FINDINGS, DELIBERATIONS AND DETERMINATI02� OU ®Id 1 vin Clerk MEETING OF JANUARY 21, 2021 ZBA FILE: #7448 NAME OF APPLICANT: Gregory and Eugene Hull PROPERTY LOCATION: 555 Bridge Street, Greenport,NY SCTM No. 1000-34-3-52 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated October 29,2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DE5CRIPTION The subject property is a non-conforming 11,487 square foot parcel located in an R-40 Zoning District. The parcel runs 80.45 feet along the southerly property line fronting Bridge Street; 141.31 feet fronting Sterling Place along the westerly property line, 81.79 feet along the northerly property line and 141.99 feet along the easterly property line. The parcel is improved with a one-and one-half story frame house under construction and a frame shed. All is shown on a survey by John Metzger,L.L.S., last revised October 21,2020. BASIS OF APPLICATION: Request for Variance from Sections 280- 124 and the Building Inspector's October 13, 2020, Amended October-21, 2020 Notice of Disapproval based on an application for a permit to legalize"as=built" alterations to an existing single-family dwelling to include an attached front porch not included in the original permit; at 1) located less than the code required minimum front yard setback of 35 feet; located at 555 Bridge Street, Greenport,NY SCTM No. 1000-34-3-52. RELIEF REQUESTED: The applicant requests a variance to reconstruct an existing covered porch that has a front yard setback of 4.8 feet where town code requires the minimum front yard setback be 35 feet. According to Section 280-104A, where property in the vicinity is improved with principal buildings with front yards of less than what the code requires, the front yard setback shall be the average setback of the existing buildings within 300 feet of the proposed building on the same side of the street in the same use district. The average front yard setback of homes on the north side of Bridge Street, between Bridge Street and Atlantic Avenue, is 8.4 feet. Page 2,January 21,2021 _ #7448, Hull SCTM No. 1000-34-3-52 ADDITIONAL INFORMATION: The applicant received a stop work order for exceeding the scope of building permit#45176. In the Building permit the applicant did not plan on re-building the front covered porch; however, during construction it was determined that the front covered porch was in such poor condition that it could not be saved and had to be demolished and rebuilt in place and in kind. The existing house was built prior to 1900 and therefore pre-dates Town Zoning Codes. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 7, 2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is an older neighborhood which pre-dates zoning with many homes having non-conforming front yard setbacks. The location of the front covered porch with the 4.8-foot front yard setback has existed since the construction of the original house more than 120 years ago. Re-building the front covered porch in place and in kind will not have any change to the character of the neighborhood, and in fact will be maintaining the character of the neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing front covered porch had a non-conforming setback. Any demolition and re-construction in place and in kind will require the benefit of an area variance. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 42.8%relief from the code when calculating variance relief from the average front yard setback.However,the new front covered porch matches the same footprint of the existing front covered porch. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a front covered porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Acampora, and duly carried, to GRANT the variance as applied for, and shown on the Architectural Plan prepared by Joseph Fischetti,P.E., dated October 9, 2020 and survey prepared by John Metzger L.L.S., last revised October 21, 2020. SUBJECT TO THE FOLLOWING CONDITIONS. 1. The front porch shall remain unenclosed and shall remain non-habitable space. Any deviation from the variances)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. This approval shall not be deemed effective until the required conditions have been met.
