AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on March 18,2021,and in ee
consideration of application fee in the sum of$250.00 paid by Fabio Pasquale Granato and subject to the Terms
and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the
following:
Wetland Permit to demolish existing 1,337sq.ft dwelling,decks and foundation; demolish existing
8.3'x6.31 storage shed; and demolish existing 24.2'x22.2' two-story garage; construct new one-story wood
frame dwelling with a poured concrete crawlspace foundation,with a total gross area of 2,859.90sq.ft.
X (45.4'x681); new wrap around deck with a total of 2,854.64sq.ft,front stairs of 198.17sq.ft., rear stairs of
136.13sq.ft. and side stairs of 45sq.ft.; new 8'x191 (152sq.ft.)trellis style pergola on rear deck; new 6x6
wood timber planters,3'8" in width outside of the decks to conceal the foundation height as the dwelling
is to be raised up 2'; total dimensions of the house with wrap around deck and planters will be
68'4"x6412.51'and located no closer than 63.21 from the rear yard setback; with the condition to establish
and perpetually maintain a 101 wide non-turf buffer landward of the bulkhead; and as depicted on the
revised site plan prepared by Condon Engineering,P.C.,last dated March 20,2021,and stamped
approved on March 29,2021.

TERMS AND CONDITIONS
The Permittee, Fabio Pasquale Granato,residing at 1725 Nassau Point Road, Cutchogue,New
York as part of the consideration for the issuance of the Permit does understand and prescribe to
the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved,but should circumstances warrant,request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that.may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Mr. McGahan:
The Board of Town Trustees took the following action during its regular meeting held on
Thursday, March 18, 2021 regarding the above matter:
WHEREAS, Jeffrey Patanjo on behalf of FABIO PASQUALE GRANATO applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town.of Southold; application
dated August 7, 2019, and,
WHEREAS,-said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on January 20, 2021 and March 18, 2021, at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of FABIO PASQUALE
GRANATO to demolish existing 1,337sq.ft dwelling, decks and foundation; demolish
existing 8.3x6.3' storage shed; and demolish existing 24.2'x22.2' two-story garage;
construct new one-story wood frame dwelling with a poured concrete crawlspace
foundation, with a total gross area of 2,859.90sq.ft. (45.4'x68'); new wrap around deck
with a total of 2,854.64sq.ft, front stairs of 198.17sq.ft., rear stairs of 136.13sq.ft. and
side stairs of 45sq.ft.; new 8'x19' (152sq.ft.) trellis style pergola on rear deck; new 6x6

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid; if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

The original plan was to demolish the existing 1337 square foot cottage,leaving the existing foundation
and adding on to it.After the Zoning Board of Appeals decision,application#7305,we are now moving
the structure back from the water'by 9'in order to have none of the structure located within the VE
Flood zone and the entire new structure will be located-entirely within the less risky AO Flood zone,
which comprises a majority of the 28,719 square foot lot.The new structure will,now need an entirely
-new foundation.
The existing 8.3'x 6.3 foot storage shed located 7.5'from the property line will be demolished and
removed.The existing 24.2'x 22.2'2 story garage located 8.3'from the property line will be demolished
and removed.Theexisting 1337 square foot house and foundation,and decks will be demolished and
removed.
The proposed new single floor dwelling will have a,poured concrete:crawlspace foundation and wood
frame house,with total gross area of 2,859.90 square feet,new wrap around deck with total,of 2,854.64
square feet,front stairs of 198.17 square feet, rear stairs of 136.13 square feet and side,stairs of 45
square feet.The pergola on the rear deck will be of trellis style and is 8'x 19'or 152 square feet.The
total new construction represents total lot coverage of 9.5%.The total overall dimensions of the
proposed house is 45.4'x 68'.the house will have a wrap around deck and 6x6 wood timber planters,3'-
8"in width outside of the decks to conceal the foundation height,as we.propos6to,raise the house up
2'.The total dimensions of the house with wrap around deck and planters will be 89'-6"x 64'-2.5".
The purpose of the project is to create a year round home with larger bedrooms,living room and
kitchen as well as a utility room to house the mechanical equipment,which is presently located in the

SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated April 15, 2019 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency
review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. The LWRP Coordinator issued a recommendation dated July 30, 2019. Based upon the information
provided on the LWRP Consistency Assessment Form, as well as the records available it is recommended that the
proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the
LWRP. The LWRP report states that a�portion of the proposed structure is located in a FEMA VE flood zone and a
portion of the proposed structure is in a FEMA AO flood zone. The majority of the property is located in an AO
flood zone therefore the structure can be moved out of the VE flood zone but cannot be moved out of the AO flood
zone. The LWRP report also recommends installing an Advanced IA/OWTS septic system to mitigate
environmental impacts. Moving the proposed structure out of the VE flood zone and installing an IA/OWTS septic
system will make the proposed structure CONSISTENT to the LWRP.
PROPERTY FACTS/DESCRIPTION: The parcel is a non-conforming 28,719 square foot parcel located in an R-
40 zone. The parcel has 117.58 feet of bulkhead frontage along Hog Neck Bay (AKA Little Peconic Bay). The
parcel runs 103.15 feet along Nassau Point Road, 318.98 feet on the South side and 271.90 feet on the North side.
The parcel is improved with a one-story frame house, a 2-story frame garage, and a frame shed. All is shown on a
survey prepared by Nathan Taft Corwin LLS dated July 13,2016.
BASIS OF APPLICATION: Request for Variance(s) from Sections 280-124 and the building inspector's March
22, 2019 Notice of Disapproval based on an application to demolish an existing dwelling and construct a new
single family dwelling at, 1) located less than the code required minimum rear yard setback of 50 feet; located at
1725 Nassau Point Road,(Adj.to Hog Neck Bay),Cutchogue,NY SCTM No. 1000-113-6-13.

RELIEF REQUESTED: The applicant requests a variance to construct a new single-family dwelling and an
attached wood deck and steps at a non-conforming setback of+/- 40.5 feet from the rear yard property line. (The
site plan depicts the proposed setback at 40 feet, 8 inches). The required rear yard setback is 50 feet.
ADDITIONAL INFORMATION: Part of the proposed structure is located in a VE flood zone and part of the
proposed structure is located in an AO flood zone. The existing dwelling is located+/-40.5 feet from the rear yard
line.There is a two-car garage on the property which the applicant proposes to demolish.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on August 1,2019 at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property
and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law §267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties The neighborhood consists of single family water front homes.
The majority of the homes in the neighborhood are not located in a high velocity flood zone. To the north of the
subject property is a public beach. The dwelling immediately to the south of the subject property has a much
greater setback from the high water mark and the rear yard than the proposed new subject dwelling; and the
applicant's agent did not submit evidence or examples of prior variances for non-conforming rear yard setbacks
along Nassau Point Road that would address the non-conforming character of the neighborhood. The granting of
alternative relief will make the proposed dwelling more conforming to code.and more conforming to the character
of the neighborhood than granting the relief as requested.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The applicant could propose the new dwelling with a code
conforming rear yard setback. However, the existing dwelling has a non-conforming rear yard setback and the
applicant's agent proposes to raise and re-use the existing foundation for the new dwelling. The alternative relief
granted is more conforming to code than the existing dwelling and a portion of the as built foundation can still be
used for the new construction.
3. Town Law §267-b(3Nb)(3). The variance for alternative relief for a rear yard setback of 49 feet from the rear
yard property line granted herein is not mathematically substantial, representing 2%relief from the code. The
majority of the property is located in an AO flood zone and any structure on the property will be located in an AO
flood zone. However, the alternative relief for a 49 foot rear yard setback will take the proposed dwelling with
deck out of the VE flood zone and place the structure in a less risky AO flood zone.
4 Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install an Advanced
IA OWTS septic system as approved by Suffolk County Department of Health.
5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel and
designed the proposed new dwelling after the Zoning Code was in effect and it is presumed that the applicant had
actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to
or at the time of purchase.
6. Town Law §267-b. Grant of alternative relief for a setback of 49 feet from the rear yard property line,is the
minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling with deck

while preserving and protecting the character of the neighborhood and the health, safety and welfare of the
community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Lehnert, and duly
carried, to
DENY as applied for and GRANT ALTERNATIVE RELIEF as follows: The granting of alternative relief
for the setback of the single family dwelling and attached wood deck at 49 feet from the rear yard property line.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. The proposed rear yard wood deck shall remain uncovered and unenclosed.
2. The existing 8.3 ft. by 6.3 ft.shed located near the northerly property line shall be removed.
3. The applicant shall submit a site plan/ survey stamped by a design professional showing the
proposed dwelling with deck located 49 feet from the rear yard property line.
4. No part of the proposed structure may be located in a VE flood zone.
5. The applicant shall install an Advanced W OWTS septic system as approved by the Suffolk County
Department of Health.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued
Before applyingfor a building permit,the applicant or agent must submit to the Board of Appeals for approval and
filing, two sets of the final site plan indicating the setback that conforms to the alternative relief granted herein.
The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this
procedure may result in the delay or denial of a building permit, and may require a new application and public
hearing before the Zoning Board of Appeals.' In the event that this is an approval subject to conditions, the
approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply
therewith will render this approval null and void.
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the
Board of Appeals shall become null and void where a Certificate of Occupancy has not been
procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three
(3) years from the date such variance was granted. The Board of Appeals may, upon written
request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one
(1) year terms.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the
LWRP based on the following:
1. On August 15, 2019 the Zoning Board of Appeals granted alternative relief for this
action requiring that the proposed structure be located outside of the FEMA VE flood
zone and the installation of the I/A OWTS.
2. There is no ability to relocate the proposed structure outside of the FEMA AO flood
zone; an area that may experience flood depths of 1 to 3 feet (Figure 1).

A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated. as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
