TERMS AND CONDITIONS The Permittee North Fork Haven LLC residing at 8871 Oregon Road, Cutchogue,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This determination is based upon the severity of active erosion and the hardened shoreline to the east. Note that the armored bulkhead would help prevent erosion of the toe of the bluff in this location, however, since the neighboring property to the west does not have a protective structure; during storms, it would erode quicker than the subject parcel. A Narrative Addressing Chapter 275, Chapter 111, and Local Waterfront Revitalization Program Policy No. 4 for NORTH FORK HAVEN, LLC 8871 OREGON ROAD CUTCHOGUE,NY SCTM#1000-83-1-34.1 The subject property is located along a developed stretch of Long Island Sound shoreline running parallel with Oregon Road, Cutchogue, that has been impacted by shoreline recession and increasing bluff erosion during the more frequent and increasingly severe storm events experienced during the past 20 years, including significant storm events Within the last decade such as the Christmas 2010 Blizzard, Super Storm Sandy in October 2012, and four major nor'easter storm events which occurred during the course of a single month in March 2018. As a result,properties in this geologic cell have experienced accelerated and severe erosion of the vegetation and soils on their protective bluffs and the landward recession of those bluffs. In response, owners of the adjacent, developed upland properties have been forced to seek approvals for the construction and reconstruction of shoreline stabilization structures, including the rock revetment on the adjacent easterly property at 8869 Oregon Road Soundview Avenue(authorized in 2002 by NYSDEC Tidal Wetlands Permit 1-4738-02962/00001 and Southold Trustees Permit 5518); the rock revetment located approximately six-tenths of a mile to the east at 2050 Dignan's Road(authorized in 2013 and 2018 by NYSDEC Tidal Wetlands Permit 1- 4738-04257/00001 and Southold Trustees Permits 9254/92540); and the rock revetment located approximately one mile to the east at 14345 Oregon(authorized in 2011 by NYSDEC Tidal Wetlands Permit 1-4738-02918/00003 and Southold Trustees Permits 7506/7506C). Severe bottom-up erosion of the subject bluff is evidenced by a landward receding bluff toe; a steepening bluff face; and the loss of substantial soil material and vegetation in expansive areas of the bluff face ranging from the bluff toe to the uppermost portion of the bluff face. Therefore, the applicant is proposing to remediate this ongoing erosional loss with an erosion control project designed in accordance with the generally accepted eroding bluff stabilization practices recommended by the USDA Natural Resources Conservation Service, which is to simultaneously stabilize the toe and eroding portion of the face of the bluff by implementing a combination of structural "hard"toe stabilization and both structural and"soft" sand renourishment and revegetation of the bluff face. Specifically, a stone revetment is proposed to stabilize the toe of the bluff, which will occur first. Then the most severely, "washed out"portions of the bluff face can be stabilized with terrace walls and renourished with sandy fill material and planted with native vegetation, including beach grass for groundcover and woody plants such as northern bayberry and beach rose. And to additionally limit potential top-down erosion resulting from stormwater runoff, a 10' wide non-turf buffer is proposed adjacent to the bluff crest, which will be planted with native vegetation. Page 1 of 2 a , Pursuant to principles set forth by Section 275-11(B)(1)(b), the proposed stone revetment is proposed in an area suffering from extreme erosion, as described above. Consistent with Section 275-1l(B)(1)(b), Sections 111-10 and 111-15, and Policy 4 of the LWRP, the revetment will be installed with a sloped face along the existing toe of bluff; an angled return will be constructed at the westerly end of the structure; and the easterly end of the structure will extend several feet onto the adjoining easterly property and be tied into the westerly end of the existing revetment on that property(see details above), all to avoid encroachment on the beach surface seaward of the existing bluff and to avoid causing a measurable increase in erosion at the site or adjacent properties or result in any other adverse impacts on adjacent properties or natural coastal processes and resources. Further pursuant to Sections 111-10 and 111-15, the purpose of the proposed structure and integrated erosion control remediation plan as described above is designed specifically to stem the continued denuding and loss of the bluff, the property's natural protective feature; and the design has been engineered in accordance with generally accepted engineering principles and is likely to control long-term bluff erosion at the site through long-term maintenance and its intended ability to withstand inundation,wave impacts, weathering and other effects of storm conditions for a minimum of 30 years. Further consistent with Policy 4 of the LWRP, the hard structure is being proposed only where 1)non-structural, vegetative means alone will not be sufficient at stemming the advanced and ongoing bottom-up bluff erosion at this site; 2) the natural protective feature, i.e., the bluff, cannot be effectively enhanced without effective stabilization at its toe, as evidenced by the recent pattern of severe erosion throughout this geologic cell; 3) a hard structure is the only design consideration that can practicably and effectively provide such toe stabilization; 4)the proposed structure has been limited to the minimal scale necessary to effectively stem the erosional trend and is based on sound engineering practices; 5) vegetative restoration and enhancement is and will remain part of the long- term remediation plan design; and 6)there will be no significant direct or indirect costs incurred by the public as a result of the project. Ultimately, the goal of the project is to stabilize, restore, and enhance the natural protective feature of the property for the purpose of minimizing the loss of structures and natural resources from erosion, which is consistent with the relevant permit standards set forth in Chapters 275 and 111 and with the goals of Policy 4 of the LWRP. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable Narrative Addressing Chapter 275, Chapter 111, and Local Waterfront Revitalization Program Policy No.4 for NORTH FORK HAVEN,LLC 8871 OREGON ROAD CUTCHOGUE,NY SCTM#1000-83-1-34.1 The subject property is located along a developed stretch of Long Island Sound shoreline running parallel with Oregon Road, Cutchogue, that has been impacted by shoreline recession and increasing bluff erosion during the more frequent and increasingly severe storm events experienced during the past 20 years, including significant storm events within the last decade such as the Christmas 2010 Blizzard, Super Storm Sandy in October 2012, and four major nor'easter storm events which occurred during the course of a single month in March 2018. As a result,properties in this geologic cell have experienced accelerated and severe erosion of the vegetation and soils on their protective bluffs and the landward recession of those bluffs. In response, owners of the adjacent, developed upland properties have been forced to seek approvals for the construction and reconstruction of shoreline stabilization structures, including the rock revetment on the adjacent easterly property at 8869 Oregon Road Soundview Avenue (authorized in 2002 by NYSDEC Tidal Wetlands Permit 1-4738-02962/00001 and Southold Trustees Permit 5518); the rock revetment located approximately six-tenths of a mile to the east at 2050 Dignan's Road(authorized in 2013 and 2018 by NYSDEC Tidal Wetlands Permit 1- 4738-04257/00001 and Southold Trustees Permits 9254/9254C); and the rock revetment located approximately one mile to the east at 14345 Oregon(authorized in 2011 by NYSDEC Tidal Wetlands Permit 1-4738-02918/00003 and Southold Trustees Permits 7506/7506C). Severe bottom-up erosion of the subject bluff is evidenced by a landward receding bluff toe; a steepening bluff face; and the loss of substantial soil material and vegetation in expansive areas of the bluff face ranging from the bluff toe to the uppermost portion of the bluff face. Therefore,the applicant is proposing to remediate this ongoing erosional loss with an erosion control project designed in accordance with the generally accepted eroding bluff stabilization practices recommended by the USDA Natural Resources Conservation Service, which is to simultaneously stabilize the toe and eroding portion of the face of the bluff by implementing a combination of structural "hard"toe stabilization and both structural and"soft" sand renourishment and revegetation of the bluff face. Specifically, a stone revetment is proposed to stabilize the toe of the bluff,which will occur first. Then the most severely, "washed out"portions of the bluff face can be stabilized with terrace walls and renourished with sandy fill material and planted with native vegetation, including beach grass for groundcover and woody plants such as northern bayberry and beach rose. And to additionally limit potential top-down erosion resulting from stormwater runoff, a 10' wide non-turf buffer is proposed adjacent to the bluff crest, which will be planted with native vegetation. Page 1 of 2 Pursuant to principles set forth by Section 275-11(B)(1)(b), the proposed stone revetment is proposed in an area suffering from extreme erosion, as described above. Consistent with Section 275-11(B)(1)(b), Sections 111-10 and 111-15, and Policy 4 of the LWRP, the revetment will be installed with a sloped face along the existing toe of bluff; an angled return will be constructed at the westerly end of the structure; and the easterly end of the structure will extend several feet onto the adjoining easterly property and be tied into the westerly end of the existing revetment on that property(see details above), all to avoid encroachment on the beach surface seaward of the existing bluff and to avoid causing a measurable increase in erosion at the site or adjacent properties or result in any other adverse impacts on adjacent properties or natural coastal processes and resources. Further pursuant to Sections 111-10 and 111-15, the purpose of the proposed structure and integrated erosion control remediation plan as described above is designed specifically to stem the continued denuding and loss of the bluff, the property's natural protective feature; and the design has been engineered in accordance with generally accepted engineering principles and is likely to control long-term bluff erosion at the site through long-term maintenance and its intended ability to withstand inundation, wave impacts, weathering and other effects of storm conditions for a minimum of 30 years. Further consistent with Policy 4 of the LWRP, the hard structure is being proposed only where 1)non-structural, vegetative means alone will not be sufficient at stemming the advanced and ongoing bottom-up bluff erosion at this site; 2)the natural protective feature, i.e., the bluff, cannot be effectively enhanced without effective stabilization at its toe, as evidenced by the recent pattern of severe erosion throughout this geologic cell; 3) a hard structure is the only design consideration that can practicably and effectively provide such toe stabilization; 4)the proposed structure has been limited to the minimal scale necessary to effectively stem the erosional trend and is based on sound engineering practices; 5)vegetative restoration and enhancement is and will remain part of the long- term remediation plan design; and 6)there will be no significant direct or indirect costs incurred by the public as a result of the project. Ultimately, the goal of the project is to stabilize, restore, and enhance the natural protective feature of the property for the purpose of minimizing the loss of structures and natural resources from erosion, which is consistent with the relevant permit standards set forth in Chapters 275 and 111 and with the goals of Policy 4 of the LWRP.
