Moore, Esq. 51020 Main Road, Southold, NY 11971 RE: PATRICIA &WILLIAM MOORE 850 RUCH LANE, SOUTHOLD SCTM#: 1000-52-2-30 Dear Ms. Moore: The Southold Town Board of Trustees reviewed the survey prepared by Peconic Surveyors, P.C., last dated September 8, 2014 and determined that the proposed 14' x 14' pergola over the existing 14' x 19' deck are out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no clearing, no removal of vegetation, no cut or fill of land or removal of sod, no construction, sedimentation, or disturbance of any kind may take place within 100' landward from the top of the bluff, or seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without further application to, and written authorization from, the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area - between-the-tidal-wetland jurisdictional_baundary and the cQaslal erosionhazard area and your project or erecting a temporary fence, barrier, or hay bale berm. 2 This determination is not a determination from any other agency. Box 1179 Southold, NY 11971 SEP 2 2 2020 Re: Moore Proposed Pergola Dear Trustee President Goldsmith, Bill and I are resurfacing our existing deck (repairs to permitted structure) and adding a 14'x 14' pergola over part of the existing deck. Our building permit is being held up awaiting a determination if a Trustees permit is required. I do not believe a wetland permit is required. In our case, we are making a small open structure over an existing "permitted" structure (deck). The Code States in "Exceptions to wetland permit":275-4(D Installation of new or replacement windows, roof shingles, solar panels, siding or doors on existing upland structures and second-story additions that are made within the footprint of an existing upland structure. I am proposing to add a @14'x 14'pergola over the existing deck (14' x 19 deck). If I am allowed to build a 2nd story then I am allowed to add a trellis/pergola to the existing "permitted" deck. The existing "structure" is a defined term: STRUCTURE Any object constructed, installed or placed in, on or under land or water, including but not limited to a building; permanent shed; deck; in-ground and above ground pool; garage; mobile home; road; public service distribution, i y transmission or collection system; tank; dock; pier; wharf; groin;jetty; seawall; bulkhead; breakwater; revetment; artificial beach nourishment; boat rack; trellis; arbor; gazebo; walkway; statue; sculpture; stairs; or any addition to or alteration of the same. The codified "exceptions" make sense because there is no more disturbance to the land then the area already disturbed by an existing structure which was issued a wetland permit. An addition over an existing structure causes no impact on the wetlands and have no environmental impact. I am filing this application with my check for $100 to avoid delay of my building permit.
