the applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code: (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; A net loss in public use of waterways is expected as a result of the construction of the dock in/on public waterways. Peconic Bay and creek water quality is declining due to anthropogenic influences. Algal blooms that are harmful to shellfish and fish species are occurring more frequently (Figure 1). The water depth of 18" at the end of the dock is inadequate for many vessels. This may set up a future permit request to extend the dock further into the waterbody, segmenting the review process. i Figure 1. High quality tidal marsh [6] Whether the dock will cause habitat fragmentation and loss of significant coastal fish and wildlife habitats; The proposed action is located within a New York State Critical Environmental Area. At the discretion of the Board of Trustees, any operations proposed in critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. Such requirements may include, but are not limited to, denial of certain operations, shortening or reducing the size of structures, and increasing the width of non-disturbance buffers. [7] Whether the dock will result in the destruction of or prevent the growth of vegetated wetlands, seagrasses including ee/grass (Zostera marina) and widgeon grass (Ruppia maritima) or shellfish; The proposed dock will adversely impact high quality, vegetated tidal wetlands. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and The construction method has not been identified. § 275-11 Construction and operation standards requires that all intertidal construction and excavation employ the installation of a silt boom that will retain all suspended sediments within the immediate project area. [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. The answer to this question has not been provided. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The construction of a private residential dock structure in public trust lands and/or waters results in a net loss of public use of such lands and water. The structure would be situated more than 15 feet from the side property line and similar in character and configuration with the neighboring dock structures located along the easterly shoreline of Wickham Creek. Specifically, the property located two to the south of the subject property and 8 of the 11 neighboring properties to the north are improved with dock structures, including several Trustee-permitted fixed dock structures similar to the proposed, such as those located 3 properties to the north(Permit No. 1835, issued in 2012); 8 properties to the north(Permit No. 8311, issued in 2013, amended in 2014); and 9 properties to the north(Permit No. 6453, issued in 2006, amended in 2018). Without such a structure the same location could still be used for access,but watercraft would have to be dragged through the marsh,which together with the associated foot traffic would create the potential damage and loss of wetland vegetation along the shoreline. To provide compliance with the"construction and operation standards" for docks set forth by Section 275-11(C)(2)and consistency with LWRP Policies 5, 6, and 9,the proposed catwalk has been designed with the minimal scope necessary to reach a minimum practicable water depth of 18 inches at mean low tide and would be constructed with open-grate decking and elevated a minimum of 4 feet above the grade of vegetated marsh. Therefore, the project would not adversely impact navigation or other public and recreational use of Wickham Creek, nor would it cause a"fragmentation of ecological communities;"result in the physical loss, degradation, or functional loss of ecological components; or otherwise adversely impact the adjacent vegetated tidal wetlands or surface waters of Wickham Creek. The proposed shed will be set back from wetlands the same distance as the existing dwelling and will have no impacts on the adjacent wetlands or waterway. The structure would be situated more than 15 feet from the side property line and similar in character and configuration with the neighboring dock structures located along the easterly shoreline of Wickham Creek.
