Box 962 6155 Cox Lane Cutchogue, NY 11935 Dear Mr. Bunchuck: Re: Town of Southold Local Solid Waste Management Plan Contingent Approvable Letter The New York State Department of Environmental Conservation (Department) has completed review of the Town of Management Plan (LSWMP) received as a final draft on November 28, 2020 for the planning period ending December 2025. provides substantive consideration of the elements set forth in the New York State Environmental Conservation Law (Section 27 Management Plan regulations (6 NYCRR Part 366-2), and that it constitutes an approvable plan. The Department understands that due to restrictions related to COVID-19, the Town was unable to hold a public meeting to present an overview of the draft LSWMPand to receive comments from the residents of the Town. The following items must be submitted for the Department to grant a contingent 1. A complete, stand-alone final LSWMP which contains all revisions to the draft LSWMP resulting from department review. 2. As required by 366-4.1, a certified resolution from the Town of Southold stating: 1) that the LSWMP is adopted by the Town, 2) that the Town will implement and maintain the solid waste management system as described in the final LSWMP and 3) that the Town will submit biennial updates. This certified resolution should be included in the final LSWMP. Final approval of the LSWMP will be contingent upon the Town hosting a public meeting and submitting both a supplemental responsiveness summary and a revised LSWMP addressing any comments received during the public meeting. The supplemental responsiveness summary and the revised LSWMP must be submitted no later than May 1, 2023. The Department will continue to work with the Town through the finalization process.
