Box 179 , East Marion, NY,,11939 RE:. 320 LAKOIEW TERRACE, EAST MARION SCTM##: 1000=31-9=13 - Bear-Mr:-Be _ The Southold Town Board--&Trustees reviewed the site'plan based-on-survey by John_ Metzger, received.on December 1', 2020 and determined that the proposed,abandohing of pre-existing cesspool by pumping and hand filling with sand in established lawn=area is deemed as maintenance, and the installation of,the new sanitarysystem on the captioned property is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion`Hazard Area (Chapter 111),no permit is required. Please be advised, however, that no clearing, no removal of vegetation, no cut or fill of land or removal of sod, no construction, sedimentation, or disturbance of any kind may take place within 100' landward from the top of the bluff, or seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without further application to, and written authorization from, the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area 2 between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. This determination is not a determination from any other agency. If you have any further questions, please do not hesitate to call. Marion NY To Whom.It May Concern: We are requesting a letter of non-jurisdiction for 320 Lakeview Terrace, East Marion for an emergency cesspool installation. The cesspool we are abandoning is located within the boards jurisdiction at the rear of the house/lakeside and the new Low Nitrogen system will be getting installed outside of the Boards jurisdiction towards the front/street side of the home. The contractor has advised that no heavy machinery can be utilized to perform the abandoning of cesspool. The existing system,which is located within your jurisdiction,will be properly pumped and abandoned per SCDHS,by hand day of the install.The new septic system will be located outside your jurisdiction at 115' from the lake. Please review the attached and send letter at your soonest convenience. In addition all equipment that will be utilized to install the new low nitrogen septic will access the property from the front and landscaping will be removed to accommodate this. We have enclosed a check for$50.00 along with a survey indicating where old system is located and where the new system is to be installed. Flags have marked the locations of the old cesspool and the new septic. In addition the current cesspool cover is visible.
