Box 1201 Southampton, NY 11969-1201 RE: MICHAEL KREGER 1085 BAY SHORE ROAD, GREENPORT SCTM# 1000-53-3-13 .1 Dear Mr. Schiano: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, January 20, 2021: WHEREAS, Inter-Science Research Associates, Inc., on behalf of MICHAEL KREGER- applied to the Southold Town'Trustees for an_Amendment to Wetland 'Permit#9433-. under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated November 20, 2020, and, WHEREAS, said application was referred to the,Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Inconsistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: providing a net increase in non- disturbance area , and 2 WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare-of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees,APPROVE the Amendment to Wetland Permit#9433 to increase the footprint of proposed,pool terrace and its'stairs by' 275sq.ft. with a setback of 145; the infinity edge trough of the swimming-pool was removed'from the plan; the pool area was decreased from 740sq.ft. to 640sq.ft. but there is also 130sq.ft. of pool coping not previously proposed; the total pool area is 820sq.ft. which is an increase of 80sq.ft. with an increase of wetland,setback from 21' to 23'; the pervious driveways was reconfigured, decreasing its area by 165sq.ft.;,the,pool'- equipment has been moved to outside the Non-Turf Buffer Area; the HVAC equipment area decreased-'from 43sq.ft. to 15s%ft.; the total impervious upland lot coverage of the property, as defined by the NYSDEC increased by 272sq.ft., from 4,311'sq.ft. to 4,583sq.ft.; expand the Non-Disturbance Buffer Area by an additional 125sq.ft., increasing it from 8,860sq.ft. to 8;985sq.ft.; when reviewing the approved permit, note that the expansion that was'proposed as part of Permit No. 9433 had increased the area of revegetation to be;made into Non-Disturbance Buffer Area by 980sq.ft., that increase is not 1,105sq.ft; the area of the Non-Turf Buffer Area will be-increased by 65sq.ft. from 1,200sq.ft, to 1,265sq.ft.; between the Non-Disturbance",Buffer Area`and the Non-Turf Buffer Area, the site will have 10,250sq.ft. of preserved,area, which is more than double the area of impervious upland lot coverage; and as depicted on the site plan prepared by Inter-Science Research Associates Inc., dated October 21, 2020, and stamped approved on January 20, 2021. - Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Date Prepared: November 20, 2020 The applicant seeks to amend Southold Town Trustees Permit No. 9433. The following changes are proposed: 1. Expansion of the footprint of the proposed pool terrace into the footprint of the existing house that was demolished. The stairs leading off the pool terrace have also been moved and additional stairs had to be added. a. The total area of the pool terrace and its stairs increased by 275 sq. ft. b. It will be at a setback of 14.5 feet, where the existing house was at a setback of 13.0 feet, measured to the wetlands flagged by the Southold Town Trustees on March 12, 2019. 2. The infinity edge trough of the swimming pool was removed from the plan. The water area of the pool was reduced. The pool area decreased from 740 sq. ft. to 640 sq. ft., but there is also 130 sq. ft. of pool coping not previously proposed. The total pool area is 820 sq. ft., which is an increase of 80 sq. ft. a. Since the infinity edge of the pool was removed, the wetlands setback of the total pool increased from 21 feet to 23 feet. ' 3. The pervious driveway was reconfigured, decreasing its area by 165 sq. ft. 4. The pool equipment has also be moved so that it is not inside the No-Turf Zone, increasing its wetland setbacks by±28 feet. 5. The HVAC equipment area decreased from 43 sq. ft. to 15 sq. ft. 6. The total impervious Upland Lot Coverage of the property, as defined by the NYSDEC, increased by 272 sq. ft., from 4,311 sq. ft. to 4,583 sq. ft. To help offset the additional structures, the following additional mitigation is offered: 1. The area of the No Disturbance Zone will be expanded by 125 sq. ft., increasing it from 8,860 to 8,985 sq. ft. 2. When reviewing the approved permit, note that the expansion that was proposed as part of Permit No. 9433 had increased the area of revegetation to be made into No Disturbance Zone by 980 sq. ft. That increase is now 1,105 sq. ft. 3. The area of the No Turf Zone will be increased by 65 sq. ft., from 1,200 sq. ft. to 1,265 sq. ft. 4. Between the No Disturbance Zone and the No Turf Zone, the site will have 10,250 sq. ft. of preserved area, which is more than double the area of impervious Upland Lot Coverage. SCTM# 1000-53-3-13.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP due to the following: 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. In 2000 the Board of Trustees issued Wetland Permit 5238 for a similar action. A condition in the permit required a 40' wide non-disturbance buffer adjacent to the tidal wetland line. ti In 2019 a second permit (9433) was issues on the parcel that included revegetation and expansion of the non-disturbance buffer but ultimately reduced the width of the non- disturbance buffer. The purpose of the non-disturbance buffer is to protect the Pipes Cove Creek and Moore's Drain Significant Fish and Wildlife Habitat Area which this parcel abuts. Habitat modifications which substantially change the natural character of the area, such as residential...developments could have a significant impact on many wildlife species in the area. It is recommended that a pool de-watering well is identified. The limit of clearing grading and ground disturbance...line overlaps the 102 sq. ft. revegetation area of the existing non- disturbance buffer. The 28.3' setback to the wetland where 50' is required for the pool and related structures is unsupported in this ecologically sensitive area. The terrace itself has not increased in area (670 sq. ft.) and the wetlands setback remains the same (40 feet). INTERSCIENCE In addition to the above new construction, the existing gravel driveway will be reconfigured, increasing its area from 2,350 sq. ft. to 2,765 sq. ft. (415 sq. ft.), but decreasing its wetland setback from 56 ft. to 58 ft. The existing garage and its attached wood stoop and steps will remain. Stormwater drywells will be installed to capture stormwater runoff from the house and the garage. The existing house does not have drywells to capture runoff; the gutter only water out to the ground surface. Lastly, the owner proposed to expand the existing 5,385 sq. ft. No-Disturbance Buffer, which was added to the property under Town Trustees Wetlands Permit No. 5238, issued October 30, 2000. The expansion will add 2,925 sq. ft. to the buffer, including 1,342 sq. ft. of existing native vegetation and 1,583 sq. ft. of proposed native vegetation, which will be planted to the northwest of the proposed house. If the project is approved, the owner would propose to record a covenant to protect all 8,310 sq. ft. of the new No Disturbance Buffer. POST OFFICE BOX 1201 - 36 NUGENT STREET • SOUTHAMPTON, NEWYORK 1 1969-1 20 1 • 631-283-5958 • FAX:631-283-5974 r The proposed project will include the demolition of the following existing structures: • A±1,850 sq. ft. one-story house, located 28.3 ft. from wetlands; • A±38 sq. ft., brick stoop attached to the south side of the house; • A±439 sq. ft. wood deck located northeast of the house and±36 ft. from wetlands; • A±33 sq. ft. shed with wood steps that is attached to the west side of the existing house, located 33 ft. from wetlands; • A ±83 sq. ft. shed with wood ramp, located west of the existing house, and ±27 ft. from wetlands; • A ±230 sq. ft. brick walkway, located south of the house and ±86 ft. from the wetlands; and • A±10 sq. ft. A/C unit on slab, located 43.5 ft. from wetlands. • Removal of the septic tank located 60 ft. from wetlands. • Removal of the leaching pools located 88 ft. from wetlands. In place of those structures, the owner seeks to construct the following structures: • A 1,895 sq. ft. two-story house (including a portion of the house that will be one-story with a roof deck),to be located 55 ft. from wetlands (an increased setback of 26.7 ft.); • A 740 sq. ft. infinity pool with spa, located northeast of the proposed house, 34 ft. from wetlands. The pool will be located within the footprint of the existing deck and house. • A 670 sq. ft. pool terrace, located northeast of the proposed house, 40 ft. from wetlands. • A 13 sq. ft. outdoor shower attached to the west side of the proposed house, located 50 ft. from wetlands; • Two roofed porches will be attached to the proposed house: one 50 sq. ft. roofed porch on the front southwest side of the house; and one 21 sq. ft. roofed porch on the northwest side of the house. They will be no closer to the wetlands than the proposed house. • Approximately 30 sq. ft. of stairs leading down from the roofed porches to the ground. They will be no closer to the wetlands than the proposed house. • Pool equipment on a 45 sq. ft. concrete slab, 34 ft. from wetlands. • A generator on a 32 sq. ft. concrete slab, 58 ft. from wetlands. • HVAC equipment on a 43 sq. ft. concrete slab, 58 ft. from wetlands. • A pool fence to be located 13.5 ft. from wetlands, which will serve as a visual and physical barrier for anyone mowing the lawn within the fence and prevent removal of vegetation towards the wetlands. • Installation of a septic tank 101 ft. from wetlands. • Installation of leaching pools, which will be 113 ft. from wetlands at their closest point. INTEIZ,-5CIENCE In addition to the above new construction, the existing gravel driveway will be reconfigured, increasing its area from 2,350 sq. ft. to 2,765 sq. ft. (415 sq. ft.), but decreasing its wetland setback from 56 ft. to 58 ft. The existing garage and its attached wood stoop and steps will remain. Stormwater drywells will be installed to capture stormwater runoff from the house and the garage. The existing house does not have drywells to capture runoff; the gutter only water out to the ground surface. Lastly, the owner proposed to expand the existing 5,385 sq. ft. No-Disturbance Buffer, which was added to the property under Town Trustees Wetlands Permit No. 5238, issued October 30, 2000. The expansion will add 2,925 sq. ft. to the buffer, including 1,342 sq. ft. of existing native vegetation and 1,583 sq. ft. of proposed native vegetation, which will be planted to the northwest of the proposed house. If the project is approved, the owner would propose to record a covenant to protect all 8,310 sq. ft. of the new No Disturbance Buffer.
