9:15 A.M. Board of Appeals Chairman Gerard Goehringer, and member James
Dinizio met with the Board. Mr. Goehringer asked the Town Board to appoint
O~een Ferwerda as a provisiona~ Clerk Typist (see resolution no. 37) for his office.
He said they have had to cance~ several meetings their next one will be in
September. He also advised the Board that Linda Kowalski, Stenographer for the
Board of Appeals, has had a desk audit by Civi! Service.
EXECUTIVE SESSION
9:30 A.M. On motion of Councilwoman Cochran, seconded by Councilwoman Oliva,
Vote of the Board: All Ayes - the Town Board moved into Executive Session with Mr.
Goehringer and Mr. Dinizio to discuss the Matt-A-Mar law suit, other ZBA decisions,
and personnel .---While still in Executive Session Town Attorney Schondebare
discussed the North Fork Environmental Council, et al Article 78, and the
Article 78 in opposition to the Carr/Wanat change of zone.
10:20 P.M. - Greenport Village Trustee Gall Horton and Village Community Director
William Gillool¥ met with the Board to discuss: (1) Reimbursement to Peconic
Contracting, Inc. for tipping .fees charged for a .job he was doing on behalf of the
Village. Th~ Boa~'d agreed to the reimbursement (see resolution no.-36) provided
the Town Clerk is provided with receipts to substantiate the charges:---Mrs. Horton
and Mr. Gillooly also Baymen's Dock constructed by the Village on town property
off of Beach Road, on Sterling Creek, Greenport. They asked the Board to
designate a committee to work with the Village to establish rules and regulations for
use of the docking facility. The Town Board designated Community Development
Administrator James McMahon and Senior Bay Constable Donald Dzenkowski.
10:45 A.M. - For Discussion Items: (1) Request from the North Fork Animal Welfare
League, Inc. to open an East End Exchange, Inc. of Southold, a joint venture
between the Town and the League, for a merchandise consignment business designed
to provide revenue for the Animal Shelter. The Town Board does not feel they
should become involved in such a venture. (2) Request of Joseph and Eileen
Santora to extend their temporary trailer permit, used as a construction facility for
their new home, to December 28, 1989 (see resolution no. 37). (3a.b.c.) Creation
of a Board of Trustees for the Town Employees Health Plan, appointment of five
Trustees, and authorization for the Supervisor to execute an agreement with the
Trustees (see resolution no. 38a.b.c.). (4) Letter from Frederick Tedeschi,
at]torney for Wayde and C~ulia Manwaring,. requesting a Quitclaim Deed to the
approximately 25 ft. abandoned by the Town at Seventh Street, Greenport. Town
Attorney will research and advise the Board. (5) Approval of the transfer of the
Times Mirror Cable Television System to Cablevision Systems Corporation (see
resolution no. 39).
11:00 A.M. - Robert L. Arner, Recycling Manager of the East End Rec¥clin9
Association met with the Board to introduce himself. He has been involved in source
separation and recycling for the past ten years. He complimented the Town Board
on the permanent STOP building and for taking the leadership role in composting.
He is currently formulating a recycling program containing goals and incentives for
resident particpation.

A Regular Meeting of the Southold Town Board was held on August 15, 1989,
at the Southold Town Hall, Main Road, Southold, New York, Supervisor Murphy
opened the meeting at 3:00 P.M., with the Pledge of Allegiance to the Flag.

the audit of the bills of August 15, 1989.

SUPERVISOR MURPHY: At this time, I'd like the Councilman if they have anything
special to report starting on my right with Councilwoman Ruth Oliva.
COUNCILWOMAN OLIVA:
Water Authority: They have aerial photos of the Laurel Lake area, and well data
from the Suffolk County. Department of Health Services, and they will get, also,
results from the Department of Health Services for the other test wells all over
town. They gave us a detailed description of what they've had to do up in Captian
Kidd to improve their water quality, and it's costing them $2,200.00 per customer,
although the cost will be spread over Countywide, so they really have had to
put a lot of money into that. They're going to look at different hazardous waste
sites, and review all the permits. They're going to review the GEIS for the
Laurel Lake area and look at the rest of our watershed area, and for Planning
Board, and we'll work with the Planning Board. So we had a very good meeting
with them. They're really doing a good job. We had a Open Space Committee
on August 3rd, and we discussed various properties that are in the works with
that. On August 9th, we had a very lovely trip to Fishers Island, and I want
to thank the Fishers Island people for their hospitality. It was a well attended
meeting, and I enjoyed it. There were a great many questions, and hopefully
we were able to answer them adequately. On August 10th, we had a Housing
Committee meeting., which the Chairman will report on, and August 11th, we had
Landfill Committee meeting, and that's it. Thank you, Frank.
On August 2nd, we had a meeting with the Suffolk County
SUPERVISOR MURPHY: Thank you, Ruth. Jean?
COUNCILWOMAN COCHRAN: Yes, indeed. On Wednesday August 7th, I met with
the Mattituck Park District, and a officer of the Captain Kidd Association, I guess
is what it's called, in relation to some of the problems that are taking place up
at the Inlet in Mattituck. On Thursday, August 3rd, Supervisor Murphy and
I as part of the Medical Management Team met with the CSEA, those members that
are on the management committee and discussed concerns that were mutual to both
of us. On the 7th, I sat in on the, I will call it more an orientation than an inter-
view, of the Trustees for our medical program, and there is a resolution on today
that will be appointing those people. On the 9th, I, also, took the trip to Fishers
Island, which was enjoyable as always, and I, also, thank the Fishers Island people
for their hospitality. I think it worked out very well. This is the first year
we had the meeting at the Legion Hall, and it was filled to capacity, but it was
a nice setting for the meeting. August 10th, we did a Housing meeting. We only
met for about an hour and fifteen minutes, but we deal~---~T~h some of the problems
that we were facing in relation to the thirteen lots that are being used for the
affordable housing program with the Housing Alliance in Greenport. We will be
meeting again, this next coming week, I believe it is, to finalize, hopefully, the
work that we're trying to do in relation to our Affordable Housing Ordinance. On
the 11th, I attended the Landfill meeting in the morning, and then met with the
Town Board half of the Medical Management to discuss along with Kaplan, and
John Cushman, to discuss some of the recommendations or requests that the Union
members of the meeting felt were important to their needs. On the 14th, which
was yesterday, ! did attend the meeting in Hauppauge for the Farmland Preservation

Commission in re!ation to the purchase of Baxter Farm, and I think that's about
it, Frank.

SUPERVISOR MURPHY: Just for the official record, I'd like to thank the people
on Fishers Island for their hospitality, and for their interest in Town government.
They are certainly one of the most viable and interesting group of people concerning
their properties and their future.
II. PUBLIC NOTICES.
SUPERVISOR MURPHY: Moving on to the second item on your agenda, is public

V. RESOLUTIONS.
SUPERVISOR MURPHY: Moving on to item five, resolutions. At this time, I'd
like to remind anyone in the audience if you'd like to address the Town Board
on any proposed resolution, you may do so now. .We will allow time after to comment
to the Town Board on any other item. So at this time, anyone like to address
the Town Board? (No response.) Hearing none, we'll move to the first one,
which is to 9rant permission to attend a Dru9 Enforcement Seminar.
1.-Moved by Councilwoman Oliva, seconded by Councilwoman Cochran, it was
RESOLVED that the Town Board of the Town of Southold hereby grants permission
to Police Office Joseph Conway, Jr. to attend a Drug Enforcement Seminar from
September 11 through 22, 1989, at the Firematic Training Center, Yaphank, N.ew
York and the use of a police vehicle to travel, and the necessary expense for
lunch shall be a legal charge against the Police Department 1989 Budget.

RESOLVED that the Town Board of the Town of Southold hereby authorizes the
purchase of one (1) 1989 Chevrolet 4-door sedan Police Vehicle from Warnock Fleet,
Hanover, New Jersey (NYS Contract #5593, group 40400), to replace the Sergeant's
Patrol Vehicle, at a cost of $14,410.00.

RESOLVED that the Town Board of the Town of Southold hereby authorizes the

Fund for the payment of the previously disputed/recently paid billing of Szepatowski

This resolution was declared duly ADOPTED.
SUPERVISOR MURPHY: Number 8 is a determination of non-significance.
8.-Moved by Councilwoman Oliva, seconded by Councilwoman Cochran, it was
RESOLVED that pursuant to Article 8 of the Environmental Conservation Law,
Stae Environmental Quality Review Act, and 6NYCRR Part 617. Section 617.10,
and Chapter 44 of the Code of the Town of Southold, notice i~ hereby given that
the Southold Town Board, in conducting an uncoordinated review of this unlisted
action, has determined that there will be no sicjnificant effect on the environment.
Description of Action: Amendment of the Vehicle and Traffic Law to desicjnate
a nu parkincj zone at the end of Luther's Road and a no stoppinc~] zone at the
landfill entrance. This project has been determined not to have a significant effect
on the environment because an Environmental Assessment Form has been submitted
and reviewed and the Town Board has concluded that nO significant effect to the
environment is likely to occur should the project be implemented as planned.

WHEREAS, there has been presented to the Town Board of the Town of Southold
a proposed Local Law entitled, "A Local Law in Relation to Vehicles and Traffic"
now therefore, be it '

RESOLVED that the Town Board hereby sets 3:3'0 P.M., Tuesday, AuCJust 29,
1989, Southold Town Hall, Main Road, Southold, New York, as time and place
for a public hearincj on the aforesaid proposed Local Law which reads as follows,

I. Chapter 92 (Vehicles and Traffic) of the Code of the Town of Southol
is hereby amended as follows:
1. Section 92-41 is hereby amended by adding thereto the following:

Town Open Space Committee, effective August 15, through August 15, 1990. No

RESOLVED that the Town Board of the Town of Southold hereby appoints Frederick
A. Ross as Chairman of the Southold Town Open Space Committee, effective August
15, 1989 through August 15, 1990, he to serve in said position withour compensation.

SUPERVISOR MURPHY: Number 12 is the renewal of a single family house trailer

Southold Town Planning Board that the Town Board will accept dedication of open

mailing of information material with respect to the proposed $9,000,000 bond issue
regarding the proposed Solid Waste/Sludge Composting Facility, said informational
material to contain pertinent data concerning composting, and alternatives to
composting.

would like to address the Town Board? You may do so now.

AUGUST 15, 1989
HELEN BROWN: Supervisor Murphy, and Town Board. Helen Brown. I'm on
Route 48 in Cutchogue. ] am questioning, maybe you could help us out. I was
informed that when Mr. Dean was the Supervisor of the Highway, I believe it
was, funds were allotted for drainage system down where we live, the $outhold
Collection Center Area, and no drainage system has been placed there. I'm a
resident and I'm here with my neighbor, Mrs. Claus and we were interested
because we lost quite a few things. Our furnace is underwater. Mrs. Claus'
furnace is underwater. Arnold Wilson, he lost everything in his cellar. ~My water
pump and it's true, that these funds were allocated. What happened? Why don't
we have a drainage system there to help us out, and whether we're responsible
where these funds where allocated, it seems to me we deserve a little help with
the furnace. We're on budgets. I'n~ disabled, ..and Mrs. Claus is d~s~blecJ,and
also, I believe, Arnold Wilson at this time is, anct I'm wondering if we can ask
with the small bud§et that we live on, where are we going to get the money to get.
a new freezer, a furnace or a water pump? If these fund were allotted, are
they, the people here, are they going to put the drainage system in? Now when
we left, I don't know what's going on, but I do know that Mr. Jacobs was con-
tacted, and there is someone digging something over on the side. I don't know
if he's .working on it, or whether he's not. It's a health hazard. I am a nurse,
and it's a_health hazard. I have two grandbabies, and they're real tiny, and
the dampness and everything that's going on, I don't think it's too good, not
pertaining to us because we're older, but the little ones. I would like to know
if there's going to be something done. I don't know if I should say, I saw some-
one digging which they were contacted this morning, and if there is going to
be something done, I' would like to know if it's. not going to be swept under the
carpet, and forgotten, or whether something is going to be done to help us out.
COUNCILWOMAN COCHRAN: Helen, does this tie into the problem the church
is having also?
HELEN BROWN: That's right. Yes.
COUNCILWOMAN COCHRAN: Because Mr. Ford, that works up at Vails, spoke
to me about a week ago, and I mentioned it to Mr. Jacobs, because evidently
there was a commitment to the area up there when Mr. Dean was Superintendent
of Highways. I did mention it to Mr. Jacobs, and also, I encouraged Mr. Ford
to go over and speak to ~Mr. Jacobs, because I was serving as a middleman, and
it's certainly better if he directly fills Mr. Jacobs in as to what is the problem.
Now this was last week. I don't know if any action has been taken, or not.
HELEN BROWN: No. Just this afternoon, in fact someone called from Riverhead,
and Mr. Jacobs promised that he would send somebody down. So just before
we came here, I guess approximately 45 minutes, we saw somebc, dy digging over
there. I don't know if they're going to follow through, but we're having problems,
and I would like to ask, do you think we could get some help to get our furnace..
SUPERVISOR MURPHY: You definitely will. I don't know if we could he!p you
on home repairs. That would be with your insurance company. I had my cellar
flooded, also, but that would be an insurance company claim, but we will take
care of that. You have to realize, we had, not counting the rain some sections
yesterday. We had about 11 inches of rain in a very short period of time. The
ground just can't take water. We will clean up that for you. We're in part of,
I think maybe what Jean, you were eluding to with Ray Dean, on orginal plan
for the landfill there was going to be a sump built behind those houses in there,
because that was the natural drain of the water and we would definitely make
sure that we didn't cause flooding on to your properties. Definitely. That will
be worked on.
HELEN BROWN: Thank you.
SUPERVISOR MURPHY: And we're very sorry, it was such an exceptionally bad
storm, and it was apropos, that Mrs. Oliva said we hope we don't get any more
rain. I hope not, too.
COUNCILWOMAN COCHRAN: Mrs. Brown. Mr. Jacobs said that he would take
care of the problem. He will.
HELEN BROWN: He did make a promise.
COUNCILWOMAN COCHRAN: Yes, he will then. Then you can be guaranteed
that he wil.

JIM McMAHON: Check with Bessie, because I'm sure there are funds that, you
know, you're elicjible for funds, or housing rehab as far as emergency, you can
call Bessie. They can take care of it right away.
HELEN BROWN: Thank you very much.
SUPERVISOR MURPHY: Yes, ma'am?
VIOLA CLAUS: I'm Viola Claus. I'm her neighbor. I've already contacted Bessie
Swann, and she said it was up to the Trustees. I have been pumped out three
times in three days. Twice today, and it's up to the Town, and I can't use my
electricity, and I have no water, and I am disabled, and I live by myself.
SUPERVISOR MURPHY: Jim, would you check with Bessie, and see what we
could on...
VIOLA CLAUS: My furnace is only two years old. It cost $3,200.00 then. My
water tank is floating on top, and this morning it was coming out of the door.
Water was coming out the cellar door. It was pumped out, and they took the
pump down to Mr. Wilson, and by that time, it was up again. I have already
had three strokes, and this is not helping any.
SUPERVISOR MURPHY: No. It's not helping at all. Jim will help you.
VIOLA CLAUS: The clothes and everything that was packed in my basement.
My daughter packed them there. She's in South Carolina. They're gone. There's
boxes floating on top, that haven't been opened. I can't even get down there.
SUPERVISOR MURPHY: Jim will help you, and we will look into that drainage
and as Jean said if Mr. Jacobs said, ~we will have that taken care of.
COUNCILWOMAN COCHRAN: It will be taken care of.
SUPERVISOR MURPHY: Anyone else like' to address the Town Board? (No
response.) If not, a motion to adjourn? Thank you for coming out on such
a nasty day.
