EXECUTVE SESSION 9:20 A.M. - Board discuss CSEA negotiations with Town Boarcf Negotiator Charles Graves. ~/ORK SESSION 10:10. A.M. - Dr. Eliot Epstein, E&A Environmental Consultants, presented', his analysis of the eight vendors who submitted requests for qualifications with respect to the Town's Solid Waste Management Program. Dr. Epstein recommended that the Town request formal proposals from the following vendors: Reidel (DANO), Waste Processing Corporation (DANO), Reuter, Inc. (Buhler-MIAG), Bedminste~' (Eweson). Councilman Penny requested the inclusion of Fairfield, bringing the~ total to five. After the proposals have been prepared the vendors will be .req~sted~ ~ t~o.make .a presentation to the T.o. wn Board.--Gary Loesch, P.E., Holzmacher, ~, ~v, urrell, P.C., presented H2M s proposal for engineer ng services for the prb~m~ ~ ~ ~-~r'vices of E&A as a major subcontractor to H2M, assisting on vaginas phases of the work. The entire package, which would take the Town to the construction stage, would be on a per diem basis with an upset budget of $145,000. The Board agreed to accept the proposal and placed resolution no. 45 on the agenda 11:00 A.M. - For Discussion Items: (I) Offer of Rene Gendron to donate to the Town a park and-.pla~/gi~Ound parcel, bf._land ink,the subdivision of Vista Bluff. Town Attorney Schondebare will research the legality of accepting this parcel. (2) Receipt Recreation Center Guidelines from Recreation Director Kenneth Reeves. Bdard reviewed and agreed to the guidelines. 11":25 A.M. - Board audited, outstanding vouchers. :11:30 A.M. - Recess for lunch. Most Town Board' members traveled to Orient Point to witness the execution of the contract for the purchase of Orient Point by the County of Suffolk; 2:00 P.M. - Kevin McLaughlin, Attorney for the West Creek Estates Property Owner's Associ-ation, met with the Board to discuss the proposed petition for a WeSt! Creek Estates Road Improvement District. In order that a petition may be circulated,- the maximum cost for the improvements of the roads must be determined. The Board' decide_l;l~that~ the most. practical, measure wOUld be 'to engage 'the' serv~c,e~ ~ of Sidney Bown'e& Son, Engineers, to determine the cost of the improvements, and ~'i!i~ the Bo.~ne fee would be a charge against the-'~istrict when it is formed (see resotutio~ no. 43)." ~ 2:05 P.M..~Executive Admi~istrator-L~ssard, along with Assessor Chairman Watts, Assessor=~Ha~ris, Justice Court Clerk Stulsk-y, met with the Board to review a proposed plan to re'vise',the office spa_ce in the'Town-Hall, pending the construction of an addition. The temporary plan would be to set off two offices for the Assessors in their outer office area, and utilize the t,wo existing Assessor offices for the Justice Court through the construction of an adjoining doorway; relocation of clostes to be included, and the addition of a doorway beside the Assessor's counter/window. The Board also proposes to convert the existing Board Room into the Assistant '~Fown ';~f~orney's Office, and use Justice Price's office for a meeting room. Those present agreed to the alterations on a temporary basis pending the construction of the addition.--A meeting will be held on Wednesday,, January 20th, with the Bowne engineering firm to discuss the proposed addition. JANUARY 19, 1988 11 2:35 P.M. - Frank Bear, Chair~man of the Water Advisory Committee, and i~anner Valerie Scopaz, met with. the Board to review the,Watershed Protection Stuc~,y with the Board r and request its inclusion in the Southold Town Water Resources Manage- ment Program. Board agreed (see resolution no. 46). 2:55 P.M. - board reviewed proposed regular meeting resolutions. There was con- siderable discussion relative to the Town Trustee position held by Councilwoman Larsen. Mrs. Larsen has not resigned her Trustee position, and is not su~-e whether she will, stating she could possibly fill her own vacancy. She stated the Bc~a~-d of Elections is not sure whether Councilwoman and Trustee is a conflict ot~ ~nterest, and she would possibly hold both positions. The property.~s all in order and they're just getting down' to the design stage now, getting a plot diagram to give to the Planning Board and get their acceptance. We're really looking forward on the Island to getting some aff~r~t- able housing ~or the young folks tha~ are now wanting to move to the Island and work over there. ~nd that's it, Frank. Thank you. DEPUTY SUPERVISOR'KUJAWSKI-: Ellen? ~ COUNCILWOMAN LARSEN: i had th~opportunity to attend the Martin Luther K. in~t Memorial Service at the A.M.E. Baptist Church in Greenport this weekend. It was a wonderful revival meeting almost, and ecumenical service in honor o~ Dr. King. Also I ~have set the meeting of the Inland Waterways committee for February 10th. I see llene sitting in the audience. I'm sure that will be' ~f i'nterest to the Trustees. And everything as far as the permit~securing for the dredging seems to be going~a!ong very well. COUNCILWOMAN COCHRAN: Yes. on the 6th I. attended a meetinc~ of th~ 'Green and we had to.chuckle a little bit because actually all the b ~ck you see p~lled up down on th~'~orner isn't our brick. Evidentiall~ when we did the Sell A ~Brick Day w~ had brir~k delivered to the site; whe~the company came out with the bri.ck they tl~6u~ght it was our order again--it happens to belong to Jim G~ay for ~the new complex here, but we're wor~k~g~it oul~with the company. We-might~even end up having a little better deal. ~nd also we accepted the bid for putting in the brickways which will be done as soon as weat~ p~rmits. In addition spent quite a bit of my time this week working on trying to solve the problem here in Town Hall. You know th~it we have a shortage of space. We did come,up with a bandaide solution this morning as far as trying to get some things settled at this point, but we will continue., I hope, to look at long range planning ~and a more permanent solution to our problem. Thank you. DEPU'I~ SUPERVISOR KUJAWSKI: George? JANUARY 19, 1988 13 COUNCILWOMAN COCHRAN: I do haVe one more thing. I would like to say that this noon some of us did go down to Orient. It mas a very nice ceremony where County Executive signed the contract for the purchase of Orient Point, an(~ it was exciting and nicely done. Thank you. DEPUTY SUPERVISOR KUJAWSKI: George? COUNCILMAN PENNY: Yes, on the 6th 1 attend a meeting of the Locai ~¥ate~-front Revitalization Committee addressing the Town Local Waterfront Revitalization. Plan. We've broken the ToWn up into the waterfront, of the areas of the Town, ~17 into nine areas, and they're meeting further to discuss that tonight~ As a matt~' of fact their meeting is concurrent with this meeting right now, so we can't Mend them both. On the 12th I attend a meeting of the Water,Advisory Committee~ which I'm sure the chai~rman~ wiill, report on. On the 16th, which was Saturday, ~ a~tended the Annual Meetin~ of the Nort~h, Fork Animal Welfare LeaE~ue, where they ~ected their president and reviewed '~Ome of their by-laws. And that ~s th~ gro~, that has a contract with the Town and they run the Town Dog Shelter, and riley are doing job'-they had a change of administration, and they're doing an exc~J~ent job down there and they're looking to renew their con~r, act which will be th~ subject of many discussions from now until July. And that's all. Thank you. DEPUTY SUPERVISOR KUJAWSKI: Thank you, George. Ruth? COUNCILWOMAN OLIVA: Yes, on January 6th I also attended the Waterfront Revital- ization Committee that George has reported on. On January 7th I went with the _G. reenport Utility Committee down' to the Department of Health Services to discuss about a demonstration project for the denitrification of wellfielcI No. 63 in G~eenport, which looks very promising. On January 11th ! went to the Lon~ Island ~egional Planning Board with Planner ValerieScopaz and Bob Villa to present our ~ater Recharge Corridor Area as a critical recharge area~for the North Fork. ~e have never been included in Southotd in'that because we do not meet all the c~eria~ but because of Valerie!s excellent presentation the committee did vote to include us in this study, which is very important because~it will tell us really what water we have, what we don't have, and then we will be included perhaps in some funds to acquire some of the property. On January 12th'the Water Advisory Committee met and we have recommended to the Town Board to make our Water Recharge Corridor a Water Overlay District with 10 acre zoning. Much work still has to be ~one on this so that equitable details can be worked out for the property owners, and these could include acquisition~ transfer of development rights, clusting outside' the water area, or purchase of development rights~ but there's still plenty more to be done. On January 14th I traveled to the DEC to speak with Dick Ryan of the Real Property Di~isi0n to see if we co~lcI apply for some EQBA funds also for our Wa~er recharge area, and that looks rather promising. I attended the ZIBA meetinE~ that night. ~ ~ On January 17th I was very privileged to atten~l the memorial service to Dr. Martin Luthe~ King at the A.M.E. Zion Baptist Church in Greenport. It was an ~nspiring and beauti~ful ceremoney. And of course today, I gue. ss the culmination of eight years of work~ to see that Orient Point was finally acquired. It certainly was just a wonderful, wonderful experience. Thank you. DEPUTY SUPERVISOR KUJAWSKI: Thanks, Ruth. For the Supervisor's Report, I guess it's obvious that the Supervisor is still recuperating from a back injury. He did put in a full day today, but was obviously in pain when he left, and really had nothing new to report on that. It's going to take time and' maybe if ~e'cl stay off his feet a l~ttle bit more it might speed up a little bit~, but it's tough to keep him down~ expecially on a day like today with so much going on. For a personal note I was very pleased with what happened today, and I found myself replacing Frank Bear on the Suffolk County Board of Trustees several years ago, and immediately being handed the Suffolk County Legislature's Acquisition Program. The Board of Trustees, as you know, was given the authority to set up the properties and the 'order of priority to be acquired with Mr. Cohalan's Open. Space Program. We rated O~i~it .Point as the number one property to be acquired, but the way things had~ been~going lately it didn't look like it was going to work out. Robins Island~ 'by'the way~ was number two. So one out of two has now fallen into place, in fact quite une×pectedly~ but t~h~t~the way these things happen I've been told, So it was really a historic day toda¥.~ II. PUBLIC NOTICES. DEPUTY SUPERVISOR KUJAWSKI: Regarding the Public Notices , there are two. 1. New York State Department of Environmental Conservation, Notice of Complete Application of Joseph Finora to construct a single family dwelling and associated sanitary system approximately 60 feet from tidal wetlands. A variance of l'~'~t is requested to the. requirecl 75 foot setback from tidal wetlands. Property located on the south side of James Creek on the north side of East Legion Avenue, Mattituck. JANUARY 19, 1988 2. U.S. Army Corps of Engineers, Public Notice, application of Stirling. Cove Condominiums for a a pier assembly extension and installation of piles, piers, floats and wave barriers, Stirling Basin, Greenport. Comments by February 8, 1988. III. COMMUNICATIONS. DEPUTY SUPERVISOR KUJAWSKI: There are several communications. 1. Letter from Our Lady of Ostrabrama Roman Catholic Church thanking the Town for the use of our cherry-picker to repair ~ window i~ the uppermost part of the church. 2. Letter from '.~he Long Island Rail Road advising that electric service from Ronkonkoma on their main line will 'begin on an interim basis on December'28th, with full electric service.to start on J~nuary 18th, and will reduce the travel time of their riders by as much as 30 minutes with direct no change service to Penn Station. 3. Letter from The Coastal Management .Corporation, Rowayton, Connecticut, offerin§ the! services of their firm in the waterfront' development of the proposed launching ramp for the-Mattituck Inlet. IV. PUBLIC HEARINGS. (8:00 P.M. - Acquisition of development rights in the agricultural lands of Joyce P. Terry.) V. RESOLUTIONS. DEPUTY SUPERVISOR KUJAWSK!: I'd like to remind you that if anyone' has any comments regarding the res~)lUtii~ns.that the Board will be acting upon, this would be the opportunity for you to stand up and make your comments known. There will be another opportunity at the end of the meeting when the resolutions are finished. Does anyone have a comment to.make? JUSTICE EDWARDS: I would like to make a comment. On Resolution No. 1, which was presented at the last meeting, and that's sending a.request to the Governor to schedule a special election for ~ vacant Towri,~rl'rustee position. It seems that Councilwoman Larsen proposed to place in her place she. suggested our Deputy Supervisor, and of course could not get the amount of votes to put that into order, and so now she has decided to stay on as a Trustee and as a_ Councilperson. But we're going to continue to pUt this resolution in there and it's~,(~nly fair to t~ Town that we have a board--a five. member board on the Trustees and not until the November election with four, or with Councilwoman Larsen staying on on both jobs as Councilperson and Board of Trustees. Thank you, Frank. DEPUTY SUPERVISOR KUJAWSKI: Does anyone else'have any comments ~egarding any of the resolutions? (No response.) Okay, then I think we could begin. Is there a motion on the first resolution? 1.-Moved by Justice Edwards, seconded by Councilwoman Cochran, it was RESOLVED that. the Town Boardof the Town of Sou. thold hereby sends a request to Governor Marlo. Cuomo to schedule a special electio'n for the vacant :Town Trustee position. 1.-Vote of the Town Board: COUNCILWOMAN LARSEN: No. My feeling is still that the Trustee position does not warrant a special election. Pursuant to Trustee Smith and Trustee Bredemeyer's letter to the Town Board regarding'a special election, in my experience I only ran in General Elections for the Town Board--~or Trustee position. The position was vacant for a year and a half, of which a four member board functioned quite well. I think it would behoove ~he Town Board to ~11 the vacancy to look for a candidate that does not belong--is ~not political. It's obvious that the Board is balanced with the 'three-three vote on this. That Jeff certainly has every right to seek re-election. 1 feel that that can wait until November. ,The Republicans have offere~'~eff. We have offered Frank. We offered Frank in the spirit that he would vote :c_.ertainly on all the applications, but we offered him in the spirit that t~e~Ould' not involve himself in the organizational aspects of~th'e Trustees. In other words, he would--at th~hr=organizational, meeting he would ,not be a part of it. It wasn't to have him as a non-voting member, it was only in a non-political tone that he would not interfer~ with that, in that he wouldn't seek re-election. He is an experienced Trustee- member and it's obvious that the Republican members of the party do not--of the -town Boa~'d do not want to support Frank. I don't feel that we should run another special election.~ The Trustees did run for four months--excuse me--eighteen months with only t~our Trustees. Of that time there was only one particular application that wasn't settled--that was Mr. Silverman. So I~ feel that we could fill the position until the time of the General Election. The Gov'~r has the right to call for a special election, if he calls for a special election so be it. But I still stand that I do not feel that the Trustees are incapable of functioning with a four member board. So my vote-is No. JANUARY 19, 1988 COUNCILMAN PENNY: I'm-~confi~i§C~;!~:~::l~S~:~thj~' poslt~on-open or is it not open? COUNCILWOMAN LARSEN: What do you mean by op.en or not open? COUNCILMAN PENNY: Well, I heard today that the position was not vacated yet. 15 COUNCILWOMAN LARSEN: No. There's a vacancy there. The question is that can 1 fill the Trustee vacancy as a Councilperson? That's all. There's no apparent--- COUNCILMAN PENNY: There is a vacancy? COUNCILWOMAN LARSEN: Yes---I don't know if there is.or .not. Yes--£ don't know, I'm not a la~wyer, I'm not into the iudicial and the lawyer aspects of the whole thing. But in other words as myself as a Town Councilperson there's no apparent conflict of interest, so if the Trustees feel that they want the fifth member so much I am_;~wil[ihg to accept that responsibility and sit as a Trustee until the General Election in November. I would like to see the Town Board fill the vacancy. If they can't fill the vacancy--come to an agreement, all of us, on filling the vacancy, soliciting people who can best fit the position of Trustee, people with a background in wetlands-,-people--that is strictly deals with wetlands, so you're not looking for anything else if someone has some marine background I'm sure there are people out there that could fill it in until November, and then in November at the time of the General Election have a General Election, bu~ I don't see any purpose in calling a special election for it. They can function, quite well. John Bednoski was on tt~e~Board at the time when there were only four people. Al is there now. So was John and Henry, and there was no problem. I sat in~ the audience for a year and a half and they never held up any business. The only thing that was held up was Mr. Silverman. When I came on the Board I supported the Silverman application, but a year later they came in for' an extension on the dredging permit. So even though they had to wait several months~-l'm not sure exactly how many-- for that permit to be decided, even when it was decided/it still wasn't completed. So they can .... COUNCILMAN PENNY: When we get to the point--if we find out that legally you can't fill both spots--- COUNCILWOMAN. LARSEN: Then I can't fill both spots. COUNCILMAN PENNY: Then we can go back to the special election. COUNCILWOMAN LARSEN: Or we can go back to the point where the Town Board can fill the vacancy. There's a history of many times where a vacancy has been filled from people either being on the Trustee Board and were appointed to finish a vacancy on the COuncil position. This is.not unheard of that the Town Board"" has ever filled vacancies. It's even occurred on this Board many times where people were brought from another department and filled a vacancy. I just don't see the point in holding a special election. Perhaps the election will be held in May, when you can just as Well either-fill the vacancy: from the Town Board, Obviously there's not going to be any political: people put in it, because we're not going to agree on it. So if we can find a qualified person to fill the Trustee position, so be it. Why not? And we can do it. COUNCILMAN PENNY: My position is~very clear. I have al~ready told Jeff Goubeaud that I would not appoint him or anybody else for the position. This is not political. I have said that I would support a special election. I would not even vote myself for a Republican for this position, and I think Jeff was shocked when I said that. So this is not partisan, this is a philosophy, and this Board--especially this Board as it-stands, and the Board=that I was on for the last two years, never appointed anybody to anything. It's a philosophy of a board. COUNCILWOM~AN LARSEN: It's your philosophy. COUNCILMAN P.I~NNY: And my philosophy i~;~that I 'don't appoint--- COUNCILWOMAN COCHRAN: Mr:-~hairman. LORNA TUTHILL: They're trying to establish a bed and breakfast, and a business of antiques, gifts and memorabilia. They put advertisements in The'Traveler two weeks, and then stopped--I think nobody came to their open house that they were ad~vertising ~he Saturday after Thanksgiving. We have given the information, copies of the ads, pictures of the house wi~h the products hanging in the yard, and in the windows, to Mr. Lessard. They advertise over the teiephc~ne, i~ you dial the number 765-2900, which is also the number of the house, they will give you a little speil~about what they have for sale and about the bed and breakfast, but nobody in the neighborhood has received any notification of its desire to a variance. COUNCILWOMAN LARSEN: And when did you transmit this information to the Build- ing Department? LORNA TUTHILL: The first of December, as soon as these things came out in the paper. We watched it progress from Halloween-time when they put the wind- socks out in the yard, and then they became Thanksgiving windsocks, and then Christmas windsocks, and then there was a blackboard out in the yard advertising bed and breakfast coming soon. Now, you can'-t miss it because they've got something they call a Christmas schooner in the front yard with a dilapidated Santa Claus and what looks like a pile of trash there.
