I J"I Xx, 101 4 TERMS AND CONDITIONS The Permittee,Alison A Byers, residing at 10075 Nassau Point Road, Cutchogue,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. ADDITIONAL INFORMATION: The existing home, proposed to be demolished is currently located only 28.6 feet from the top of the bluff. The applicant's representative listed various comparable variances granted to neighboring properties which were also included in the application as an addendum: Appeal #7003, December 15, 2015, for 7324 Nassau Point Road, variance granted for the construction of a single family dwelling at 34 feet from the top of the bluff; Appeal No. 7128, March 15, 2018, 9775 Nassau Point Road, variance relief for a swimming pool located 51 feet from the top of the bluff; Appeal No. 7170, June 21, 2018, 9475 Nassau Point Road, variance relief for additions and alterations to a single family dwelling located 45 feet from the top of the bluff. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 5, 2020 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law$267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property is located in an old neighborhood which consists of single-family waterfront homes. The existing home is currently located 28.6 feet from the top of the bluff. The new home is proposed to be located 50 feet from the top of the bluff. Smith Road is a gravel road that is lightly traveled. The proposed house meets the code conforming 50-foot setback from Nassau Point Road and the proposed non-conforming front yard setback from Smith Road will have little impact on the few others properties that share this small,unpaved access road. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is constrained on its east side which requires a 100-foot setback and on the West side by Smith Road. The 100-foot bluff setback nearly reaches the front lot line on the south side of property. It is impossible to locate a dwelling which conforms to both the 100-foot minimum bluff setback and the 50-foot minimum front yard setback. The proposed location of the house balances between the two setbacks by seeking a significant improvement in the bluff setback without overly encroaching upon the adjacent roadway. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for the bluff setback is mathematically substantial, representing 50% relief from the code. The variance granted herein for the front yard setback is mathematically substantial representing 28.6% relief from the code. However,the proposed bluff setback is more conforming than the bluff setback of the existing dwelling to be demolished and the variance for the non-conforming front yard setback allows the applicant to move the home further landward of the existing bluff. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. BYERS 10075 NASSAU POINT ROAD CUTCHOGUE, NY SCTM#1000-119-1-13.0 The project's design features and mitigation measures listed below will mitigate potential project impacts and result in a net improvement to the environmental conditions of the property and adjacent lands, including an increase in the protection and improvement of groundwater and surface water quality and the protection and restoration of the adjacent bluff, shoreline, and tidal wetland ecosystem through increased bluff setbacks; enhanced treatment of septic waste; increased drainage capacity and decreased runoff potential; and enhancement of native vegetation buffer area that both increases protection from bluff erosion and serves as a sink and filter for stormwater runoff and the contaminants potentially contained therein. 1) The existing dwelling located 28 feet from the top of bluff will be replaced with a dwelling located at least 50 feet from the top of bluff, a roughly 78 percent increase in bluff setback; and the existing patio surface located 15 feet from the top of bluff will be permanently removed. 2) The nonconforming septic system, which is located 71 feet from the bluff, will be removed and replaced with a low-nitrogen, UA sanitary system located more than 100 feet from the bluff. Unlike conventional systems that are not designed or equipped to treat nutrients such as nitrogen, UA systems are designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters. 3) A stormwater drainage system consisting of roof gutters, leaders and drywells will be installed to collect and recharge roof runoff and runoff from other developed surfaces, including the driveway, which will also be comprised of a pervious gravel surface. 4) While approximately 5,390 sf of existing vegetative cover situated more than 15 feet from the top of bluff will need to be cleared for the proposed construction, approximately 8,195 sf of the property will be replanted with native vegetation. 5) A 15' wide, approximately 3,685 sf non-turf buffer will be established adjacent to the top of bluff, from which existing invasive vegetation will be removed and existing native vegetation will be supplemented with additional native plantings. 6) A project limiting fence will be installed to contain site disturbance and potential surface runoff during construction. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR ALISON M.BYERS 10075 NASSAU POINT ROAD CUTCHOGUE,NY SCTM#1000-119-1-13.1 POLICIES 5 & 6 Consistent with the goals of Policies 5 and 6 of the Local Waterfront Revitalization Program and Chapter 275, Wetlands, the below plan features will mitigate potential project impacts and result in the protection and improvement of groundwater and surface water quality and the protection and restoration of the adjacent bluff, shoreline, and tidal wetland ecosystem through increased bluff setbacks; enhanced treatment of septic waste; increased drainage capacity and decreased runoff potential; and enhancement of native vegetation buffer area that both increases protection from bluff erosion and serves as a sink and filter for stormwater runoff and the contaminants potentially contained therein. 1) The existing dwelling located 28 feet from the top of bluff will be replaced with a dwelling located at least 50 feet from the top of bluff, a roughly 78 percent increase in bluff setback; and the existing patio surface located 15 feet from the top of bluff will be permanently removed. 2) The nonconforming septic system, which is located 71 feet from the bluff, will be removed and replaced with a low-nitrogen, I/A sanitary system located more than 100 feet from the bluff. Unlike conventional systems that are not designed or equipped to treat nutrients such as nitrogen, I/A systems are designed to significantly reduce nitrogen loading into the groundwater and ultimately surface waters. 3) A stormwater drainage system consisting of roof gutters, leaders and drywells will be installed to collect and recharge roof runoff and runoff from other developed surfaces, including the driveway, which will also be comprised of a pervious gravel surface. 4) While approximately 5,390'sf of existing vegetative cover situated more than 15 feet from the top of bluff will need to be cleared for the proposed construction, approximately 8,195 sf of the property will be replanted with native vegetation. 5) A 15' wide, approximately 3,685 sf non-turf buffer will be established adjacent to the top of bluff, from which existing invasive vegetation will be removed and existing native vegetation will be supplemented with additional native plantings. 6) A project limiting fence will be installed to contain site disturbance and potential surface runoff during construction.
