SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject,non-conforming, 15,000 square feet, .34 acre,rectangular parcel located in the R40 Zoning District measures 100 feet along Longview Lane then runs 150 feet northwest along a residentially developed lot, then runs 100 feet along two residentially developed lots to the west;then returns 150 feet southeast along an unimproved residential lot back to the roadway. The subject parcel is developed with a one- story frame dwelling with covered front porch and rear screen porch and open deck along with an attached shed, wood stop and front brick patio on grade and an asphalt driveway as shown on the survey prepared by Kenneth M. Woychuk,Land Surveying,PLLC and dated August 18, 2020. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's October 6, 2020 Notice of Disapproval based on an application for a permit to construct an accessory swimming pool;at 1)more than the code permitted maximum lot coverage of 20%; located at: 1450 Longview Lane, Southold,NY. SCTM No. 1000-88-4-43. RELIEF REQUESTED: The applicant requests a variance to install an inground swimming pool measuring 18 feet by 36 feet in a compliant rear yard location, increasing lot cover from 18.5% to 22.2%, where the code limits lot coverage to a maximum of 20%. ADDITIONAL INFORMATION: Prior to the public hearing an immediate neighbor commented in writing against this application. The neighbor also indicated that the property owner rented the house out(according to the Town Building Department,who issues rental permits,there is no permit pending or issued)and that on multiple occasions loud"partying"continued through the night, early into the morning. Page 2,January 21,2021 #7451,D'Accordo SCTM No. 1000-88-4-43 The subject parcel is covered by the following Certificates of Occupancy: #Z3287 issued September 26, 1968 covering a single-family dwelling #Z4406 issued October 6, 1971 covering a single-family dwelling #Z15052 issued October 29, 1986 covering an addition to a single-family dwelling #Z15987 issued July 23, 1987 covering a deck addition to a single-family dwelling #Z25085 issued June 13, 1997 covering a garage addition to a single-family dwelling #Z37062 issued August 5, 2014 covering an alteration addition to a single-family dwelling The applicant states that as part of the pool installation they will remove the 8.4 feet by 8 feet attached shed from the property and will also remove a rear deck, reducing lot coverage. The applicant proposes to place the required drywell and pool mechanicals on the southside of the residence outside of the gate area along the foundation of the house. On January 19, 2021, the applicant's representative submitted a revised survey dated January 17, 2021, in order to show the proposed swimming pool mechanicals and a drywell. The applicant's pool installer testified at the hearing that a smaller pool to further reduce the lot coverage can be installed.However, it would then be difficult to create a deep `end' as the pool's shallow end includes standard stairs that take up much of the interior slope. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 7,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in,the character of the neighborhood or a detriment to nearby properties. The subject property is located in the Terry Waters subdivision, a bayfront private beach association neighborhood located on Hogs Neck,consisting of approximately 72 pre-existing, non-conforming lots, laid out in a grid, several of which have swimming pools. While most of the houses in the neighborhood were built in the 1960's and 1970's, the majority have been updated in recent years to reflect current needs and taste. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance.Variance relief is necessary to enable the applicant to construct a modest sized pool in the rear yard. The applicant has reduced the size of the pool that was originally planned (18 feet by 44 feet to 18 feet by 36 feet) and they intend to remove the existing `attached' shed and rear deck, thereby reducing lot coverage,so that the relief requested is the minimum necessary to allow enjoyment of an accessory pool. 3. Town Law&267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 11%relief from the code. However,because the pool is a ground level improvement,the visual massing will not be discernable to neighbors or those passing by,versus a structure with more dimension such as an addition to the residence. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of excessive lot coverage, 22.2% where 20% is the maximum permitted in the R40 Page 3,January 21,2021 #7451,D'Accordo SCTM No. 1000-88-4-43 Zone, for an inground swimming pool measuring 18 feet by 36 feet while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Planamento,seconded by Member Lennert,and duly carried, to GRANT the variance as applied for, and as shown on the survey prepared by Kenneth M. Woychuk, Land Surveying,PLLC, and last revised January 17, 2021. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall install and maintain evergreen vegetation to screen the rear yard. 2. Pool mechanicals shall be placed in a sound deadening enclosure. 3. A drywell for pool de-watering shall be installed. 4. All exterior lighting on the subject parcel shall be LEED/Dark Skies compliant pursuant to Chapter 172 of the Southold Town Code. 5. A Town of Southold rental permit is to be obtained prior to any rental occupancy of the subject property, pursuant to Chapter 207 of the Southold Town Code. That the above conditions be written into the Building Inspector's Certificate of Occupancy,when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one(1)year terms. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The subject premises is one of 72 pre-exiting nonconforming lots in the Terry Waters Subdivision with similar dimensions and improvements. A neighboring property two doors down was granted variance relief for an ingrodnd pool in a nonconforming rear yard location (See ZBA File 6811 — Sankovich). Here, the proposed pool will be in a conforming location that is significantly screened from view by"the existing house. As with the neighboring property, the proposed pool will be entirely consistent with the character of this residential neighborhood. 2. The benefit sought by the Applicant CANNOT be achieved by some feasible method for the applicant to pursue other than an area variance, because: Variance relief is necessary to enable the Applicant to construct a modest sized pool in the rear yard. The Applicant has reduced the size-of thd-pool that was originally planned (18x44 to 18x36) and they intend to remove the existing shed and rear deck so that the relief requested is the minimum necessary to allow their family to enjoy a pool. 3. The amount of requested relief is not substantial because: The construction of a pool will result in a 3.7% increase.in the existing for coverage which amounts to a mere 557 square feet however a,2. 2% variance is all that is required from the 20% limit. The Applicant submits that the relief sought is not significant under the circumstances, particularly for a ground level structure. 4. The variance will NOT have an adverse impact on the physical or environmental conditions in the neighborhood or district because: As stated previously, the proposed swimming pool is modest in size for a family pool and will be constructed in a conforming location on the parcel. The proposed construction will also result in the removal of the rear deck and accessory shed. There is no perceivable environmental impact from the proposed construction. As per our conversation, I will be attending the 10:30 AM time slot for Adam D'Accordo #7451 request for variance from Article XXIII. I have two questions/issues to bring to the attention of the board. I live directly behind Mr. Accordo's property at 1450 Longview Lane in Southold at 1435 Bay Haven Lane. He may not be aware that there is an underground aquifer that runs between our properties, and I am not sure how a large pool may impact basement and crawl space flooding if there is heavy rain or a serious storm. In the fourteen years we have lived here, we have had three groundwater floods that have submerged our boiler and/or our burner. Just information to be shared. On another note, and this might need to be addressed offline, but over the summer Mr. Accordo's house has been primarily used as a rental property. Many if not most of his guests enjoyed partying, singing and talking loudly until 3AM. My neighbor across the street from me said she could her them. I wonder if he could ask his guest to take the party inside after 11PM?
