Dear Mr. Ivans:
The Southold Town Board ofTT�ustees reviewed your letter received in this office on
November 2, 2020 and the survey prepared by Peconic Surveyors, P.C., last dated
October 1, 2020, and the mapping and Aerials prepared by Suffolk Environmental
Consulting, Inc., received on November 2, 2020 and determined that the proposed
construction of two (2) porches; second story balcony; deck/terrace; removal of existing
concrete walk and asphalt driveway and replacement with pervious oyster shell
driveway are out of the Wetland jurisdiction under Chapter 275 of the Town Wetland
Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands"Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required.
Please be advised, however, that no clearing, no removal of vegetation, no cut or
fill of land or removal of sod, no construction, sedimentation, or disturbance of
any kind may take place within 100' landward from the top of the bluff, or seaward
of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the
coastal erosion hazard area as indicated above, without further application to,
and written authorization from, the Southold_Town Board of Trustees pursuant to
Chapter 275 and/or Chapter 111 of the Town Code.

It is your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result
from your project. Such precautions may include maintaining adequate work area
between the tidal wetland jurisdictional boundary and the coastal erosion hazard area
and your project or erecting a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

This Firm represents the owner of the above referenced property, who is seeking all
required regulatory approval to further improve thereon.
In that the proposed activities are located substantially more than 200' from the tidal
wetlands boundary(i.e.,AHW)to the south along Orient Harbor,as well as being located
across an established road (i.e., Skippers Lane / Harbor River Road), a Letter Of Non-
Jurisdiction is hereby requested from your office.
The proposed activities include the following:
(1) Construction of two (2) Porches (628 square feet);
(2) Construction of a 2nd-Story Balcony (112 square feet-above easterly proposed
porch);
(3) Construction of a Deck/Terrace (250 square feet);
(4) Removal of the existing Concrete Walk (connecting dwelling to Skippers
Lane);
(5) Removal of the existing Asphalt Driveway, and replacement with pervious
Oyster Shell Driveway.

(1) Survey of subject property, prepared by PECONIC SURVEYORS, P.C., last
dated October 1, 2020,indicating all existing vs. proposed structures;
