Furse PROPERTY LOCATION: 776 Bell Hill Avenue(Adj.to Hay Harbor),Fisher's Island SCTIVI#1000-9-3-2.2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 13, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated December 21, 2020. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is CONSISTENT with the LWRP policy standards based on the following: I. The proposed structure is located further landward that the existing structure. 2. The proposed structure is not located within the FEMA Flood Zone. 3. The parcel is not located within the CEHA. 4. Mitigated action to further the LWRP polices 4,5, and 6 are proposed. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 41,400 square foot lot in the R- 80 Zoning District. The northerly property line measures in total 305.39 feet (survey closing line), the easterly property line measures 88.82 feet, the southerly property measures 353.76 feet and runs adjacent to a 25 foot right of way to the beach by several of the neighboring homeowners who also use a shared road to reach their properties. The right of way is heavily vegetated and almost impossible for the enclave homeowners to use. Also, the applicant's driveway from the shared road is partially located in the right of way. The westerly property line measures 125.00 feet and is adjacent to Hay Harbor. The parcel is improved with existing one-story framed dwelling with a two-story wing that presently exists but is proposed to be demolished as shown on the survey map prepared by Craig P. Bigger,LS and dated October 22,2020. BASIS OF APPLICATION: Request for Variance from Article XXIII, Sections 280-124 and the Building Inspector's September 28, 2020 Notice of Disapproval based on an application for a permit to construct additions Page 2,January 21,2021 #7450,Furse SCTM No. 1000-9-3-2.2 and alterations to existing single family dwelling; at 1) located less than the code required minimum front yard setback of 50 feet; located at: 776 Bell Hill Avenue (Adj. to Hay Harbor), Fisher's Island, NY. SCTM#1000-9-3- 2.2. RELIEF REQUESTED: The applicant requests a variance to construct additions and alterations to an existing single-family dwelling with a front yard setback of 20 feet where the code requires a minimum of 50 feet. as shown on the Site Plan drawing prepared by Sam Fitzgerald,Architect,PC and dated October 10,2020. ADDITIONAL INFORMATION: On January 7, 2021, the Chief Building Inspector conducted an inspection of the property and reported that no discrepancies were found. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 7, 2020at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposal includes the demolition of an existing two- story wing of the subject dwelling and construction of a new one-story wing that will be essentially in the same location as the existing wing and will not be visible from any adjacent houses in the summer. The property has frontage on Hay Harbor, an inlet off Fisher's Island Sound. The proposed addition will be less visible as seen from the water due to the smaller size and will not increase the non-conformity that presently exists. The new construction will reduce the livable floor area by 532 square feet and will include new decks: 7' x12' (water side); 15.5' x6.5' (landward side). The subject property is isolated from adjacent parcels because the configuration of the lots in this waterside community are oddly shaped with only one common access to the lots through a 25 foot Right of Way off of Bell Hill Avenue, The ROW has several driveways branching off of it to other properties. The applicant's driveway is located partially in the 25 foot Right of Way which is so overgrown with trees and vegetation that it cannot be accessed by either foot traffic or vehicle traffic. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant is proposing to remove a structurally unstable two-story wing of her summer house, and is seeking a variance to replace it with a new one-story addition in essentially the same location and with the same non-conforming front yard setback from the Right of Way. The proposed addition is smaller in height, volume and area than the present existing wing and will also be set back farther from Hay Harbor than the part of the existing dwelling proposed to be demolished. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 60% relief from the code. However, the existing wing to be demolished has a more non-conforming set back from Hay Harbor than the proposed new construction which will be located further landward and is proposed to be attached to the remaining part of the dwelling in essentially the same location and with the same non-conforming front yard setback from the Right Of Way. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 3,January 21,2021 #7450,Furse SCTM No. 1000-9-3-2.2 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created. The present structure of the existing two- story wing is structurally unsound and needs to be rebuilt and requires a variance. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora, seconded by Member Dantes, and duly carried,to GRANT the variance as applied for, and shown on Site Plan and Building Plans prepared by Sam Fitzgerald, Architect PC, labeled pages 3 and 8-12, and dated October 10,2020. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The proposed Open Wood Decks shall remain Open to the Sky. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one(1)year terms.
